Dear PAO,
My cousin was apprehended for alleged robbery. After his arrest,
he was compelled to undergo drug testing and his urine sample
yielded positive for the presence of crystal meth. The police said

dangerous drugs) of Republic Act (RA) 9165, but the only
evidence they presented was the result of the drug test. We were advised by a
friend that the drug test conducted is deemed a violation of my cousin’s right
to privacy. Please enlighten me on the matter.

Article II of RA 9165, or the “Comprehensive Dangerous Drugs Act of 2002,”

The above-stated rule was explained in the case of Dela Cruz vs People of the
Philippines (GR 200748, July 23, 2014), where the Supreme Court through
Chief Justice Maria Lourdes Sereno stated that:
“The drug test in Section 15 does not cover persons apprehended or arrested
for any unlawful act, but only for unlawful acts listed under Article II of RA
9165.
“First, ‘[a] person apprehended or arrested’ cannot literally mean any person
apprehended or arrested for any crime. The phrase must be read in context and
understood in consonance with RA 9165. Section 15 comprehends persons
arrested or apprehended for unlawful acts listed under Article II of the law.
“Hence, a drug test can be made upon persons who are apprehended or
arrested for, among others, the ‘importation, sale, trading, administration,
Applying the above-cited decision in your situation, the drug test conducted to
your cousin is not in accordance with the provisions of Section 15 of RA
9165. The term “person apprehended or arrested” under the same act refers to
person arrested or apprehended for violating Article II of RA 9165, and it
does not pertain to any offense. Thus, the above-mentioned police had no
legal basis to require your cousin to undergo drug testing because he was
arrested for robbery, which is not a punishable offense under Article II of RA
9165.
