DARIN EVAVOLD FOR COMPLIANCE OF THE ISSUED SUBPOENA FOR HIS
DEPOSITION AND MOTION TO MODIFY SCHEDULING ORDER

Defendants in the Declaratory Judgment proceeding, Court File No.: 19HA-CV-18-905

and Plaintiffs in the underlying action, Court File No.: 19HA-CV-18-4289, David V. Rucki,

Samantha Rucki and Gianna Rucki, (“The Ruckis”) hereby join in Plaintiff State Farm Fire and

Casualty Company’s Motion to Compel the Depositions of Defendant Deirdre Elise Evavold and

Issuance of a Directive to Darin Evavold and to Amend the Scheduling Order (in both cases) and

for reasonable expenses and attorney fees in bringing this pending motion on behalf of The

Ruckis’.

This motion is based upon the Affidavit of Lisa M. Elliott and exhibits filed and served

herewith and argument thereon, and upon all files, records and proceedings herein.
