(Hereinafter referred to as the “LANDLORD” and this expression wherever the context so requires
or admits shall mean and include its, legal representatives, nominees, permitted assignees,
administrators, executors, successors in title etc.,) of the FIRST PART.

RESIDING AT Flat No C-0303, 3rd Floor in Block ‘C , KHB PLATINUM APARTMENTS,
KENGERI SATELLITE TOWN, KENGERI-560060.

(Hereinafter referred to as the “TENANT”,this expression wherever the context so requires or


admits shall mean and include its, legal representatives, nominees, permitted assignees,
administrators, executors, successors in title etc.,) of the SECOND PART.

WHEREAS, the LANDLORD is the absolute owner of all that piece and parcel of Flat No.
C-0303 at 3rd Floor in Block ‘C’ KHB PLATINUM APARTMENTS, KENGERI SATELLITE
TOWN, KENGERI-560060. having a super built-up area of 94.29 Sq. mts. inclusive of
proportionate share of common areas and consisting of Hall, Kitchen, Balconies, Wash area, 2
(Two) Bed Rooms, 2(Two) Toilet cum Bath Rooms, electricity and water facilities, R.C.C. roofed
building (hereinafter referred to as the “Schedule Premises”). WHEREAS, on 09/06/2017 the
LANDLORD has put to the TENANT in peaceful possession and enjoyment of the Schedule
Premises on rental basis or on month-to-month tenancy basis.
WHEREAS, pursuant to the TENANT was put in possession of the Schedule Premises on rental
basis, the TENANT had agreed to pay an amount of Rs. 50,000/- (Rupees Fifty Thousand Only) to
refundable security deposit and Rs.12,000/-(Rupees Twelve Thousand Only) as monthly rentals
which shall be paid by the TENANT to LANDLORD without fail.

WHEREAS, the TENANT paid the LANDLORD an amount of Rs.5000/- (Rupees Five Thousand
Only) as a partial payment to refundable security and further has paid an amount of
Rs.1,32,000/(Rupees One Lakh Thirty Two Thousands Only) as monthly rental from July, 2017 to
May, 2018.

WHEREAS, due to unforeseen circumstances, the TENANT is unable to pay the monthly rentals
to the LANDLORD and the TENANT is in arrears on monthly rentals from June , 2018 to till date
for a sum of Rs 1,20,000/-(Rupees One Lakh Twenty Thousand Only).

WHEREAS, the TENANT has approached the LANDLORD with a request to grant time to pay
the arrears of monthly rentals and handover the vacant possession of the Schedule Premises to the
LANDLORD and based on the mutual negotiations and understanding, the parties to this MOU
have mutually agreed to a settlement based on the following terms and conditions.

HENCE THIS MOU IS NOW MADE AND THE PARTIES HERETO AGREE AS
FOLLOWS:

1. ARREARS OF MONTHLY RENTALS:

The Tenant hereby agrees to pay an amount of Rs. 1,20,000/- (Rupees ONE LAKH TWENTY
THOUSANDV Only) towards the arrears of monthly rentals from June , 2018 to March, 2019
within a period of ____________ days period from the date of signing of this MOU.

The TENANT agrees to pay the aforesaid amount of Rs.1,20,000/-(Rupees One Lakh Twenty
Thousand Only) within stipulated period mentioned above. In this regard, the TENANT has
issued a cheque in favour of the LANDLORD, the details of the cheque are mentioned below:

2. HANDOVER PEACEFUL POSSESSION OF THE SCHEDULE PREMISES:

The TENANT agrees to handover the peaceful possession of the Schedule Premises to the
LANDLORD within a period of ___________ days from the date of signing this MOU.

The Tenant hereby agrees to pay monthly rentals for subsequent months post signing this MOU
to the LANDLORD and the said amount shall be paid prior to handing over the peaceful
possession of the Schedule Premises to the LANDLORD.

The Tenant agrees to bear the painting charges and other charges towards damages caused to
the Schedule Premises, the said amount shall be paid by the TENANT at the time of handing
over the possession of the Schedule Premises to the LANDLORD.

3. GOVERNING LAW:

This MOU shall be governed and construed in accordance with the laws of India.

4. WAIVER:

It is expressly understood that if either party on any occasion fails to perform any term of this
MOU and the other party does not enforce that term, the failure to enforce on that occasion
shall not prevent enforcement on any other occasion.

5. SEVERABILITY:

a. Each Clause of this MOU is severable. If any provision is held unenforceable by a court of
competent jurisdiction, such ruling shall not impair any other provision/s that remains
intelligible and all other provisions shall continue in effect.

6. POSSESSION OF MOU:

a. The Original of this MOU shall be in possession of the LANDLORD and the photocopy of
this MOU shall be handed over to the TENANT.

7. SUPERSEDES PRIOR COMMUNICATIONS:


The parties hereto acknowledge that this MOU supersedes all prior communications between
them including all oral or written proposals. Any variation, addition and modifications of this
MOU between the parties shall be valid only if in writing signed by the parties.

8. STAMP DUTY, REGISTRATION CHARGES AND INCIDENTAL EXPENSES:


All stamp duty and other miscellaneous charges shall be borne by the TENANT only.

IN WITNESS WHEREOF THE PARTIES HERETO HAVE EXECUTED AND


DELIVERED THIS MOU ON THE DAY AND THE YEAR FIRST WRITTEN ABOVE IN
THE PRESENCE OF THE FOLLOWING WITNESSES:

facilities, R.C.C. roofed building and same is bounded on:-

EAST : Flat No. C-0304;


WEST : Flat No. C-0302;
NORTH : Open to Sky;
SOUTH : Lobby and Lift;

Fitting and Fixtures are also provided to the TENANT in the Schedule Premises are mentioned
below:

1. Fans – in Numbers

2. Tube lights- in Numbers

3. Bed Room Wardrobe with mirror- 2 in Numbers.

4. Modular Kitchen Cabinet -1 in Number.

5. TV cabinet with drawers-1 in Number
