JUDICIAL AFFIDAVIT
(Pursuant to SC A.M. No.12-8-8-SC)
I Nibbles, Filipino, 21, male, single, and a resident of Melendrez Compound,Brgy. Caniogan, Pasig City,
Philippines, after having been duly sworn to in accordance with law in answer to the questions asked of
me by Atty. Christian Edward Ong, in his office at Pasig City at 1:00P.M. fully conscious that I do so
under oath and that I may face criminal liability for false testimony or perjury hereby depose and state:

Q: Mr. Witness, How are you related to the accused?

A: I am the son of hereby accused Tom.

Q: Do you know the victim and the private complainant?

A: Yes they are our neighbors.

Q: Where were you on the evening of November 29, 2018?

A: I was at home.

Q: Who is with you?

A: I was with the accused at our residence in Melendrez Compound,Brgy. Caniogan, Pasig City,
Philippines.

Q: What were you doing at home?

A: I was looking after my father who was suffering from hypertension and arthritis.

Q: What was your father doing at that time.

A: He was sleeping. He was feeling drowsy because of the medicine he took and slept from 7 pm that
evening.

Q: What happened at around 11:45 of the same evening?

A: I heard a loud firecracker like sound from outside. My father was also awaken by that sound and he
called upon me and asked me what the sound was about.

Q: What did you do next?

A: I looked outside the window where I saw a commotion. It was dark outside with only the headlights of
a vehicle on. I did not bother going outside since I do not want any part of it.

Q: Where was your father when all of this was happening?

A: He was with me inside the house. We decided it is safer to stay inside so we turn in for the night and
decided to sleep.

Q: How would you describe your father’s relationship with the victim?
A: They are not best of friends but I can say that they are friends. There were instances that they had
arguments in the past. However all of those arguments have been resolved with the help of the
barangay. They even attended a few gatherings together in our neighborhood.
