AFFIDAVIT
I, PEARLY S. NATIVIDAD, of legal age, married, and a resident of Rio
Village, Bangkal, Davao City, after having been duly sworn to in accordance with
law, hereby depose and say:

That I am engaged in poultry farming, which farm is situated at Wakanda

Subdivision, Catalunan Grande, Davao City (a copy of my barangay permit is
hereto appended as ANNEX “A” and forms an integral part hereof);

That at or about 11:21 o’clock in the morning of July 15, 2004, while I was
in the office of my counsel at C. M. Recto St., Davao City, I received a text
message from my brother that MARIA E. SANTOS accompanied by another two
female and two male companions on board a yellow Multi-cab with markings
SOLID WASTE, barged in by forcing open the gate of the poultry and got inside
the poultry and robbed 10 live chicken by the use of force and intimidation;

That I immediately went to Police Precinct No. 3 at Matina, Davao City

and reported the said robbery (a copy of an excerpt from the police blotter is
hereto appended as ANNEX “B” and forms an integral part hereof);

That after I reported to the police the said incident, I went immediately to
my farm and confirmed what happened;

That I am executing this affidavit to attest to truth of the facts heretofore

narrated, so that a case for robbery may be filed against MARIA E. SANTOS and
her four cohorts and for whatever purpose not contrary to law.
