UPON PAYMENT of the sumof ₹ 2,00,000 paid by Buyer to Seller (the “Purchase Price”), receipt of
which is hereby acknowledged, Seller grants, sells, conveys and transfers ownership of the following
dog (the “Dog”) toBuyer:

ThepartiesacceptandagreetobeboundbytheattachedTermsandConditions
governingthepurchaseandsaleoftheDog.
In the event that the Dog is not available due to sickness, death, or any other circumstance owing to
the fault of Seller, Buyer’s deposit will, at Buyer’s option, be either (i) refunded, or (ii) transferred to
the next litter of puppies.
The dog is being sold as a show prospect. The Buyer agrees that "show prospect" does not guarantee
that the dog will win any prizes in dog shows, nor is it a guarantee that the dog will not develop faults
as it matures. The Buyer agrees to not breed the dog prior to
a) Winning dog shows and
b) Completion of all health certifications, as noted below, except with the express permission of the
Seller.
The Buyer agrees to make a reasonable attempt to complete the dog’s training. The Buyer agrees to
not spay or neuter the dog without written permission from the Seller, except where such surgery is
required as an emergency life-saving procedure. The following actions are assumed to constitute a
“reasonable attempt” to complete dog’s championship:
Attending handling and or puppy socialization classes, where available
Keeping the dog in show coat and good physical condition, as recommended by the Seller
Utilizing the services of a reputable professional handler (at the Buyer’s option)
Entering and exhibiting the dog in shows when it is mature, in show coat, and in good
physical condition
If health problems of a hereditary or congenital nature that would prevent or preclude showing or
breeding the dog are found at any time before 3 years of age, or if the dog does not develop to be of
sufficient quality (as agreed by the Seller) by 4 years of age to compete in dog shows and to be of
breeding quality, the Buyer may choose to either
a) keep the dog (and provide proof of spay/neuter to the Seller) and receive a refund of 1/5 of the
purchase price or
b) to return the dog to the Seller and receive a refund of 1/2 of the purchase price.
Alternatively, a replacement puppy may be taken in lieu of a monetary refund, by mutual agreement
of both buyer and seller.
The Seller’s liability for Guarantee is limited to the original purchase costs paid by the Buyer. The
Seller has the right to request proof of health problems, including the right to request copies of all
veterinary records pertaining to the problem, and the right to communicate directly with the
veterinarian(s) involved in the case.
2. Transfer of Ownership andRegistration
Upon payment in full of the Purchase Price, Seller (at Seller’s sole cost) shall promptly take all actions
required to officially transfer ownership and registration (if any) of the Dog to Buyer.
4. Fitness ofPurpose
The Dog was bred as a companion animal, and Seller does not provide any warranty as to the Dog’s
fitness for any specific purpose, including obedience trials, show ring performance, and/or breeding
purposes.
5. Buyer’sRepresentations
Buyer represents to Seller that:
(a) Buyer will have the Dog spayed or neutered by the age of sixmonths.
(b) The Dog will reside with Buyer as companion pet to Buyer and Buyer’sfamily.
(c) Buyer will keep the Dog in an enclosed area of adequate size, and will not allow the Dog to
roam at will. Buyer will not keep the Dog chained or tethered or permanently house the Dog
in a kennel.
(d) Buyer will provide the Dog with nutritious food and necessary veterinary care, including de-
worming, heartworm prevention and regular vaccinations (includingrabies).
(e) Buyer is not acting as agent for any other person or business in the purchase of theDog.
(f) Buyer will not sell, give, or release the Dog to a pet shop, retail store, dog dealer, animal
testing facility, research facility, or an agent for any such business orfacility.
(g) In the event Buyer sells the Dog to a new owner, Buyer shall ensure that the new owner
agrees in writing to comply with the terms of thisAgreement.
6. Indemnity andRelease
If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury,
death, or liability, Buyer agrees to defend, indemnify, and hold Seller harmless and to pay all of
Seller’s costs and expenses, including reasonable legal fees, any amount paid in settlement and any
award or judgment with respect thereto. Buyer releases Seller from any and all liability, costs or
damages caused by the Dog after placement with Seller, including but not limited to damage to or
destruction of property, and injury to anyperson.
7. Limitation ofAction
Any action or claim brought by Buyer against Seller for breach of this Agreement or for loss due to
negligence must be brought within one (1) year of the date such claim or loss occurs.
8. GoverningLaw
This Agreement shall be governed by and construed in accordance with the laws of Government of
India.
9. EntireAgreement
This Agreement represents the entire agreement between the parties. Seller and Buyer have made no
other agreements, promises, representations or warranties, express or implied, unless specifically
stated in thisAgreement.
