GOVERNMENT OF PAKISTAN MINISTRY OF SCIENCE AND TECHNOLOGY NOTIFICATION Islamabad, the 16th February, 2012 Thit NATIONAL INsTrTUTE OF OCEANOGRAPHY EMPLOYEES SeRvICE RULES, 2012 1. PREAMBLE (INDICATING ENABLING PROVISION) S. R. O. 192(1)/2012.—In exercise of the powers conferred by section 29 of the National Institute of Oceanography Act, 2007 (Act No. Ill of 2007), the following Rules aic hereby made and notified: CHAPTER -I GENERAL 1 Short Title and Commencement: (i) These Rules may be called the National Institute of Oceanography Employees Service Rules, 2012. Application: ‘These Rules shall apply to all the employees of the Institute. 3 Interpretation: (i) The Federal Government shall be final authority for the interpretation of these Rules and any supplementary instructions issued in connection with these Rules. i) All Rules, Regulations and Bye-laws continued in force are, so far as 4. they relate to matters provided under these Rules, stand repealed. Definitions: (1) In these Rules, unless there is anything repugnant in the subject or context:— (a) “Act”, means the NIO Act-II of 2007; (b) “Appointing Authority”, a person or an authority empowered by these tules to make appointment to a post; (c) “Competent authority”, means the Authority competent to make appointment to the post held by the employee concerned; (d) “NIO”, means the National Institute of Oceanography as constituted under the Act; (e) “Duty”, includes; (i) Service as a probationer; Gi) _ period during which an employee is on joining time; (ii) _ period of training in or outside Pakistan after appointment to a post; and (iv) period spent on board a vessel, boat (including time spent on joining the vessel or returning from it), for carrying out ParrIf] | THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 483 observations on board or allied observations ashore, whether under field programmes of the NIO or under joint programmes in which NIO is participating. (f) “Employee” means an employee in a whole time employment of the NIO; (g) “Board of Governors” mean a Body constituted under Section 6 of the Act; (h) “Grade” means a Basic Scale of Pay in which a post or group of posts is placed; (i) “Selection/Promotion Board; (a) Selection/Promotion Board means a Board constituted for the purpose of making initial appointment/promotion to the posts in BS-20 and above in the NIO. (b) Selection/Promotion Committee means a Committee constituted for the purpose of making selection for initial appointment/ promotion to the posts in BS-19 and below. () “Appellate Authority” means an authority designated as such next higher to the appointing authority; (k) “Family” means spouse of an employee, children whether residing with the Government Servant or not and dependent parents; () “Basic Pay” means the amount drawn as a basic pay each month in the prescribed scale as approved by the Institute for the post; (m) “Pay” means the amount to be drawn by an employee in a fixed pay scale of the relevant post; (n) “Emoluments” means monthly substantive pay including personal pay, special pay, qualification pay and other allowances admissible under the rules; (0) “Financial year” means the period beginning on the first day of July in a calendar year and ending on thirtieth day of June in the following calendar year; 484 THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 _ [Parr Il (p) @ © (s) w @ W) (w) &) yy) @ (aa) (bb) “Honorarium” means a recurring or non-recurring payment granted to an employee as remuneration for the special work of an occasional of intermittent character; “Leave salary” means the monthly amount paid by the institute to its employee when on leave; “Provident Fund” means Contributory Provident Fund; “[nitial appointment” means appointment made otherwise than by promotion or transfer; “Contract Employment” means the service hired for a specific period on such specific terms and conditions as may be prescribed under these Rules with prior approval of the Federal Government; “Deputationist” means a person from Federal/Provincial Governments or a local authority or a corporation or body setup or established by Government working on deputation in National Institute of Oceanography (NIO); “Lien” Title of an employee to hold substantively a post on which he/ she has been confirmed; “Federal Government” means the Government of Pakistan; “Penalty” means a penalty as prescribed under the Government Servants (Efficiency and Discipline) Rules, 1973; “Qualifying Service” means the service which begins from the date of joining the Institute subject to the fulfillment of conditions prescribed in CSR-361 but does not include the service before attaining the age of 18 years and such interruptions during which duty pay or leave or leave salary is not granted to the employee; “Regular Appointment” means an appointment whether by promotion or otherwise made in the prescribed manner; : “Regular Employee” means an employee appointed to a post on regular basis under the Rules of the Institute; “Regular/Permanent Post” means a post which is likely to continue for an indefinite period; Parrll] _ THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 485 (cc) “Service Record” means history of service, service book or service roll/ACRs maintained in such a form as might be prescribed by the Institute in which performance of an employee is recorded without any erasing or pre-writing and is duly attested by the concerned officer; (dd) “Temporary Post" means a post other than a permanent post. CHAPTER-IL DESIGNATION OF POSTS, PAY AND ALLOWANCES 5. Designation of Posts: ‘The designation of posts in the NIO shall be as sanctioned by the competent authority from time to time. 6. Pay: Means the amount drawn monthly by an employee as a pay, other than special pay or pay granted in view of his/her personal qualifications which has been sanctioned for a post held by hinv/her substantively or in an officiating capacity or to which he/she is entitled by reason of his/her position in a cadre; ii. technical pay, special pay and personal pay authorized by the authority. 7. Scales of pay and allowances: The Scales of pay means Basic Pay Scale adopted by the Federal Government from time to time and includes Management Scales in which a group of posts is placed with the approval of Competent Authority. 8. Travelling Allowance: The employees shall be entitled to the travelling allowance on transfer and tour as admissible under the government rules. CHAPTER—III APPOINTMENT, PROBATION, CONFIRMATION, SENIORITY AND PROMOTION 10. Appointment: Appointment to various posts in the Institute shall be made by one or more of the following methods and in ratio mentioned in Schedule — I:— 486 ‘THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 [PagrIl (a) _ byinitial appointment/recruitment; (b) by promotion; (c) by transfer; (a) by contract; 11. Recruitment: (1) All appointments/promotions to the posts in grade 17 to 21 shall be made by the Ministry on the recommendations of the Selection/ Promotion Board/ Committee as mentioned in Schedule-IV. (2) Departmental Selection/Promotion Board/Committee of appropriate level will be set up by the Ministry to select suitable persons for appointment/promotion to the posts in BS-16 and below in the NIO. 12. Conditions of appointment: (1) No person who is not a citizen of Pakistan shall be eligible to hold any post under the NIO. (2) Noperson married to a national of a foreign country shall be appointed to a post in the NIO except with the prior approval of the Federal Government. (3) A candidate for initial appointment must possess the educational qualifications and experience and must be within the age-limits for the purpose as laid down in the Schedule—III to these rules. (4) A candidate for recruitment must be in good mental/bodily health and free from any physical defect likely to interfere with the discharge of his/her duties. A candidate, who after such medical examination as prescribed is found not to satisfy these requirement, shall not be appointed. (5) No person whois less than 18 years of age shall be appointed toa post by initial recruitment. (6) Character and antecedents of a candidate other than the one who is already in the service of the NIO or holding a post in the Federal or Provincial Government, shall be verified and the appointment shall be made only if, in the opinion of the appointing authority, the character and antecedents are satisfactory. Parti] |THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 487 mM No person shall be substantively appointed to a permanent post without a medical certificate of health from the authority prescribed by the NIO. 13. @ Gi) ii) Gv) w) i) 14. Probation: Person appointed by initial appointment, promotion or transfer shall be on probation for a period of one year. ‘The period of probation may be curtailed for good and sufficient reasons, to be recorded or, if considered necessary, it may be extended for a period not exceeding one year as may be specitied at the time of appointment. On successfull completion of period of probation, the appointing authority shall, by a specific order, terminate the probation. If no order is issued under sub-rule (iii), on the expiry of the first year of probation, the period of probation shall be deemed to have been extended under sub-rule (ii). Where in respect of any post, the satisfactory completion of probation includes the passing of an examination, test or course or successful completion of any training, a person appointment on probation to such post who, before the expiry of the original extended period of probation, fails to pass such examination, test, course or complete training, as the case may be, shall stand discharged from service or reverted to the post from which he/she was promoted. An employee appointed by initial appointment shall not be deemed to have completed his/her period of probation satisfactory until his/her character and antecedents have been verified to the satisfaction of the appointing authority. Confirmation: Confirmation of the employees of the NIO shall be made in accordance with the rules/instructions issued by the Federal Government from time to time. 15. Seniority: Seniority of the employees of the NIO shall be determined in accordance with the rules/instructions issued by the Federal Government from time to time. 488 THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 __ [Pari 15-A. Initial Appointment: (Persons recruited directly through an earlier open advertisement or selection would rank senior to those recruited through a subsequent ‘open advertisement or selection. Gi) _Iftwo or more persons are appointed in open advertisement or selection, their inter-se-seniority would be determined in the order of merit assigned by Departmental Selection Board/Committee as the case may be. Gi) If only one candidate is appointed in open advertisement or selection, he/she would count his/her seniority from the date of recommendation by the Departmental Selection Board/Committee or the date of joining the post, whichever is later. (a) _ If the person was already holding the same post on ad hoc basis, he/she would count his/her seniority from the date of recommendation by the Departmental Selection Board/ Committee. (b) _ Ifthe person was not already holding the same post, he/she would count his/her seniority from the date of his/her joining the post after being recommended by the Departmental Selection Board/ Committee. 16, Promotion: (1) An officer possessing such minimum qualification as prescribed in ‘Schedule-II shall be eligible for promotion toa higher post for the time being reserved under the rules for departmental promotion in the service or cadre to which he/she belongs. Non-selection posts: (2) All posts in grade 2 to 19 shall be deemed to be Non-Selection posts. (3) Promotion to non-Selection Posts shall be on the basis of seniority- cum-fitness. Selection posts: (4) All posts in grade 20 and above shall be deemed to be selection posts. All promotion in the Institute shall be made keeping in view the guideline contained in the Promotion Policy of the Federal Government. Criteria for performance evaluation for promotion As per instructions contained in the Book, A Guide to Performance Evaluation, 2004 published by Pakistan Public Administration Research Centre and promotion policy of the Federal Government issued vide Establishment Division's D.O. letter No. 10(3)/81-C-P-I(P0), dated 31-10-1982 as amended vide O.M. No. 1/3/2007-C-P-I dated 24-10-2007. 17, Appointment by Transfer: (1) Appointment by transfer shall be made on the recommendations of the Selection Board/Departmental Promotion Committee as specified in Schedule-IV to these rules. (2) Appointment by transfer shall be made by the appointing authority from amongst the persons holding appointment on regular basis in a post in the same pay scale or equivalent to or identical with the post to be filled. (3) Only such persons as possess the qualifications and meet the conditions laid down for the purpose of transfer to the post shall be considered by the Selection Board/Departmental Promotion Committee for appointment by transfer. 17.1 Posting and Transfer: (1) Anemployee shall be liable to transfer on any post in the Institute or in any of its set-up, controlled or managed by the Institute. (2) The Director General or designated authority may transfer any employee from one post to another within the Institute on the same terms and conditions of employment. (3) Deputation within Pakistan: As per the instructions of the Federal Government issued vide O.M. No. 1/28/75-D IVR. 3/R.I, dated 18-02-1987 and 11-04-2000. (4) Restrictions on Deputation: No employee initially appointed shall be considered for deputation unless he/she has served for at least five years in the Institute from the date of his/her initial appointment to a post in the Institute. 490 THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 _ {Parr 18. Creation of posts of consultants and experts on contract basis: ‘The creation of posts of consultants and experts on contract basis shall vest in BoG as per Section 8(E) of NIO Act-2007. CHAPTER-IV RETIREMENT, RESIGNATION AND TERMINATION OF SERVICE 19. Retirement from service: (1) Anemployee shall retire from service: ()_ Onsuch date, after he/she has completed twenty years of service qualifying for pension or other retirement benefits as the Competent Authority may, in the public interest, direct; Gi) Where no direction is given under clause (i), on the completion of sixty years of his/her age. (2) No direction under clause (i) of sub-rule (1) shall be made until the employee has been informed in writing of the grounds on which it is proposed to make the direction and has been given responsible opportunity of showing the cause against the said direction. Explanation: In this rule competent authority means the appointing authority prescribed in scheduie-1V. 20, Resignation: An employee wishing to terminate his/her appointment will submit his/her resignation in writing. He/she will continue to be in the service of the Authority until hisher resignation is formally accepted by the appointing authority. The option of resignation shall not be available to 2n employee or officer against whorn disciplinary proceedings are pending or are contemplated against him/her or who is under a bond to serve the Authority for a specific period. 21. Termination of service: (1) The service of an employee may be terminated without uctice:- (@) during the initiaV/extended period of his/her probation: Provided that, where such employee is appointed by pr motion on probation or, as the case may be is transferred from one cadre or post Parti] __THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 491 to another cadre or post, his/her service shall not be so terminated so long as he/she holds a lien against his/her post as the case may be; Gi) On the expiry of the i and tial or extended period of his/her employment; (2) Where, on the abolition of a post or reduction in the number of posts in a cadre, the services of an employee are required to be terminated, the person “whose services are terminated shall ordinarily be the one who is the most junior in such cadre, (3) Notwithstanding the provisions of Sub-Rule (1) but subject to the Provisions of Sub-Rule (2), the services of an employee in temporary employment or daily wages shalll be liable to termination on fourteen days notice or pay in lieu thereof. 22. Employment after retirement: The re-employment on contract after retirement shall be made in accordance with Federal Government instructions issued vide O.M No.6/2/2000-R3, dated 6th May, 2000 as amended from time to time. CHAPTER-V iG, DEPUTATION, LEAVE AND JOINING TIME view of Rule 17.1 24. Training: The NIO may require an employee to under-go training within or outside Pakistan at any time and for any duration on such terms and conditions as it may specify from time to time. 25. Leave: Anemployee shall be entitled to such leave as is admissible to the employees of Federal Government under the revised Leave Rules, 1980, as amended from time to time. In the case of Director General the competent authority to grant leave (including castial leave) shall be the Secretary of the administrative Mit istry but the ex-Pakistan leave of the officers in BS-17 apd above shall be sanctioned by the Secretary of the administrative Ministry. 492 ‘THE GAZETTE OF PAKISTAN, EXTRA., FEBRUARY 23, 2012 _ [Parr 26. Joining Time: The employee shall be entitled to the joining time on transfer from one station to another on such terms and conditions as are admissible to the civil servants of the Federal Government. CHAPTER-VI GENERAL, CONDUCT AND DISCIPLINE 27. Conduct and discipline: The conduct of an employee shall be regulated by the Government Servants (Conduct) Rules, 1964. An employee shall be liable to disciplinary action and penalties in accordance with the procedure prescribed in the Government Servants (Efficiency and Discipline) Rules, 1973. 28. Compliance with orders: Every employee shall conform to and abide by these Rules and shall comply with and obey all orders and directions which may from time to time be given by any person or persons under whose jurisdiction, superintendence or control may, for the time being, have been placed. CHAPTER-VII SERVICE RECORD 29. Conduct and discipline: As per instructions of the Federal Government issued from time to time. CHAPTER-VIII MISCELLANEOUS 30. Training, medical facilities and allocation of residential accommodation: The NIO employees will be governed by the rules on the subject as may be prescribed by the NIO from time to time with the prior approval of the Federal Government. Terminal Benefits: The Institutes employees shall be entitled to such terminal benefits as are prescribed with the prior approval of the Federal Government.
