Executive Summary

Madhya Pradesh Human Rights Commission deals with basic Human Rights formed in
year 1996 and the Human Rights Act enacted in India in the year 1993 which look upon the
violation of rights of an individual . It has its origin from ancient European Times from the
concept of ‘Natural Rights ‘. Natural Rights led to the formation of Human Rights .
Originally evolved in the field of domestic legislature as in Magma Carta (1215), Petition
of Rights (1628) , The Habeous Corpus Act 1618), Bill Of Rights and the Act of settlement
in England (1701) These are regarded as the landmark in the path of liberty .

The foundation of this body of law are the Charter of the United Nations adopted at San
Francisco in 1945 by the general assembly and the UDHR 1948.

UDHR includes two conventions ICCPR and ICESCR It is to be found in the Charter of UN
adopted on San Francisco on 25 June 1945

The League of Nations was established in 1919 after the negations over Treaty of Versailles
following the end of world war 1 which also fails due to happening of World War 2 after
which UN Charter has formed Human Rights day is observed every year on 10 December .

INTRODUCTION
In this summer internship programme of MPHRC from 15th May 2019 to 4th July 2019
following areas were covered –

THEORETICAL ASPECT –
 Learning and understanding about the historical prospects of Human Rights from
their origin to the evolution of the
 Protection of Protection of Human Rights Act 1993,
 International Aspect of Human Rights including the United Nations development
programme to establish Human Rights in the world.

OFFICE VISIT –
 A meeting with the Research Officer of MPHRC Mr. Sanjay Kumar Vishwakarma who
guided me with the internship programme, working of the commission and about
the human rights.
 Observation and discussion of the court’s proceedings with the honourable
Members of MPHRC.

Case 11

District – Umara

Category – Jail

Sub Category – Custodial Death

Department – Jail

Applicant – Prisoner Ravendra Singh

Sufferer – Prisoner Rajendra Singh

Complaint – The Police In-Charge of the police station imprisoned the person involved in
criminal case he has sent as judicial custodian whi died in the Hospital during the treatment .
The death was told to the parents on 22nd January 2016

Facts and proceedings –

o On 24 January 2016 , the Secretary of Jail was written a letter for his response on this
manner
o On 29 March 2016 a reminder was sent to the Secretary of the Jail
o On 28 April 2016 , a reminder was sent to call the Report regarding Custodial Death
o On 20 May 2016 , the report was received that the judicial inspection was done after
the death of the p[person , So, a letter was sent to call the result of inspection or
investigation
o On 31 May2016 , the reminder was again and again sent from the report of
investigation
o On 22nd June 2016, the respective person was called under section 13(2) of the
Protection of Human Rights Act 1993
o On 29th July 2016, after the investigation it was found that the person’s death was not
due to any against him
o During investigation process it was found that on the 22 nd January 2016 the prisoner
become sick and his health got worsen so he had been sent to the hospital

o It was found that that when he was arrested and sent to the jail on 24th December
2014. On 11th January 2015 he reported his weakness to the Jail Hospital. On 23rd
January 2015, he has got an anxiety disorder so he was referred to the hospital in
Rewa and after that he was referred to the mental hospital in Gwalior
o On 23rd October 2015 URI he was given treatment in jail’s hospital and on 22nd
January 2016 Mr. Tripathi was on eave and on 23rd January 2016 he got to know he
was having a stomach ache and was doing vomiting
o Consulting Dwedi on phone he advised to give medicine to the patient. Around 12:35
pm the prisoner was sent to the hospital where he died whereas the Doctor asked the
compounder that the patient to be brought around 1:00 pm but due to emergency he
was sent to the Hospital on 12:35 pm and the Dr was informed but he died during the
Treatment
o On 7th October 2016 the reason behind the death was delay in giving proper treatment
as he was suffering since 2 days .Reminder was sent to the Jail Secretary under sec
13(2) of Protection of Human Rights Act 1993
o On 25th April 2017 the commission s gave its recommendations ; negligence on the
part of Jail Authority in providing medical treatment
o The secretary accepted the recommendations

Recommendations-

o Rs 50,000 to be given to the family of the dead prisoner under section 18(a)(1) of
Protection of Human Rights act 1993
o Investigation to be carried against the guilty person

Complaint – Respondent had kidnapped applicant’s daughter by manipulating her complaint


has been filled in police station of Amboah still the applicant’s daughter is missing and the
accused has not been arrested

Facts and proceedings –

o 19th April 2018 the girl Rekha has been kidnapped from district Morena who is a
minor of age 16 years old at 11:00 pm
o F.I.R has been lodged on 20th April at 3:00 pm
o Through POSCO Act deliberation Jurisdiction has been taken
o Through cyber cell help many traces of their hostages has been found in places like
Saiyan, HalapurAgra,Paduapura, Mansukhpuria etc after that phone was switched off
o The shadow image had been sent to DCRB Morena Gazette Publications
o Accused Investigation is in process
o Prize for finding the accused has also been published
o 13 July 2018 still accused has not arrested and the girl has not been found
o His father is getting stressed he had visited Police station many times but no response
and information has got
o Case has been registered in MPHRC on 11 July 2018
o Reports have been asked from Office superintendent Zilla Morena
o Reports have been called on 18th August 2018, 10th September 2018, 27th October
2018
o Progress reports have been called on 9 November 2018 haven’t received yet

Complaint – Applicant has registered complaint against the department for non payment for
non-payment pf salary since February 2018

Facts and proceedings –

o Persecution is being constantly mentally and financially tortured by Deputy director,


Kisan Welfare and agricultural Development Department
o Petitioner collocation period directorate of farmer’s welfare agricultural Development
Madhya Pradesh , Bhopal
o On 2nd June 2017 collocation period was over
o Pay rise has also been stopped from 2013-2018
o Many times oral and written application has also been sent
o 15 June 2018 complaint has been done under CM helpline number
o In 2017 victim has fallen ill on 13th September 2017 . He also sent Medical Reports
and has taken credit from others for his treatment but the department haven’t paid him
o Due to knocks in the petitioner waist and in left cheeks is having a lot of difficulty in
taking eating and is advised for operation
o Medical leave since 13th March 2018
o Petitioner 10th September 2018 showing his presence in office but none has taken his
appearance
o He has given application to Sagar District but no reply has received
o Till now medical leave pay has not received by him

Respondent – Shrikant,Vinod,Jagdish,Lalit, Pavan, Indrajeet

Complaint – The Victim was grievously hurt and faced multiple injuries including elbow
and knee injury as an aftermath of a fight . The respondents are accused of threatening other
inmates and gaining financial benefits

Facts and proceedings –

o The case got registered through newspaper cutting on the date 11 April 2012 with the
headline ‘ Conspiracy of killing a prisoner in jail via prisoners ‘
o During fight accused Suresh he was teasing Jagdish Nagpure
o On 12 April 2012 at night approx. 8:00 pm
o Suresh has been beaten up by the Shrikant, Vinod, Jagdish , Lalit, Pavan , Indrijeet in
bareck no.2
o On 16 January 2012 FIR was registered and after receiving newsletter strict
proceedings has been started by Jail Superintendent
o Every accused prisoner were transferred to another jail on 2
o February 2012
o In this report it has said that the matter was narrated in a boaster manner . Authority
was in discipline and in duty too
o On 21 March 2012 case was disposed off and matter was sent to MPHRC
o On 15th October 2014 Rs 10,000 has been paid to the victim father

RECOMENDATIONS

o Through newspaper cutting case was registered


o Incident happened on 13 January 2012 in which convicted victim was in barrack no.2
o At 8:00 pm he was allegedly been beaten up by 6 prisoners
o Medical examination was also done when the F.I.R was registered
o In investigation it was revealed that Suresh has been beaten up
o Hasn’t made noise so it wasn’t noticed
o Lances of money which was demanded by Suresh i.e amount of 1500 of which he
could only pay 500 was found to be true
o He narrated this matter to his brother who come to visit him in jail then he filed the
F.I.R
o Jail was in proper discipline
o Accused were of crime nature
o His Father was rewarded 10,000 INR as compensation

Complaint – Death of a Pregnant lady in Hospital

Facts and proceedings –

o Rehnuma a pregnant lady died on 13 July 2017 at 8:20 pm


o Complaint got registered through Newspaper cutting on 14 July 2017
o Letter sanctioned 28 June 2017 for calling the reports
o Again on 30 June 2018 reports called haven’t received
o In the above case Chief Medical And Health Officer Chattarpur information which is
asked haven’t received
o According to sec 13(2) reports to be send with one month .
o On 27 December reports have been received where it is stated that the Doctor and
Nurses have treated the patient Rehnuma Ansari .
o At night 11:45 of 11 June 2017 operation was done and on 12th morning and in
evening her condition was normal checked by the Dr Nidhi Khare
o On 13th she faced critical situation but staff tried to safe her but couldn’t to do and on
13 June 2017 she died
o There was no negligence from the part of the doctors
o Reports of investigation details have been sent on 27 September through post by
Office of Chief Medical and Medical Health Officer, District, Chatarpur Madhya
Pradesh but has not been received on time by MPHRC

• SUFFERER – Women giving birth to new babies

• RESPONDENT – Superintendent, Medical

• COMPLAINT – The women have to buy medicines from outside of the hospital even
after the scheme of the government to provide them with enough medicine so that the
life of women and child be saved especially for people living under the below poverty
line.

FACTS & PROCEEDINGS –

o In response to a newspaper report “medicines to be brought from outside


despite hospital sanction” dated 08th January
 2018. The department took the Suo moto Cognizance on 27th January
2017.

o On 30th January 2017, the department sends a letter to CMHO, Jabalpur for his
response on the said case.

o The response was not received till the given date, so a reminder was sent on
7th April 2017 for the response of CMHO.
o On 19th April 2017, the Superintendent & manager of the hospital gave its
views and response to the commission which was looked by the commission
on 8th May 2017.
o After the inquiry and going through the response from the Superintendent of
the hospital, it was found that women were given free medicines and facilities
when they were hospitalised but during the time of discharge of the patient,
the medicines written by the doctor (upto 3 months) on the discharge card was
not provided by the hospital.
o There was a necessary tablet called IFA, which was to be taken by the patient
for 100 days after the delivery of the child.
o On 26th July 2017, the commission gave its
recommendations.
o They also asked for the response of the secretary of the State Health and
Family Welfare Department
o There were 3 reminders sent to the secretary for his response which is still not
received by the commission.

RECOMMENDATIONS

1.For this scheme (Janani Suraksha Yojna) to be successful and to reduce the death
rate, it is important to provide necessary medicines from hospital to the patients
belonging to below poverty line after they are discharges from the hospital as they
can’t afford such costly medicines.

(OFFICERS OF DIFFERENT DEPARTMENT)

o BARVAH OBSERVATION –

o On 8th July 2012 an observation in the district Barvah was done by the
registrar of law Mr. A.K. Saxena.

o In this visit the registrar observed that the whole town had very less drainage
system. The rain water was scattered everywhere in the town. Most of the
place was dirty and the administration was careless to the issue.

o He went to the police station but only a few policemen were working. Also,
there was only 1 policeman at the main square who was sitting on his bike and
was blowing the whistle but all other squares had no policeman.

o So, on this observation a notice was sent to concerned officers of the Barvah
on 10th July 2012 for there responses.
o The commission received the responses from various department heads and
gave its recommendations

o Concerned authority had sent no comments to follow or not follow the


recommendations. It is the violation of section 18 (e) of the Protection of
Human Rights Act 1993. So, a letter is sent to the Secretary of M.P.
Government to ask about the response from the concerned authorities.

 Reminder was sent on 15th July 2013, 6th March 2017 respectively.
o On 23rd September 2017, the recommendation no. 1, 2 and 3 were fulfilled or
were accepted.
o On 10th October 2017 the Secretary was asked to give his response on why the
recommendation 4 can’t be followed.

RECOMMENDATIONS

o Bypass should be made as soon as possible or if there is any such plan of


making the bypass then it should be approved immediately.

o During the time of making the bypass, less agriculture land to be taken and
proper compensation to be given along with a proper source of income to the
people who’s land is being taken.
o The municipal corporation has no government land, so it must be setup near
bypass so that municipal corporation can function properly.

o Rural development department to give instructions to make a proper drainage


system in the colonies along with the cleanliness of land

Lecture 1

It was a lecture related to cyberspace. A Cyberspace refers to the virtual computer world, and
more specifically, is an electronic medium used to form a global computer network to
facilitate online communication. It is a large computer network made up of many worldwide
computer networks that employ TCP/IP protocol to aid in communication and data exchange
activities. Cyberspace's core feature is an interactive and virtual environment for a broad
range of participants.

An HTTP cookie (also called web cookie, Internet cookie, browser cookie, or
simply cookie) is a small piece of data sent from a website and stored on the user's computer
by the user's web browser while the user is browsing. Cookies were designed to be a reliable
mechanism for websites to remember statefull information (such as items added in the
shopping cart in an online store) or to record the user's browsing activity (including clicking
particular buttons, logging in, or recording which pages were visited in the past). They can
also be used to remember arbitrary pieces of information that the user previously entered into
form fields such as names, addresses, passwords, and credit card numbers.

Social engineering is the term used for a broad range of malicious activities accomplished
through human interactions. It uses psychological manipulation to trick users into making
security mistakes or giving away sensitive information.
Social engineering attacks happen in one or more steps. A perpetrator first investigates the
intended victim to gather necessary background information, such as potential points of entry
and weak security protocols, needed to proceed with the attack. Then, the attacker moves to
gain the victim’s trust and provide stimuli for subsequent actions that break security
practices, such as revealing sensitive information or granting access to critical resources.

It was held by Mrs. Sharma relating Human Rights to acquire and requirement – You should
be human rights are entitlements legality protected interest. Particular to individual including
community rights ,not only community rights but also rights for all including age, nationality,
caste , creed , education are immaterial. Human Rights is a bundle of rights.

State can protect and oppress the rights and also compel the states to follow the basic rights
.HR is bundle of rights and entitlement by legally entitlement to every human only because
he is human and can protect by state . They have global standards .

In the ancient times human rights are evolved through natural law which was evolved by
John Locke theory .

During world war 1 alliances European Union polarized into two groups Germany was
defeated 1918 World war 1 was over after that League of Nations developed in 1919 included
countries of powerful people .after that World War 2 Hitler wanted to take revenge again he
lost 1938-1945.

After that Charter of UN was formed and also UDHR and also formation CCPR and
CCSEPR

I was literally carried away by the words and the interacting session that we interns had with
Mr SS Lali. He was a Traffic Officer and also served as an DSP of MPHRC . He told us
about Human Rights not the actual definition of Human Rights but what is human . How
humans should behave how humanity should strive inside us that the power of humanity is
above all and everyone should be a human first . humans are the creature of God so we
should behave like a God in oneself

He told us about how basic Custodial Custody convicts are to treated , they should also be
treated with the same dignity of life and should not violate their rights

He showered his experience that he had with in this organization and also basic values that
we as a future lawyers should have a helping hand for the needy . To help the human beings
as an human beings and not behave as an evil in this mankind world . To protect to save our
natural rights from violating . He literally opened our eyes as an honest review I was
flourished by his lecture and Mr SS Lali is an honest man and we need more such people like
him.

CONCLUSION

The Madhya Pradesh State Human Rights Commission has by and large played its role: quite
effectively and has always upheld the basic principles of human rights by promoting,
protecting and implementing human rights. Ii has investigated a number of cases involving
serious human rights violations, and submitted reports to the Government with a number of
recommendations suggesting measures to be taken to curb such human rights violations.
However, the work of the Commission is least effective, and is far from satisfactory. The
following suggestions are made in order to ensure the efficacy and efficiency of the MP State
Human Rights Commission. If these recommendations are conceded, it will strengthen
MP.H.R.C. so that everyone can live with dignity and honor in our society. With the said
avowed goal in mind the researcher would like to propose the following suggestions and
recommendations.

To remove the weaknesses and shortcomings of the MP State Human Rights Commission,
the Protection of Human Rights Act 1993 requires urgent modification and amendment. The
Government of MP may submit recommendations for effecting amendment in the Act and
prevail upon the Union Government to affect the amendment immediately in order to
strengthen the MP.H.R.C.

Learning Outcomes

i. This internship gave me an opportunity to work for a governmental organization and know
about its working and functioning. I learnt how the complaints are received, managed and
segregated by the department.

ii. During the internship, I had the opportunity of sharpening and improving my research,
reading, and analyzing skills.

iii. It gave me a chance to interact with members of commission and students from various
other colleges. The main advantage was that not only law students were welcomed for the
internships but students from political science, medical sciences, criminology etc were
welcomed.

iv. It was an enriching experience to understand the issue of Human Rights and its
significance in the contemporary world.

v. It most importantly taught me the significance of team work in our life. While working
with the members my group, I learnt how teamwork can help instilling sense of
responsibility, encouragement to work harder and efficiency due to division of work.

vi. This internship helped me instill some other professional learning outcomes as well like
behaving ethically, listening effectively, dressing appropriately, addressing colleagues and
superiors appropriately, adapting effectively to changing conditions, participating as a
member of a team and developing individual responsibility.
