WITNESSETH;
WHEREAS, the FIRST PARTY is the actual occupant of a house erected in a portion of
FELICITAS N. MALUBAY
WHEREAS, the FIRST PARTY have been responsible in paying the real property tax for
the said house up to this date;
WHEREAS, the SECOND PARTY claiming rights over the aforementioned portion of lot
brought the issue to the Tengco Homeowners Association;
WHEREAS, during one of the meeting set before the Tengco Homeowners Association,
BOTH PARTIES have agreed to a settlement, as witnessed by then Homeowners
Association President, EDGARDO S. CADA,
WHEREAS, due to lack of documentation or records of the settlement made before the
Tengco Homeowners Association, BOTH PARTIES intend to formalize the agreement

NOW, THEREFORE, for and in consideration of the foregoing premises and subject to
the terms and conditions herein below specified, the parties have agreed and do
covenant with each other as follows:
1. The FIRST PARTY shall pay the SECOND PARTY the amount of TWENTY
THOUSAND PESOS (PhP20,000.00) Philippine Currency, representing payment
for the immediate relocation of the septic vault situated under the premises of
FIRST PARTY’s assigned parcel of land to the SECOND PARTY’s assigned parcel
of land.
2. Any excess in the cost of the relocation of aforementioned septic vault shall be
the obligation of the SECOND PARTY.

3. In the event that SECOND PARTY fails to cause the relocation of the septic vault
within thirty (30) days upon receipt of the full amount stated in the preceding
condition or opted not to relocate the said septic vault despite of payment made,
the FIRST PARTY reserves the right to prohibit SECOND PARTY from any future
request to relocate the septic vault or open the septic vault cover for purposes of
siphoning or dislodging in case of an overflow in the sewer system, except when
the FIRST PARTY expressly permits the SECOND PARTY by means of a written
consent.
4. That after paying the amount stated in the preceding condition, the SECOND
PARTY shall acknowledge FIRST PARTY’s conditional right over the parcel of land
wherein their house was erected and with postal address at 406 Tengco Street,
Pasay City,
This Agreement, including all terms and conditions hereof, is expressly and voluntarily
agreed upon by the parties.
