The people expect the evidence to Show
Victim 1 and Victim 2 were married and living in Apartment 2D
in the apartment complex. Victim 3 is the mother of Victim 2
and Victim 4 was in a dating relationship with Victim 3. Victim
5 lived in Apartment 3C of the apartment complex.
On above DTL, V3 and V4 visited V1 and V2 for dinner at their
apartment. They were waiting for another family member to
arrive who had been held up at work. V1, V2, V3 and V4 all sat
around a set dinner table, with food on the table, untouched.
There was a fifth table setting for the family member they were
waiting for. At that point, this Defendant entered through the
front door of apt 2D armed with a 40 caliber firearm. The
Defendant approached the 4 victims in the kitchen and fired
numerous shots striking all 4 victims. All 4 bodies dropped to
the floor around the table.

The Defendant then exited Apt 2D out the front of the

apartment still armed with the firearm. As the Defendant left
2D, he walked towards Apt 3C, Victim 5's apartment. W1, a
neighbor who lives near apartment 3C and could see the
walkway to apartment 3C, heard the initial shots ring out. W1
observed this Defendant shaking while approaching Victim 5’s
apartment. Victim 5 and W2 were present in apartment 3C. W1
locked eyes with the Defendant and then he locked his door
and rushed his wife and child to the rear of their apartment for
safety. W2 heard a commotion from the apartments below him
and walked out their back door to investigate. Victim 5
remained on her couch. Shortly after W2 exited the rear of 3C,
the Defendant entered through the unlocked front door of 3C
still armed with a firearm. The Defendant then pointed the 40
caliber firearm at Victim 5. W2 reentered the rear of his
apartment and saw the Defendant pointing a firearm in the
area of the living room where Victim 5 was sitting. W2 heard
Victim 5, call out a couple times to W2, “The neighbor.” W2
then fled out the rear of the apartment to escape.
W1 and his family saw W2 flee out the rear of the 3rd floor
apartment. W1 was with his wife and infant; W1’s family could
not safely and quickly exit via the back stairwell due to
construction so instead W1 went back through his apartment,
exited the front door and escaped with his family down the
front stairwell. Simultaneously, W2, despite the construction,
scaled the back stairwell and exited to the ground floor. While
fleeing, W1 heard 2-3 additional shots ring out. W1 and his
family ran to a gas station at Oak Park and Irving Park and
waited for safety. As W2 ran towards the front of the building
he encountered Officers and exclaimed that his mother was
just shot.

W3, who lives with her husband W4, an off duty police officer,
in the apartment complex, heard what she believed to be
gunshots. W3 then went to her window and saw the Defendant
coming out of apartment 2D and put his hand in his pocket as if
he had a gun. W3 then called out to her husband, W4. W4 then
observed the Defendant enter the front door of Victim 5's
apartment 3C while holding a firearm.
Meanwhile, in apartment 3C, the Defendant shot Victim 5 once
in the abdomen. Victim 5 was somehow able to run out her
back door and down one flight of stairs to the 2nd floor. A trail
of Victim 5’s blood led from her living room and out the back
door of her apartment. The Defendant stalked after Victim 5
through the rear of her apartment, down the stairs, and shot
Victim 5 once in the back of the head on the 2nd floor of the
rear of the building.

After the initial gunshots, W3 observed W2 on the 3rd floor

balcony looking around and asking "where are you, are you
ok?". W3 and W4 then observed W2 run away from his unit
and down the back stairwell. W3 and W4 then observed Victim
5 walking on the balcony away from her apartment (3C)
towards the stairwell. Victim 5 was holding her abdomen and
was walking down from the 3rd floor to the 2nd floor. W4 then
observed the Defendant follow behind V5, pointing a gun at
her. As Victim 5 got to the bottom of the stairs with the
Defendant behind her, and knowing what was about to happen,
W4 looked away, but then heard the gunshot. W3 saw Victim 5
walking down the stairwell from 3rd floor to 2nd floor when
W3 heard a gunshot and observed Victim 5 roll down the
stairs, land on the second floor at the bottom of the stairs. At
that point, W3 called 911 to report the incident. By the time
W3 returned to look in the direction of the incident, the
Defendant had walked down to the first floor and was walking
around with a gun still in his hand.

The Defendant then returned to his 2nd floor apartment and

put the gun on the coffee table in his living room. The
Defendant then exited the front stairwell of the building to the
ground floor and walked towards Oak Park Ave. as police
arrived. The Defendant exclaimed to responding officers "I
think you're looking for me, I did it." The Defendant also
exclaimed that the door to his apartment was open and that the
gun was inside. The Defendant was arrested on scene.

Officers immediately went to the Defendant’s apartment where

his front door was open and they observed a firearm in plain
view on the Defendant’s coffee table in his front room adjacent
to the front door.

Officers recovered a 40 caliber handgun and ammo from the

living room of the Defendant’s apartment. Officers also
recovered a note taped to the inside of the Defendant’s door, in
Polish, that translates to:
“No Mercy!!!
Remember
Whatever shit they do to you
You control it yourself not them!!
Enough!!
They have to pay for it!!”

Officers also recovered another note from the Defendant’s

apartment the next day, that stated in Polish:
"Tomorrow!! No Mercy
Without any stupid hesitation!!!
Remember who you are!!
Remember what this piece of shit is doing to you!!
Enough!!"

The Defendant lived alone and is not paying his association fees
or his mortgage. The association was seeking to evict him.
Additionally multiple cryptic letters drafted by the Defendant
were recovered in his apartment specifically addressing issues
with his neighbors.
