Compliance Checklist & Application Guide
(Print this Document and check off steps as you complete your application process)

First and foremost this is a REFERENCE GUIDE to help you as you go through your
FFL process. It still is your (The Applicants) Responsibility to Comply with ALL Federal,
State and Local Laws and Ordnances in reference to running a firearms business.

We have developed this detailed compliance and application guide to help ensure your
success in properly filling out your Form F7 (5310.12), establishing necessary business
licenses, and other requirements you may need to obtain a FFL.

Note:If your application is improperly filled out your application is likely to be denied
or delayed until properly corrected. These delays can result in months before a
application is finished processed.

NOTICE: First off if you expect to obtain your standard Type 01 Dealer In Firearms you
MUST and I mean MUST intend on engaging in a business and making a profit. You
CANNOT and I repeat CANNOT get a license to solely enhance your personal firearms
collection. As you sell Yes you can buy firearms for yourself.

If you solely want to enhance your collection fill out the curios and relics C&R license.
Its for collectors and you can only buy antique firearms. Usually firearms older than 50
years old qualify but you can find out on the approved C&R list. C&R Licenses are
discussed in the C&R section of our site.

You will be expected to meet with an ATF Inspector sometime during the
application process. These inspections are routine and they are ensuring you will be
in compliance with local, state and federal laws as well as your address on the
application is a actual home or business. You are required to keep detailed
transaction records called Acquisition & Dispositions or A&D Records. The ATF
does NOT provide these books we however sell them at www.gunlocators.com and
you can print and bind your own using the downloadable copy on this site. Note
your records and premises are subject to inspection by the ATF during business
hours. You should keep ALL personal firearms separate from your business inventory.

If you plan on selling a lot of firearms we recommend looking into forming a LLC
to help protect your personal property from litigation. LLC or Corporations
information can be found online and via local legal offices.
You also are REQUIRED to furnish information to the ATF in regards to
Firearms Traces. We highly recommend assisting any law enforcement agency when
they are needing your assistance in a firearms information related to investigations
These are just a few of the requirements and recommendations to help you get
your FFL.

Ok with ALL That said Don’t be discouraged as this may seem a bit intimidating.
However it is not that difficult in most cases to get your FFL. The simple fact is the ATF
is generally very helpful and just expects you to follow guidelines in accordance with
local, state and federal laws. Inspectors have a job to do and its for everyone safety and
security.

Another thing to remember is that everyone you sell a gun to will have to have a
background check ran. NICS is the point of contact for running background checks.
The NICS center is part of the FBI. They are discussed in detail in the NICS section
of this site. Some states may have a NICS point of contact and once issued your FFL
contact NICS operations center to confirm you using the proper channels.

Next item of business is to see if you even qualify for a FFL. We do not and cannot
guarantee you will be approved for a FFL. However most of our customers have
qualified for a FFL. Besides what is listed above there is a few other items you need
to check.

If you have a criminal history or you are prohibited from buying firearms you
need NOT apply. This should go without saying, however this question has been asked
more than one time.

Ok, If you have made it this far there is a few more items to discuss before we
detail filling out the application.

The cost of a Type 01 Dealer in Firearms License is $200 for the first 3 years at
the time of this guide and $90 for each 3 year renewal. This license only covers the
sale of pistols, rifle and shotguns. And it only covers single shot and semi-auto
weapons. If you want to sell full auto or suppressors you need a Type 03 license and
they run $3000. We do not cover these license and they are MUCH harder to obtain
and almost impossible to sell them without a storefront. Also the profit potential is much
less with a full auto and suppressor sales. Although some aspects of this guide will be the
same for class 3 dealer licensing your going to have even more restrictions and
requirements.

You also may wonder if you need a FFL to repair firearms. Yes you MUST have a
FFL to work on any firearm other than your own by federal law or you must work under
a licensed FFL holder.

What about selling gun parts? You do not need a license to sell most gun parts.
The only parts that require a license to are frames and receivers as they are
the stamped serial numbered parts the ATF requires registration for.
At this point you should have used the ATF order link to order all the forms and
applications listed on the main members page. Expect 2 – 3 weeks for the ATF to
deliver the applications by mail. We no longer provide Form F7 copies as they
change time to time and we want you to have the most current application. Outdated
applications being submitted will result in DENIAL or Delay of your Licensing.
If you have purchased a kit elsewhere and have an application be sure its the updated
application.

Once you submit your application expect a 4-8 week for a approval or denial. If you are
denied you will get your $200 fee back. At that point you should consider a C&R FFL or
if your required a business location a business office or business location that meets
requirements. FFLKit.com has no control over time frame of application process or
knowledge what state your application will be in during review. If you think its been too
long without an answer call your local ATF Inspector or the ATF Atlanta Industry
Operations Center to inquire.

Ok if we are ok with the zoning/code office, you have no criminal records that would
prohibit you from obtaining a FFL. Lets Get started

STEP 1. Lets Get Your FFL Forms Ordered These come straight from the ATF we do not
charge for them in the kit price. Forms are free and to ensure you get the most updated
form and prevent sending a outdate form and getting denied order the recommended form
listed on the main members page. We have a convenient web link to the ATF Distribution
Center to order the forms.

Form 7 is the form on the order link that more people have a hard time finding and it is on the
order page. These Are the forms you will need to order

The F7 is a little hard to find on form if you do not know how the ATF List it. It will be Listed As

If for some reason you get a security or invalid web request error when you click the link it
could be for multiple reasons. 1 your security setting on your web browser may be too high or the
ATF may be having technical difficulties with their website. In those cases you may need to call
the distribution center and order the forms via the telephone. Call 1-301-583-4696 Thats the
direct line to the ATF Distribution Center and place your order that way. NO We do not send
Forms and people selling kits that do may be putting you license process in jeopardy by getting
you denied or delayed if you send in a obsolete or outdated form. Thats why we have you order
the forms direct and provide an link to a easy to use electronic method for ordering the forms. Its
fast and easy.
Once you receive your application and forms please continue to follow this FFLGuide and the
instruction provided on the application. The two will ensure your filling out information correct
as well as confirming local and state compliance.

STEP 2. You need to ensure you check with your local and state authorities to see if
you need any additional licenses. This includes state revenue or sale tax permit, DBA's if
required. To check contact your state comptrollers / tax office, city or county court house
for business registration if required. I also recommend checking with your local zoning or
code enforcement division to see if you can operate out of your home if your planning
operating from your home. There are a few cities that simply do not allow home based
businesses. If you plan to operate out of a retail location just see if your within code or
zoning regulations. This is your responsibility not the ATF’s however if they find your
out of compliance you will not be approved or your license may be
revoked. Also some states require state firearms resale license. Check with your
state to inquire if your in need of any special permits. A resale certificate is required
in nearly all states so you must have one if required by your state.

I also recommend you view the list if ATF offices that’s provided with this kit.
Find your local or regional office and call them. Ask to speak to an ATF Inspector
NOT an Agent. Inspectors are your point of contact for licensing issues. Agents deal with
criminal activities. The agents are very busy generally with investigations so if you get
one that answers the phone ask for an inspector unless they say they will help you. I urge
you DO NOT waste their time with licensing issues as generally thats NOT their
department. Once speaking to an inspector Ask them if they know of any reason you may
not be approved. They are usually familiar with all the local and state regulations that
their region covers and if not they can find out. If all else fails contact us at

STEP 3. If your going to hire employees or you want to as a sole proprietor Apply for a
Federal Tax ID Number EIN

STEP 4. OK NOW lets get started on filling out the application. Print this and check off
or fill in as you complete the application process.

STEP 5. Now with this base information lets fill out the application. You must NOT
leave
any spaces blank. If something does not apply I recommend you write in not
applicable or N/A. This ensures the ATF does not think you may of missed
something and delay your application until its corrected or clarified by the ATF.

Item 1: Name of Owner or Corporation must be listed.
Item 2: Trade name or Business Name (If None use N/A)
Item 3: EIN or SSN
Item 4: Name of County business premises is located in.
Item 5: Business Address (NO PO Boxes)
Item 6: Mailing Address if different (May Use PO Box)
Item 7: List ALL Contact Numbers
Item 8: Type of business
Item 9: Describe Activity you plan on engaging in i.e.: Sales of Firearms or
Gun smithing
Item 10: Are you a Pawn Broker?
Item 11: Check Type 01/02 Fee is $200.00
Item 12: Select Payment Method. I recommend Check. You can confirm when it’s
cashed
Item 13: Fill out your hours of operation. (Cannot Do By Appointment Only)
Item 14 or 14a: Is for if you are currently engaged in a Firearms Business requiring
a FFL
Item 15: Were you in the Military
Item 16: Do you own, lease or are you on a military installation?
Item 17: How is your premises zoned?
Item 18: You MUST INTEND ON OPERATING A BUSINESS…………………

If you are obtaining business from a current FFL Holder, be sure to complete Item
20 &
21 if not place N/A in those blanks.
Item 22: Each business owner or partners MUST fill out completely…….

Item 24, 25 & 26: You Must Write “Yes” or “No” in the Blocks. If YES, explain in
detail.

Be sure fill in Chief Law Enforcement Officer, May be Sheriff or Chief of


Police. Call them and ask. (THEY DO NOT SIGN THIS APPLICATION)
Item 28: Sign and Date and Attach Current 2x2 Passport Style Photo.
DO NOT PROCEED FURTHER:
ITEM 29 is for ATF USE ONLY.

STEP 6. Note: Enclose Copy 1 and Copy 2 with Fingerprint cards, secure gun storage
certification, certification of compliance to the ATF. Send to address on application
and I recommend sending it USPS with signature and delivery confirmation.
STEP 7. Deliver Copy 3 to your Chief Law Enforcement Officer or send certified mail
w/ signature & delivery confirmation. Although you do not have to be approved by your
chief law enforcement officer to obtain a FFL the law REQUIRES you send a copy of
your application to them. This notifies them your intent to sell firearms. Last thing you
need as a FFL Holder is the local authorities not knowing your legally selling and you get
in a wreck, possibly lose your license and be arrested in firearms charges due to a
misunderstanding.

STEP 8. FINGERPRINT CARDS must be submitted with the application. This section is to
detail whats need in each block of each fingerprint card. Check below to ensure fingerprint card is
complete. This will avoid possible delays if not completed. You must go to your local PD sheriffs
office or state police and have them fingerprint you. They usually charge a small fee for
fingerprinting.

Ok this may seem like a ton of information and seem overwhelming however its a quite easy
process if done correctly the first time.

At this point you may be asking your self WHAT use is this kit membership. I had to order my

Here are a few items we want all customers to know. Why do we publish our kit online? This
allows us to constantly update ever changing information from the ATF. Mailed copies of kits do
not work well for several reasons. Biggest reason is that information changes a lot. Also forms
and application change often and without notice. If you were sent a application from us and the
ATF has a new one for example, you could be delayed or even denied for sending in the outdated
forms. We provide a list of needed forms on the main members page with a link to order these
forms. You may need to submit multiple orders as the ATF system has a limit on each order
submission example only 10 types of forms can be ordered at once. These forms then will be
Direct fulfill mailed to you by the ATF.

What we do is not only provide a guide, we also provide software, one stop research resources for
your state, A&D paperwork not provided by the ATF as well as support via our support system at
