In the PH, there are laws wherein marriage
could be dissolved for as long as the ground for
dissolving the bond is present. The Family Code
or the Executive Order no. 209 provides the
methods in which Filipino couples could dissolve
their marriage bond.
• LEGAL SEPARATION
This is merely the separation of spouses from bed
and board. While it permits the partial suspension of
marital relations, the marriage bond still exists as the
marital bonds are not severed as in the case of
annulment.
• Grounds in filing a petition for
Legal Separation:
• Repeated physical violence or grossly abusive conduct directed against the petitioner, a
common child, or a child of the petitioner.

• Physical violence or moral pressure to compel the petitioner to change religious


affiliation.

• Attempt of respondent to corrupt or induce the petitioner, a common child, or a child of


the petitioner to engage in prostitution, or connivance in such corruption or inducement.

• Final judgment sentencing the respondent to imprisonment of more than six years, even
if pardoned.

• Drug addiction or habitual alcoholism of the respondent.

• Lesbianism or homosexuality of the respondent.

• Contracting by the respondent of a subsequent bigamous marriage, whether in the PH


or abroad.
• Sexual infidelity or perversion.

• Attempt by the respondent against the life of the petitioner.

• Abandonment of petitioner by respondent without justifiable cause for more than one
year.

• ANNULMENT OF MARRIAGE
This has the effect of considering the marriage as
“void ab initio,” a Latin term to meaning the marriage
never existed at all. Although it has a different effect
in how it considers the marriage (null and void) after
the annulment, it has, however, the same effect in
terms of capacitating the parties to remarry.
• A marriage may be annulled for
any of the following causes:
• Absence of parental consent if one of the parties is eighteen years
old but below twenty one.

• Either of one party was of unsound mind.

• Consent of either party was obtained by fraud.

• Consent of either party what obtained by force, intimidation, or


undue influence.

• Physical incapacity.

• Affliction of serious and incurable sexually transmissible disease.

There is now a proposed law in the House of
Representatives during the 11th Congress filed on March 8, 1999
and authored by Rep. Manuel C. Ortega of La Union providing the
grounds of divorce in the PH.
This bills seeks to amend E.O. no. 209, otherwise known as
the Family Code of the Philippines, as amended by E.O. no. 227,
by allowing absolute divorce (a vinculo matrimonii in Latin) and
thereby granting legally separated spouses the right to remarry.

Sec. 1. Article 26 of the Executive Order No. 209 is hereby amended to
read as follows:

"Art. 26. All marriage solemnized outside the Philippines in accordance


with the laws in force in the country where they were solemnized, and
valid there as such, shall also be valid in this country, except those
prohibited under Articles 35(1), (4), (5) and (6), 36, 37 and 38.
Where a marriage between a Filipino citizen and a foreigner is validly
celebrated and a divorce is thereafter validly obtained abroad by the alien
spouse capacitating him or her to remarry, the Filipino spouses shall have
capacity to remarry under Philippine law."

Sec. 2. Article 36 of Executive Order No. 209 is hereby amended to read
as follows:

"Art. 36. A marriage contracted by any party who, at the time of the
celebration, was psychologically incapacitated to comply with the
essential marital obligations of marriage, shall likewise be void even if
such incapacity becomes manifest only after its solemnization.“

Sec. 3. Article 39 of the Executive Order No. 209 is hereby amended to


read as follows:

"Art. 39. The action or defense for the declaration of absolute nullity of
marriage shall not prescribe. However, in the case of marriages
celebrated before the effectivity of this Code and falling under Article
36, such action or defense shall have taken effect."
