III. JUDICIAL AFFIDAVIT PROPER

I, Pers Wit Ness, 50 years old, single, Filipino, and a resident of #03
Pangatlong st., Third Village, Baguio City, after having been duly sworn to
in accordance with law, hereby depose and state:

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which prescribes the

use of judicial affidavits to serve as the direct examination testimony of
the witness, on the basis of which the adverse party may conduct their
cross-examination on such a witness, I hereby execute this judicial
affidavit in a question and answer format;

That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC,
I also state that it was Atty. King Anthony M. Montereal, counsel of the
plaintiff, who conducted the examination of the undersigned affiant;

That conformably also with section 3 (c) thereof, I hereby state

under the pain of perjury that in answering the questions asked of me, as
appearing herein below, I am fully conscious that I did so under oath, and
that I may face criminal liabilities for false testimony or perjury;

AND UNDER OATH, AVERS THE FOLLOWING:

PERS WIT NESS IS A FRIEND OF PROF E. SSOR

1. Q: What is your current occupation, if any?

A: I am a legal medicine professor, sir.

2. Q: Where have you been working as a professor?

A: I am currently working at Saint Louis University, sir. In fact, I
have been working for more than 20 years in the same university.

3. Q: When exactly did you become a professor?

A: I was hired way back June 1999, sir.

4. Q: What did you first teach?

A: I taught basic law and medicine classes in the undergraduate
program sir.

5. Q: How long did you teach the subject?

A: About 5 years, sir.

6. Q: What did you teach after?

A: Few law subjects in the school of law and legal medicine in the
school of medicine, sir.

7. Q: What prompted you to teach?

A: I was encouraged by my good friends Prof E. Ssor and Do C. Tor,
sir, because they were teaching the same subjects in the university,
sir.

8. Q: How long have you become friends with Prof E. Ssor and Do
C. Tor?
A: They were my good friends since around 1980s, sir.

9. Q: How did you become friends?

A: We attended the same secondary education, sir.

10. Q: What school did you attend to?

A: We studied at SLU Boys High, sir.

PERS WIT NESS IS A WITNESS TO THE EXECUTION OF THE LOAN

AGREEMENT BETWEEN PROF E. SSOR AND DO C. TOR

11. Q: Where were you in the afternoon of January 1st, 2017?

A: Here in Baguio City, sir.

12. Q: Where specifically?

A: I was in Upper Session Rd. that afternoon, sir.

13. Q: What time exactly, if you can remember?

A: That was around 2 o’clock in the afternoon, sir.

14. Q: Who was with you?

A: I was with Prof E. Ssor, Do C. Tor, and Sikand Wit Ness.

15. Q: What were you doing?

A: We, together with Sikand, were asked to be a witness to the
execution of the loan agreement between Prof and Do, in the office
of Atty. Steve Jack Ma.

16. Q: Who executed the document?

A: Prof and Do.

17. Q: Who was the debtor or the one lending?

A: It was Prof, sir.

18. Q: Who was the creditor or the one borrowing?

A: Do, sir.

A: The notary public, asked them if they have read fully the contents
of the document, and if they are understood it fully, sir.

20. Q: What happened next, if any?

A: They signed the document together, sir.

21. Q: What did you do?

A: We were also asked to sign the document, sir.

22. Q: Where did you sign?

A: I signed in the bottom left corner of the document, sir.

23. Q: What was the title of the document you signed?

A: It was titled “Loan Agreement”.

24. Q: How many people signed the document?

A: Four sir.

25. Q: Who signed the document, if you can recall?

A: All four of us signed it sir.

26. Q: For the record, please you name the four persons who
signed the document.
A: Prof, Do, Sikand and myself, sir.
