JUDICIAL AFFIDAVIT OF JOECARLO DALISAY

Preliminary Statement

The Witness answered under oath in the English language and

have sworn that he understood his statements made here and stands
for their veracity and the lawyer conducting the examination is Atty.
Butch Maat at his office in HMU Bldg., Real St., Tacloban City, Leyte.

The witness is JOECARLO DALISAY, of legal age, single, and

with residence at Brgy. Poblacion, Tanauan, Leyte, witness of the
accused Paulo Collegio. His testimony is being offered to:

1. Prove the location of Paulo Collegio at the time of the

commencement of the alleged crime; and

2. All other related matters, facts and circumstances relevant

and material to this case.

The Witness is answering the questions fully conscious, in

English and is translated to Waray-waray, that he does so under oath,
and that he may face criminal liability for false testimony or perjury.

Q1. Do you swear to tell the truth and nothing but the whole truth
only in this query that I am going to conduct with you?

A3. I am Joecarlo Dalisay, of legal age, single, Filipino and residing

at Cavite East, Palo, Leyte.

Q4. Do you know the accused in this instant case, Paulo Collegio?

A4. Yes, Sir. He is my childhood playmate and teammate in

basketball.

Q5. You said, Paulo Collegio is your teammate. Do you have any
future games or did you join any Liga?
(Nayakan ka nga inin hi Paulo Collegio in imo teammate. Mayda ba
kamo mulay hin basketball or nag-bulig ba kamo hin Liga?)

A5. Yes, we have several games in the upcoming weeks. The Liga
started on August 5, 2019. Our first game was on August 8,
2019.

Q6. What happened on August 8, 2019?

A6. It was our first game against the Elite Basketball Team. At
about 3pm, Paulo picked me up at our house. We both arrived
at the Basketball Court in Tanauan at about 3:15. When we
arrived at the basketball court, the first game was not yet done.
So, we decided to warm up and at the same time watch the
game together with our teammates.

A7. Our game with Elite Basketball started on 4:45pm. Paulo is one
of the biggest team members, so he is one of the first five of the
game.

A8. Yes, Sir.

Q9. Was he playing the whole time of your game?

A9. No, Sir. He had to rest for a few minutes. But most of the time,
our coach lets him play because he is our big man.

Q10. Do you know what time your game ended?

A10. Yes, Sir. Our game ended at about 8pm on August 8, 2019.

Q11. After your game, where else did you go?

A11. We ate dinner at a Barbecue stand near the basketball court.

Q12. Who else were there?

A12. We were all there, ma’am. Because we won our first game, it
was our coach’s treat to us.

Q13. After you ate dinner, did you go somewhere else?

A13. None, Sir. We decided to go home because we were all tired

from the game and it was already late. Paulo dropped me at
our house at about 9:45 in the evening.
