MANIFESTATION

Complainant, through the undersigned counsel, most respectfully

manifest that;

1. During the preliminary conference the prosecutor ask that a

subpoena be served to the Physician/Records Custodian of Parañaque
Hospital.

2. It was sent and was recieved by Parañaque Hospital. They

replied to the court that the attending Physician of the Complainant
that was issued a subpoena is no longer there at the hospital.

3. Complainant followed it up when he tried to get the copy of

medico legal certificate from the hospital.

4. Complainant got to talk to the records custodian and served a

copy of the subpoena.

5. The said records custodian refused to receive the subpoena

for the reason that according to him the subpoena is addressed to
the “Physician/records custodian” and not directed to him and said
he can deny it, hence he might not appear in the hearing of this
case on June 19, 2019.
