EDITORIAL... ✍ Protect Hindu Places of Worship -

Ahobila Mutt Jeer Appeals to Judiciary
Orissa Government recently decided to demolish Mutts around Puri Jagannath Temple which
are centuries old places of worship, in the name of beautification etc. This is a condemnable, illegal and
dastardly act. All Hindus should condemn this act. Jeer of Sri Ahobila Mutt which is a historical Mutt
condemned this and appealed to Supreme Court to restore order. The operative portion of the Jeer's
letter to CJI is reproduced below.
"Ahobila Mutt Jeer right from inception of the Mutt is said to have been the Royal Guru to both
Vijayanagara Dynasty and Kalinga dynasty. The 6th Jeer of Sri Ahobila Mutt, Sri Parankusa Yateendra
Mahadesikan was honourded by Emperor Mukunda Deva Raya, the Kalinga King by lifting his palanquin.
He is said to have played a major role in protecting the Puri Jagannath Deity from the invasion of
Kalapahaar and Moghuls. Many Vaishnava Mutts in Puri Such as Rewasa Mutt, Raghavadas Mutt claim
allegience to Ahobila Mutt.
The Supreme Court has our ancient principle <ÆoÁz á™|: ÀooÁz \Æ:> in its emblem and we hope that
the Court will ensure that justice is always done as per this principle. One of the basic principles of
justice followed from ancient times in Bharat is of delivering justice only after hearing the impacted
parties which in modern parlance is called as principle of natural justice.
The Supreme Court has the responsibility to ensure that this basic principle is strictly followed
in response to the representation of the Mahants.
The Mutts in Puri are places of Worship and the Mutts associated with Puri Jagannath Temple
complex are integral part of the place of worship and has a devotional character. It is also brought to your
kind notice that along with the rights of the Mahants the rights of presiding Deities of the Mathas are also
involved in this matter. The presiding Deities have been continuously worshipped for several centuries
with devotion and their rights are also protected by the Central Places of Worship (Special Provisions)
Act of 1991.
The provisions of this Act has not been as yet considered by the Supreme Court. It is also an
historic fact that in a similar situation when TTD as part of its Master Plan had acquired the properties of
several Mathas in Tirumala upheld by the AP High Court; a separate petition was filed by Dr M.V.
Soundararajan, Shishya of Sri Ahobila Mutt invoking the provisions of the said Act to protect the rights of
the Presiding Deity - Lord Lakshmi Narasimha of Sri Ahobila Mutt.
The TTD trust board in response to this petition had signed an MOU with the then Jeer of Sri
Ahobila Mutt protecting the place of worship and agreed to several conditions with regards to preserving
ancient traditions, custom and usage of the shrine. Likewise a legal procedure considering the provisions
of Places of Worship Act 1991 needs to be worked out here to protect the Mutts as places of worship
without changing customs, usage and altering the full devotional character of the Mutt and associated
intra-Mutt worship premises of historic and devotional character. The place of stay and worship of numerous
Religious saints line Sankara, Ramanuja, Chaitanya etc., are by themselves worshipped by devotees
and they need to be protected without altering the devotional and locational character of the place..
We hope that the Supreme Court will ensure that a proper, Just and Constitutionaly mandated
legal process is followed in this case after staying the demolition as requested by the Mahants. Hon’ble
Supreme Court of India should kindly ensure that the fundamental property rights of the Mahants under
Article 26 of the Constitution and their fundamental cultural rights under Article 29(1) are protected in
toto."
Hindu place of worship once consecrated remains for ever and cannot be disturbed. If structures
are becoming old we need to protect them via advanced methods of safe guarding heritage structures.
A sikh Gurudwara built by Guru Nanak was also in the list of structures to be demolished at Puri.
Captain Amarinder Singh, CM of Punjab appealed to Orissa Government and the demolition was stalled.
We hope Supreme Court intervenes in the case of Hindu structures too.
