JUDICIAL AFFIDAAVIT OF
MARCELINA POMOY

This Judicial Affidavit of MARCELINA POMOY is being offered, in lieu

of her oral testimony on direct examination pursuant to A.M. 12-8-8-SC,
otherwise known as the Judicial Affidavit Rule, for the following purposes, to
wiet:
1. To prove that the plaintiff is the mother of defendant, Roland Pomoy and
she was the wife of Marcelito Pomoy who died on 1 July 2007;

2. To prove that Marcelito Pomoy was the registered owner of a parcel of land
under Transfer Certificate of Title no. T-161273 located at San Isidro (Now
Naganacan), Cauayan City, Isabela with an area of Ten Thousand (10,000 sq. m.)
square meters;

3. To prove that on 6 February 2014 a Deed of Donation was executed

purportedly by Marcelito Pomoy with the consent of his wife MARCELINA
POMOY in favor of the accused, Roland I. Pomoy covering the parcel of land
under TCT No. T-161273.
 4. To prove that at the time of the execution of the Deed of Donation Marcelito
Pomoy was already deceased having died on 1 July 2007;

5. To prove that Transfer Certificate of Title No. T-161273 was cancelled by

reason of the Deed of Donation and the land now is registered in the name of the
defendant, Roland I. Pomoy under Transfer Certificate of Title No. 035-
2015000075 issued by the Registry of Deed for the Province of Isabela dated 29
April 2014;

PRELIMINARY STATEMENT

my sons.)

that you both owned a land located in San Isidro (Naganacan),

Transfer Certificate of Title No. T-161273. (There is, Sir. That land
is one of our farmland with an area of Ten Thousand (10,000) square

 Lacantara told me in 2014 that the land is owned by Roland I.
Pomoy, that is why I am surprised.)

daga. (I was surprised because me and my husband did not sell the
land to him and we did not convey the land to him.)

and I told him that the land is now owned by Roland I. Pomoy.)

that a Deed of Donation was used as an evidence that we donated the
land to Roland I. Pomoy in February, 2014.)

impossible for us to have signed the Deed of Donation because my
husband was already dead on July 1, 2007.)

Exhibit “B” and below at the right side is the signature above the
name of Marcelito Pomoy.)

2007. (I do not know whose signature is that but I am sure that it is
not of my husband because he was already dead on July 1, 2007.)

Sir. (I cannot remember that I signed that Deed of Donation, Sir.)

nagidarum kenyak ditoy. (I know him because he helped me with my
problem regarding the name of my son Roland Pomoy who filed a
complaint against me in this case.)

with that problem, is there any other situation where you went to him

granddaughter Brechelle Marie Pomoy showed me a document in
April 2015 and explained to me that my husband leased the said
 property with TCT No T-161273 amounting to P500,000.00 in favor
of Darius P. Alcantara on November 2014, and this is not true
because my husband was already dead on July 1, 2007.)

the information about this, in the same date, April, 2015, I went to
the office of Atty Ferdinand D. Ercill to ask help again regarding this
issue.)

A: Nagaramid isuna iti surat para ken ni Darius P. Alcantara tapno

addressed to Darius P. Alcantara to invite him to come to the office
of Atty. Ferdinand d. Ercilla so that the matter be clarified.)

came to the office of Atty. Ferdinand Ercilla and he told us that he
would wait for Roland I Pomoy who was the brainchild of the

After our encounter with Darius P. Alcantaa in April 2015, I went
again at the office of Atty. Ferdinand D. Ercilla to ask his opinion
regarding the paper my son Roland I. Pomoy and Darius P. alcantara
sought me to sign, because I can not understand what they asked me
to sign on May, 2014.)

Cauayan City, Isabela iti gated nga Php2,500,000.00 ken ni Darius
P. Alcantra. (Atty. Ferdinand d. Ercilla explained to me that what I
signed is a document which states that I leased my five (5) hectare
land situated in Barangay Naganacan, Cauayan City, Isabela,
amounting to P2.5M pesos.)

problems which they perpetrated.)

that the lease agreement be rescinded which had no truth in it, and
because there is too much bad mouthing against me from my son
Roland I. Pomoy, I just signed the document because I do not
understand what I signed.)

Memorandum of Agreement shows that the total of six hectares of
your land located in Naganacan, Cauayan City, Isabela was
conveyed to Roland I. Pomoy out of the 10,000 square meters located
in front as first of his inheritance, in addition to this, is another land
situated at the far end which is bequeathed to Roland Pomoy. It also
states that Roland I. Pomoy shall pay Consuelo Pomong-Domingo
Php800,000.00, what can you say about this?)

A: Awan ti kasta nga nagtutulagan mi, sir. Haan nga naibaga ken

have any agreement like that, Sir. I was not informed and explained
about that. If I only knew of the content of the document, I would
have not have signed because I am still alive, and I do not have the
plan to bequeath the property. I do not know of the amount of
P800,000.00 given to Consuelo Pomoy-Domingo.)

Sir.)

said to me that he will give me the original copy of TCT No. 161273
so that he has a title to it, and he would be the one to settle everything
pertinent to all our properties with my husband.

161273 because I believed in what he said.)

(Roland Pomoy said that he made you his caretaker of the ricemill
and seed growing business. He said that you were not able to account
the income of the business, and that is why he disallowed you to
manage the businesses, and that is the reason why you went to ask
the help of the PAO. What can you say about that?)

the issue in this case, what can you say about this?)

pagbayadan na. (That is not true. I have not said that, and why should
he pay Consuelo when I am here as the payee?)

maibagam iti dayta. (Roland Pomoy said that you gave gime the
original copy of TCT no. 035-2015000075, what can you say about
that?)

and the Deed of Donation, what can you say about that?)

What do I know about that document, I only finished grade 3.)

repeatedly says that his wife sent you USD18600 as payment of the
land, for which is the issue on this case, and you were allegedly
called regarding this.

nga banag. Ken apay nga ni Consuelo ti pagbayadan naket siyak met

 cannot show any receipt? Consuelo has not called me about this
thing.)

have this case?)

daytoy nga kaso? (And, what do you feel about the actions of Roland
I. Pomoy in this case?)

agassawa. (It hurts because of his deceitful acts on our properties as
husband and wife.)
