ORDINANCE NO. 9

AN ORDINANCE PROHIBITING LITTERING AND REQUIRING TRASH CANS OR


REFUSE CONTAINERS TO BE PROVIDED IN EVERY BUILDING AND PUBLIC
CONVEYANCE.

Be it ordained by the Municipal Council of Calapan, Oriental Mindoro, that:

SECTION I – It shall be unlawful for any person to throw, deposit or allow to fall or
cause to be thrown, placed or deposited any refuse, fecal matters, urine, garbage, rubbish, in any
yard, street, vacant lot, park, rivers, canals and esteros. For purposes of this ordinance, the
aforementioned terms shall have the following conditions:

a) The term “refuse” shall mean the solid waste products or those having the character
of solids rather than liquid in that they will not readily without additional liquid and
which are composed wholly or partly of such materials as garbage sweepings,
cleaning, rubbish, industrial solid wastes or domestic solid wastes; organic waste or
residue of animals, matters from kitchen, dining rooms, markets, food establishments
or places dealing in handling meat, fowl, fruit grains, or vegetables, or the carcasses
of animals; tree or shrub trimmings, grass clippings, brick, plaster or other waste
matter resulting from the demolition, alteration or construction of buildings or
structure, accumulated waste materials, cans, containers, tires, junks, or other such
substances which may become a nuisance;

b) The term “garbage” shall include every accumulation of animal, vegetable or other
matter that attempt the preparation, consumption, decay, storage of meat, fish, fowl,
birds, fruits, or along with such material. For the purposes of this ordinance,
carcasses of dead animals, dog manure, feces, or waste parts of a butchered animals,
or refuse from slaughterhouse shall be considered as garbage.

c) The term “rubbish” shall include wastes or rejected materials that does not easily
decay such as used papers, paste boards, woven materials, broken glasses, porcelain,
glass, rags, wood, leaves, ashes, street sweeping or any other matter or similar kind
by which such development of any business or industry in the municipality may
produce.

SECTION II – It shall be the duty of every tenant, lessees, or occupant of any private
dwelling house, the keeper of hotel restaurant, eating place or other buildings where meals are
served, the owner of the apartment house, hotel and of every person having garbage or rubbish to
provide and keep within said building or on the lot on which the building or business is situated
suitable and sufficient containers of adequate size to handle the accumulation of garbage or
rubbish on the premises.

SECTION III – It shall be the duty of every owner and/or operator of any public
conveyance doing business within this municipality such as jeep, buses, tricycles or calesas to
provide within their vehicle a can or box for garbage or refuse, plainly marked: “FOR TRASH
ONLY”.

SECTION IV – Any ordinance inconsistent herewith is hereby modified or revoked


accordingly.

SECTION V – this ordinance shall take effect upon approval.

PENALTIES

Violation of any of the provisions of this ordinance, shall subject the offender to a fine of
not less than FIVE (P5.00) PESOS or an imprisonment of not less than TWO (2) DAYS for the
first offense; no less than TEN (P10.00) PESOS or not less than FIVE (5) DAYS imprisonment
for the second offense and FIFTEEN (P15.00) PESOS or an imprisonment of EIGHT (8) DAYS
for the third offense or both fine and imprisonment at the discretion of the Court.
