Gentlemen:

This is to acknowledge receipt of your notice to vacate dated 20 August 2019.

Upon careful perusal of the content therein, we are not amenable to some of the provisions of
your proposed agreement. While it is true that you have the right as lessor of the unit to issue a
notice to vacate, however, this must be founded on valid legal grounds pursuant to RA 9653
Section 9. Please take a look also at the penalties for violation of this law.

Considering that your claim is based on your alleged legitimate need to use the property or to
be used by an immediate member of your family, you should have stated in particular who
among the member will be using said unit. What is his/her name and how are you related to that
person. As stated in the law, such person who will be using the unit must be an immediate
member of the family.

Moreover, we do not agree to option 2 in your letter for the reason that this is not in accordance
to what we have agreed upon during our barangay conciliation. This is still subject to further
discussion.

Thus, we will just receive this letter and we still have to talk among the family what will be our
appropriate action to take.

Thank you and hoping that we will arrive soon at an amicable settlement acceptable to both
parties.
