Following are the factual antecedents as narrated by the victim, Diana Ang to PCpl

Megara Santos:

On October 27, 2011 at around 11 p.m., Diana Ang, 20 years old, 5 months
pregnant, married but estranged from her husband, Jeremiah Catigas, met with her
boyfriend, Eugenio Cruzetes, 30 years old, single, and went to the Robinsons Place
Malate, Manila. After watching movies and dinner in the said mall, Eugenio and
Diana decided to go. They left the Robinsons Mall Valet Parking at around 2:30
A.M onboard a red Honda CR-V being driven by Eugenio Cruzetes with Diana riding
at the back of the vehicle for her to be able to lie down.

When they reached the Jones Bridge at around 3:00 AM, Eugenio stopped and
alighted from the vehicle to check the rear lights and repeatedly opened and closed
the right door for more or less 5 minutes. Suddenly, a taxicab arrived at the rear of
their vehicle wherein three men alighted and approached them from behind pointing
deadly weapons to Eugenio forcing him to enter the vehicle. One man armed with a
knife, Identified by Diana as Pedro Coranez went to the back left side seat, while
another man, armed with a gun, Identified by Diana as Jessie Tapales entered the
driver’s seat, finally another man identified by Diana as Tomas Eugenia occupied
the passenger seat. After entering the vehicle, the men declared “Hold-up ito!
kailangan lang naming ang pera mo”. Jessie Tapales got Eugenio’s wristwatch, while
Pedro Coranez robbed Diana’s iPhone X, Laptop and wallet containing P 10,000
worth of cash.

While robbing the helpless victims, they continued driving the Jones Bridge, made a
“U” turn and turned right going to Bonifacio Drive until they reached the Fire
Department in Intramuros. Eugenio started to shout “Hold-up, Hold up” trying to
make a scene and gather help to the passers-by, prompting Pedro Coranez to stab
him and Jessie Tapales to shot the powerless victim. The driver, Tomas Eugenia told
Eugenio “Pare tumalon ka na lang”. While Eugenio was heavily wounded, Diana,
forcefully attempted to get the knife from Coranez. Eugenia then, after being stabbed
and shot, jump out of the vehicle through the window. Blood-filled and dying Eugenio
Cruzetes fell in the middle of Delpan Bridge.

Diana fearful for her life and her unborn child pleaded to the perpetrator but only
heard in vain. Then Pedro Coranez ordered Jessie Tapales to proceed to “Kapatid”
in Kamuning, Quezon City but THEN Tapales looked for a vacant lot INSTEAD.
Arriving at a vacant lot, the men ordered Diana Ang to alight from the vehicle
followed by Corales and Tapales. ABOUT 6 METERS FROM WHERE THEY
ALIGHTED, Tapales GAVE HIS JACKET TO DIANA then instructed HER to lie down
THE GRASS and there Corales and Tapales took turns on raping the hapless victim
while the other one served as the look-out. Diana admitted that the perpetrators did
not use any weapon and she opted to submit HERSELF when Tapales and Corales
sexually assaulted her because she was scared for her life and her CHILD.

After the inhumane acts of Corales and Tapales to Diana, the three went back to the
vehicle after which she was finally dropped off by the perpetrators in dark areas in
MIA Road. Before alighting from the vehicle, the perpetrators gave money to Diana
threatened to kill her if she reported her ordeal to the police.
Diana losing her sense of self, She went to the Centris Mall and told the people
around her dreadful experience. A concerned citizen accompanied her to Police
Precinct 8 to report the incident.

The following day, Diana went to Precinct 2 of QCPD where she saw the shoes of
her boyfriend EUGENIO. She was then taken by the police to the morgue and
positively identified the dead body of her boyfriend, Eugenio Cruzales. The next
morning Diana was physically examined by one Dr. Lucero at Precinct 2. In that
same day, she was physically examined by Dr. Lucero and was positively examined
as physically and sexually abused.

After narrating her ordeal, a hot pursuit was ensued prompting the immediate arrest
of Pedro Coralez, 40 years old, single; Jessie Tapales, 42 years old, single; and
Tomas Eugenio 38 years old, single. All three were positively identified by Diana
Ang.

Follow-up investigations conducted revealed that:

(a) Dr. Donnalyn Diaz, conducted a medico-legal examination and came up with
these findings: (1) lacerations at the labia minora at 6 and 9 o'clock positions and (2)
erythema in her vaginal area. Dr. Diaz also positively confirmed that Diana Ang was
5 months pregnant and further advised her to have STD prophylaxis;
(b) Mr. Good Nacario, duty barangay tanod during the time of the incident, saw the
red Honda CR-V to pass-by but noticed nothing unusual as the said area of the
incident is not covered by CCTV installed in the Jones bridge;
(c) , a street dweller, saw that unidentified men alighted from a taxi cab and at knife-
point forced Eugenio Cruzetes to ride the CR-V;
(d) John Salazar, a Valet Parking Assistant, confirmed that the CR-V vehicle of the
victims entered the Robinsons mall at about 11:00 PM and went out at about 2:00
AM.
