DRAFT DECISION

The Factual Antedecents

This case stemmed from the Protest filed by the Appellant Lucena
Pacaña against herein Appellee Juanito Cahilig, represented by his widow,
Lilia A. Cahilig for the exclusion of the Miscellaneous Sales Application of
the portion of Lot No. 8878, Psd-20353 and/or Application for titling thereto.

Appellee filed her Opposition to the Protest with Motion to Transmit


Records to DENR Region IX Office containing her defenses. In that Juanito
Cahilig was the original owner of Lot No. 8878, Psd-20353 situated at
Kulambugan, R.T Lim, Zamboanga Sibugay. Having exclusively owned the
property in controversy, Appellee has been religiously paying the required
Real Property Tax of the same from the year 1965 to Present.

On the other hand, Appellant based her claims of ownership by virtue


of an Alleged Deed of Sale executed by one Abdul Hasim in favour of the
former’s predecessor. However, upon perusal of the alleged Deed of Sale, it
is readily apparent that the same deed refers only to a house erected on the
property and the same is silent as to the description of the land.
The Issue
I. Whether or not the DENR-IX erred in ruling in favour of the Appellees.

The Ruling

After evaluating the respective pieces of evidence presented by both parties,


this Office is inclined to rule in favour or the Appellees, thus affirming the
_____ Decision of the DENR

IN VIEW OF THE FOREGOING, the appeal is hereby denied.
