Section 5. Reporting Requirement.

– All schools shall inform their respective schools


division superintendents in writing about the anti-bullying policies formulated within six
(6) months from the effectivity of this Act. Such notification shall likewise be an
administrative requirement prior to the operation of new schools.

 Schools are directed to adopt policies, which are to be regularly updated, to address the
existence of bullying in their respective institutions. These policies are to be reported to
the appropriate school division superintendent of the Department of Education
(“Department”) during the first week of every academic year. During this period, the
School shall also submit a report of relevant information and statistics on bullying and
retaliation culled from the previous academic year.

The School shall also educate parents and guardians about bullying, its effects, the anti-
bullying policies of the School, and how such parents or guardians can provide support
in imparting upon their charges the gravity of bullying, and to reinforce the policies of the
School. The School shall provide the students and their parents or guardians with copies
of these policies, which shall likewise be included in the student and employee manual of
the School.

 Who will implement these anti-bullying policies of the School?


 The School’s Child Protection Committee (“Committee”) shall serve as the body which
will handle all bullying cases in the School. The Committee shall be composed of:
the School head or administrator as chairperson;
the School guidance counselor/teacher as vice chairperson;
a representative of the Schools teachers as designated by the School faculty;

Section 6. Sanction for Noncompliance. – In the rules and regulations to be


implemented pursuant to this Act, the Secretary of the DepED shall prescribe the
appropriate administrative sanctions on school administrators who shall fail to comply
with the requirements under this Act. In addition thereto, erring private schools shall
likewise suffer the penalty of suspension of their permits to operate.1âwphi1
 It is clear from the cited provision that every school handling elementary and
secondary education, without distinction as to qualification (whether private or
public), is mandated to adopt anti-bullying policies and ensure that such policies
are made available to students and their parents or guardians. The school, in
crafting anti-bullying policies, shall make sure that bullying shall be stopped and
not be tolerated. Moreover, it is stated in the law that non-compliance with the
provisions shall be meted with administrative sanction on school administrators,
as well as the penalty of suspension of permits to operate in case of non-
compliant private schools. Finally, any complaint for non-compliance can be
ventilated to the Office of the Secretary of the Department of Education (DepEd).

ng pang-elementarya at sekondaryang edukasyon, na walang pagkakaiba sa

kwalipikasyon (pribado man o pampubliko), ay ipinag-uutos na magpatibay ng

mga patakaran sa anti-bullying at tiyakin na ang mga naturang patakaran ay

magagamit sa mga mag-aaral at kanilang mga magulang o tagapag-alaga. Ang

paaralan, sa paggawa ng mga patakaran ng anti-bullying, ay dapat tiyakin na

ang pambu-bully ay hihinto at hindi pinahihintulutan. Bukod dito, nakasaad sa

batas na ang hindi pagsunod sa mga probisyon ay dapat matugunan ng parusa

ng administrasyon sa mga administrador ng paaralan, pati na rin ang parusa ng

pagsuspinde ng mga pahintulot upang mapatakbo kung sakaling ang mga hindi

sumusunod na pribadong paaralan. Sa wakas, ang anumang reklamo para sa

hindi pagsunod ay maaaring maaliwalas sa Opisina ng Kalihim ng Kagawaran ng

Edukasyon (DepEd).

Section 7. Implementing Rules and Regulations. – Within ninety (90) days from the
effectivity of this Act, the DepED shall promulgate the necessary rules and regulations
to implement the provisions of this Act.

 These Rules and Regulations are promulgated to implement the State policies
and objectives under the Act which aims to promote and facilitate the transfer,
dissemination, and effective use, management, and commercialization of
intellectual property, technology and knowledge resulting from research and
development
 Otherwise Known as the Anti-Bullying Act of 2013
 An Act Requiring All Elementary and Secondary Schools to Adopt Policies to
Prevent and Address the Acts of Bullying in Their Institutions. This is also known
as the Anti-Bullying Act of 2013. Administrative disciplinary actions that may be taken
against a bully, The School shall also educate parents and guardians about bullying, its
effects, the anti-bullying policies of the School, and how such parents or guardians can
provide support in imparting upon their charges the gravity of bullying, and to reinforce
the policies of the School.

Section 8. Separability Clause. – If, for any reason, any provision of this Act is
declared to be unconstitutional or invalid, the other sections or provisions hereof which
are not affected thereby shall continue to be in full force or effect.

 In law, severability (sometimes known as salvatorius, from Latin) refers to a


provision in a contract which states that if parts of the contract are held to be
illegal or otherwise unenforceable, the remainder of the contract should still
apply. Sometimes, severability clauses will state that some provisions to the
contract are so essential to the contract's purpose that if they are illegal or
unenforceable, the contract as a whole will be voided. However, in many legal
jurisdictions, a severability clause will not be applied if it changes the
fundamental nature of the contract, and that instead the contract will be void;
thus, often this is not explicitly stated in the severability clause. Severability
clauses are also commonly found in legislation, where they state that if some
provisions of the law, or certain applications of those provisions, are found to be
unconstitutional, the remaining provisions, or the remaining applications of those
provisions, will, nonetheless, continue in force as law. While this merely restates
what is generally the law of most jurisdictions, it is nevertheless wise to include
such language to make clear the parties' intent that only unimportant non-
material provisions may be severed. Many laws have clauses specifying clearly
the exact opposite, in which only all parts of the law taken together can be
enforced: This act is to be construed as a whole, and all parts of it are to be read
and construed together. If any part of this act shall be adjudged by any court of
competent jurisdiction to be invalid, the remainder of this act shall be invalidated.
Nothing herein shall be construed to affect the parties' right to appeal the matter.
(example New Hampshire statute).

Section 9. Repealing Clause. – All laws, decrees, orders, rules and regulations or
parts thereof which are inconsistent with or contrary to the provisions of this Act are
hereby repealed, amended or modified accordingly.

Section 10. Effectivity. – This Act shall take effect fifteen (15) days after its publication
in at least two (2) national newspapers of general circulation.

Republic Act 10627, or the Anti-Bullying Act (the “Act”), aims to protect children enrolled in
kindergarten, elementary, and secondary schools and learning centers (collectively, “Schools”)
from being bullied. It requires Schools to adopt policies to address the existence of bullying in
their respective institutions.
