DEED OF CONDITIONAL SALE OF LAND

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF CONDITIONAL SALE is made and entered into by and between:

RONIE C. LUCERO, of legal age, Filipino, married to Perlyn A. Lucero and a


resident of Brgy. Lunga-og, Sto. Tomas, Davao del Norte, Philippines and
herein referred to as the VENDOR;

- and -

LYN M. CURE, of legal age, Filipino, married and a resident of the same
address above-stated, hereinafter referred to as the VENDEE;

W I T N E S S E T H:

WHEREAS, the VENDOR is the registered owner of a certain parcel of land


specifically identified as Lot No. 7, PSD-11-045704 (AR), covered by Transfer
Certificate of Title (TCT) No. C-9007, with a total area of Twenty Four Thousand
Six Hundred Sixty Four (24,664) square meters, more or less, located at Brgy. Lunga-
og, Sto. Tomas, Davao del Norte, Philippines.

WHEREAS, the VENDEE has offered to buy and the VENDOR has agreed to
sell the portion of the above-described subject property consisting an area of Ten
Thousand (10,000) square meters, more or less, for the consideration and the terms
and conditions set forth herein below;

NOW THEREFORE, for in consideration of the foregoing premises the VENDOR


hereby SELLS, TRANSFERS, CONVEYS the aforesaid land in consideration of the
following terms and conditions, to wit:

1. The total consideration of the sale shall be in the amount of Eight Hundred
Thousand Pesos only (Php. 800,000.00) Philippine currency, to be paid
by the VENDEE to the VENDOR of which shall be paid in full within the
month of May 2020;

2. Upon execution of this document, the VENDEE shall deliver to the VENDOR
the amount of Two Hundred Thousand Pesos Only (Php.200,000.00) as
partial payment;

3. All realty taxes and assessments to be imposed on the subject portion of the
abovementioned property done before the LESSEE has fully paid her
obligation unto the LESSOR shall be for the exclusive account of the
LESSOR;

4. It is hereby agreed by the parties that the purchased price shall not be
increased by the VENDOR for the entire period;

5. Upon the full payment of the balance of the purchased price, the VENDOR
shall immediately execute an Deed of Absolute Sale and/or any other
instrument of transfer of ownership of the aforementioned property in
favor of the Vendee, his heirs, assigns and/or beneficiaries;

6. In case of death of the herein parties, their heirs, assigns and successors-in-
interest shall be bound by the terms and conditions of this sale;

This DEED OF CONDITIONAL SALE OF LAND is executed by the aforesaid


parties voluntarily under their own volition, act and deed and without the use of
force, intimidation, threat, undue influence neither from any individuals and/or third
persons nor to defraud creditors.

IN WITNESS WHEREOF, the parties have hereunto set their hands this
October 15, 2019 at Sto. Tomas, Davao del Norte, Philippines.

ACKNOWLEDGMENT

BEFORE ME, a Notary Public for and in the Province of Davao del Norte, this
October 15, 2019 at Sto. Tomas, Davao del Norte, Philippines, personally appeared
the aforementioned persons and exhibited to me their respective competent evidences
of identity numbers shown below their respective names and signatures and
represented to me to be the same persons who executed the foregoing Deed of
Conditional Sale of Land and that they acknowledged to me that the same is their free
act and voluntary deed.

This instrument consisting of two (2) useful pages including this page wherein
this acknowledgment is written has been signed by the parties together with their
instrumental witnesses on the left margin of each and every page thereof.
