COMPLAINT AFFIDAVIT

I, Juan Dela Cruz y Castro, 55 years old, married, resident of Hda. Lobaton,
Brgy. 8, Victorias City, Negros Occidental, after having been duly sworn to in
accordance with the law do hereby depose and say;

That I am a sugarcane laborer at the hacienda for almost thirty five (35) years;

That at about 5:50 in the morning of February 27, 2019, I am at our comfort room
taking my personal necessities and preparing myself to go to work ,when I heard a
noise coming from the motorcycle of my neighbor/brother in law in the person of Pedro
Penduko;

That right after I cautioned him in vernacular to quote “ kagahod”;

That at about 6:00 in the morning of the same date, I went out of my house to go
to hacienda to get instruction for work (arima) from our hacienda overseer
(engkargado);

That while on my way, walking along Brgy 8 road, I sensing someone following
me and when I take a look back, I saw Pedro Penduko and his two sons identified as
Gerald Penduko and George Penduko, all armed with bolo coming towards my location
and immediately Gerald Penduko threw me a stone but luckily I was not hit;

That I immediately ran and Gerald Penduko on the second time, threw me a stone
hitting me on the back portion of my head and I fell on the road;
 That right after Pedro Penduko hacked me with his bolo, hitting on the different
parts of my head and left arm until I became unconscious;

That minutes after, when I recovered, Pedro Penduko, Gerald Penduko and
George Penduko, all armed with bolo chased me and I ran for my life until I reached
inside the house of Andres Baldelovar

That right after, I took a glanced inside the house of Andres Baldelovar, I saw
Pedro Penduko, Gerald Penduko and George Penduko walking towards their house;

That after I saw that they left , I went out of the house of Andres Baldelovar and
went to the house of Marlon Rizal, driver of the service vehicle of our Brgy and
immediately he brought me to Ikaayong Lawas Foundation for medical treatment but
later they referred me to Silay Provincial Hospital for proper medical treatment;

I am executing this affidavit in my own free will and voluntary acts to attest to the
truthfulness of the foregoing facts and circumstances and to file the criminal complaint
against Pedro Penduko y Mendoza, 57 years old, resident of Hda. Lobaton, Brgy. 8,
Victorias City, Negros Occidental, for the crime of “ ATTEMPTED HOMICIDE” as well
as damage in the proper court.

I, Rosalinda Terencio y Magalona, 47 years old, separated, a resident of Teacher’s

Village, Brgy. 2A, Manapla, Negros Occidental after having duly sworn to in accordance with
The law, Do I hereby depose and say;

That I am the mother of Loleta Terencio y Magalona, who was found dead at room
number Two of Ernings Costodian Pension House, located along Roxas Street, Brgy. 5, Victorias
City, Negros Occidental, last Nov 25, 2018 at about 3:15 in the Morning;

That last Nov 25, 2018, I was with my friends at Silay City and at about 4:00 in the
morning of that same date, I received a call thru cellular phone from my sister in law, informing
me that my daughter Loleta Terencio y Magalona was found dead inside the room number two
at, Ernings Costodian Pension House located along, Roxas Street, Brgy. 5, Victorias City,
Negros Occidental, at about 3:15 in the morning and her cadaver presently lies at Jaruda
Funeral Parlor, Victorias City, Neg. Occ.;

That I immediately went to the said place and I confirmed the lifeless body of my
daughter and I came to know from the witness and from the PNP personnel of Victorias City,
Police station, that the person who responsible to the killing of my daughter was certain ;

circumstances and to file a criminal complaint for “ MURDER” against Pablo Ragamak y Basilyo
of legal age, a resident of Yap Quiña Subd., Brgy.3, Victorias City, Neg. Occ.

COMPLAINT AFFIDAVIT

I, Ma. Lourdes Lopez y Mahilum, female, 54 years old, married, resident of Hda. Loreta
Chang, Brgy. 10, Victorias City, Negros Occidental, after having been duly sworn to in
accordance with the law do hereby depose and say;

That at about 09:30 in the morning of January 3, 2018, I was at home, cleaning my
chamber pot in our water well, just located besides of my resident just near in the river bank;

That I caught by surprised, when suddenly, one of our neighbor in the person of Nancy
Apelario approached shouted at me in different libelous words but then I choose to calmed
down but then I was shocked when she slumped my chamber pot on the ground, in result it
broke into pieces and concurrently she hold my both hands tightly and without any reason she
punched me, hitting me in my right eye, which resulted to fell me on the river bank and I felt
slightly unconscious;

That lately I saw my husband assisted me towards our house in the presence of my
friend in the person of Tessie Thomas who just arrived and witnessed the said incident;

That I reported the said incident to our Brgy. hall but no settlement has been made
between us and lately I was issued a certification to file action against my respondent;

That I am executing this affidavit in my own free will and voluntary acts to attest to the
truthfulness of the foregoing facts and circumstances and to support my filling of criminal
complaints against Nancy Apelario, married, legal age, resident of Hda. Loreta Chang, Brgy. 10,
Victorias City, Negros Occidental, for the crime of “ LESS SERIOUS PHYSICAL INJURY”.

AFFIDAVIT

I, Judy Ann Santos y Mas, 80 years old, widow, residents of Garganera St., Brgy 6,
Victorias City, Negros Occidental after having been duly sworn to in accordance with law do
hereby depose and say;

That I am a OIC/Research Director of Collegio De Sta Ana De Victorias, situated along

Osmeña Avenue, Brgy. 6, Victorias City, Negros Occidental;

That at about 2:55 in the morning of September 26, 2018, I was at home, sleeping inside
my room and I was awake, when I heard the voice of my personal secretary in the person of
Dona Dee, shouted from her room which just located in front of my room to quote “MAAM”
“MAAM”;

That upon hearing, I immediately woke up and stand from my bed and open the door of
my room and I saw Dona Deez sitting on the floor in front of my room, crying and with a swollen
face, informing me in vernacular to quote “ Maam gisulod kita sang kawatan panira da kay basi
hilabtan ka nila” and because of fear, I immediately close the door of my room and locked it and
immediately called the City Disaster Risk Reduction Management Office (CDRRMO) hotline
informing them that we are forcibly entered by unidentified persons;

That I also called Mr. Diego Silang a Brgy. 6 administrator after informing him the said
incident and after a few minutes Emee Regatalio called back to me informing me that Brgy.
Tanod of Brgy 6 and Victorias PNP were already outside of my gate prompting me to go out
from my room and Olga Tiopez went outside of her room to accompanied me to go outside
where the tanod and Victorias PNP waiting for us to open the gate of my house;
 Investigation conducted by Victorias City PNP, revealed that at about 2:30 in the
morning of September 6, 2018, unidentified persons forcibly entered my house and suspects
gained entry inside of my compound by climbing over the cyclone wire perimeter fence and
forcibly open the back door of our kitchen situated at the west portion and once inside they
detached the jalousie leaves of one of the window going to our living room and by chance they
were able to entered the room of my personal secretary in the person of Dona Dee y Daanoy,
46 years old, single, resident of Had. Ining, Brgy. San Pablo, Manapla, Neg. Occ., who asleep at
that moment and wake up after sensing their presence and shouted for help but she was
mauled by the three suspects who were inside her room and keep asking her where my money
was kept.

That the three suspects was able to entered to the other room by forcibly opened it and
once inside carted away the following to wit:

 One (1) piece necklace with Spanish pendant with estimated market value of PHP
20, 000,

 One (1) piece necklace with Chinese pendant with estimated market value of PHP
20, 000,

 One (1) piece lady ring with solo brill with market value of PHP 30, 000 and

 Twenty one (21) pieces of lady ring with brills with market value of PHP 10, 000.

 One (1) unit Samsung color white touch screen cellular phone with estimated
market value of PHP 25, 000,
 All of it was placed on top of the dresser and they also forcibly opened the
cabinet and carted away cash money amounting to one hundred thousand pesos ( PHP 100,
000) which was kept inside of it.

That later I came to know from Victorias PNP that the persons who forcibly entered my
house were Roberto Duran y Villas , 18 years old, single, resident of Zone 3, Brgy. 6, Antonio
Luna y Galea, 17 years old, minor, resident of Brgy. 6, Crispin Chong y Robles, 16 years old,
minor, resident of Had. Mercedez, Brgy. Pasil, E.B. Magalona, Lebron James y Mainit alias
“kowe”, 13 years old, minor, resident of Gomburza Street, Brgy. 6, a certain Michael Jordan and
alias Bam-Bam, all of Victorias City, Neg. Occ.

That I am executing this affidavit to file a criminal complaint which will be filed against
the above named suspects for “ROBBERY”;
