Energy (the Nuclear Law), FANR was established as

Under Article (23) of the Nuclear Law, a licence

The new Law gives Licensees 12 months from ‫وَّٕح اٌمبٔىْ إٌىوٌ اٌدذَذ اٌّشخض ٌهُ فزشح‬
September 2009 to adjust their status and be ‫ شهش ٌزؼذًَ أوضبػهُ واٌحظىي ػًٍ رشخُض‬12

4. When do I need a Licence from .4
FANR?
Any business or Government organization ‫َدت ػًٍ أٌ ششوخ أو خهخ حىىُِخ رّبسط‬
which is or intends to become involved in ‫(أو رشغت فٍ) حُبصح أو اعزؼّبي أو رظُٕغ أو‬
possession, use, manufacture, handling, ‫ رظذَش أو ٔمً أو‬/‫ِٕبوٌخ أو رخضَٓ أو اعزُشاد‬
storage, import/export, transport and disposal ‫اٌزظشف فٍ اٌّىاد اٌّشؼخ أو ِىٌذاد األشؼخ‬
of radioactive materials, X ray generators or ،َٓ‫اٌغُُٕخ أو ِظبدس أخشي ِٓ اإلشؼبع اٌّؤ‬
other source of ionizing radiation, must apply ،‫اٌزمذَ ثطٍت ٌٍحظىي ػًٍ رشخُض ِٓ اٌهُئخ‬

5. What sources of ionizing radiation .5

FANR licenses all radioactive sources including ‫رُشخض اٌهُئخ وبفخ اٌّظبدس اٌّشؼخ ثّب فٍ رٌه‬
radiography, well logging and nuclear medicine ‫اٌزظىَش اإلشؼبػٍ و لُبعبد عجش اِثبس‬
practices. It also licenses generators of ionizing ‫ وّب رشخض أَضبً ِىٌذاد‬.ٌ‫ِّبسعبد اٌطت إٌىو‬
radiation such as all X ray machines, including ‫اإلشؼبع اٌّؤَٓ ِثً خُّغ أخهضح األشؼخ‬
medical and dental X rays and security ‫اٌغُُٕخ واٌزٍ رشًّ األشؼخ اٌغُُٕخ اٌخبطخ‬
scanners. .‫ثبألعٕبْ واٌّبعحبد اٌضىئُخ األُِٕخ‬

6. Are there any exemptions from .6


licensing?
As a general rule, all practices which use ‫ َزؼُٓ ػًٍ خُّغ اٌّّبسعبد‬،‫ومبػذح ػبِخ‬
radioactive material or sources must hold a ‫اٌزٍ رغزخذَ اٌّىاد أو اٌّظبدس اٌّشؼخ حُبصح‬
valid licence from FANR. Under Article (26) of ‫ وفمبً ٌٍّبدح‬.‫رشخُض عبسٌ اٌّفؼىي ِٓ اٌهُئخ‬
the Nuclear Law, the Board of FANR may, ٍ‫ َدىص ٌٍّدٍظ ف‬،ٌ‫( ِٓ اٌمبٔىْ إٌىو‬26) ُ‫سل‬
within the limits of international commitments ‫حذود االٌزضاِبد واالرفبلُبد اٌذوٌُخ اعزثٕبء ثؼض‬
and agreements, exempt certain facilities and ‫ ششَطخ‬،‫اٌّشافك واألٔشطخ ِٓ ششوط اٌزشخُض‬
activities from the requirement for licensing, ً‫أال رّثً رٍه اٌّشافك أو األٔشطخ رهذَذاً خىهشَب‬
provided that such facilities and activities do ‫ وَزُ حبٌُبً إػذاد ِغىدح الئحخ حىي‬.ْ‫ٌألِب‬

8. What if I want to export/import .8
Radiation Source?
‫َدت ػًٍ اٌّشخض ٌه اٌزٌ َشغت فٍ اٌحظىي‬
A licensee wishing to acquire or return a source ‫ػًٍ ِظذس ِٓ دوٌخ اإلِبساد اٌؼشثُخ اٌّزحذح أو‬
to/from the UAE must first obtain an import or ‫ أْ َحظً أوالً ػًٍ رشخُض‬،‫إػبدره إٌُهب‬
export license from FANR. A licence to ‫ َّىٓ ٌزشخُض‬.‫رظذَش ِٓ اٌهُئخ‬/‫اعزُشاد‬
import/export may be one of the activities ‫ اٌزظذَش أْ َؼذ واحذاً ِٓ األٔشطخ‬/‫االعزُشاد‬

Each individual import or export that is within ‫اٌحظىي ػًٍ رظشَح خبص ِٓ اٌهُئخ ٌىً ػٍُّخ‬
the coverage of a FANR licence requires an .‫رظذَش فشدَخ رمغ ضّٓ ٔطبق رغطُزهب‬/‫اعزُشاد‬
individual permission from FANR.

9. Do I have to pay for a License? .9

At present, FANR has not established licence َ‫ ال رطجك اٌهُئخ أٌ سعى‬،ٌٍ‫فٍ اٌىلذ اٌحب‬

10. How long will it take to process my .10


application?

It normally takes up to a month to process a ‫ وَّىٓ ٌزٍه اٌّذح أْ رخزٍف ثٕبء‬،‫إًٌ شهش‬
new licence application, through this can vary َ‫ َدت ػٍُه اٌزمذ‬.‫ػًٍ دسخخ رؼمُذ اٌطٍت‬
depending on the complexity of the ‫ثطٍت ٌٍحظىي ػًٍ رشخُض فٍ ألشة ولذ‬
application. You should apply for a licence as ٌ‫ لجً شهشاْ ػًٍ األلً ِٓ اٌّىػذ اٌز‬،ٓ‫ِّى‬
soon as possible, but no later than two months .َٓ‫رشغت فُه ثبٌحظىي ػًٍ ِظذس اإلشؼبع اٌّؤ‬
before the date that you intend to acquire the
source of ionizing.

11. What happens if my licence .11


application is refused?

If you are refused a licence you may seek a ِٓ ٍُ‫فٍ حبي سُفض ِٕحه رشخُض َّىٕه اٌزظ‬
review of the decision by submitting a ‫ ثزمذَُ وزبة خطٍ ِغجت إًٌ ِدٍظ‬،‫اٌمشاس‬
reasoned request to the Board of FANR. .‫إداسح اٌهُئخ‬

12. Who would make the licence .12


application on behalf of my
company?
The licence application should be authorised by
‫َؼزجش اٌشخض اٌّغؤوي فٍ اإلداسح اٌؼٍُب ٌذي‬
the responsible member of the senior
management of the entity seeking a licence e.g. ‫اٌدهخ اٌزٍ رشغت فٍ اٌحظىي ػًٍ رشخُض هى‬
the general manager, the managing director, ًُ‫ ػًٍ عج‬،‫اٌّخىي ثزمذَُ طٍت اٌزشخُض‬
the hospital administrator, the chief executive ‫اٌّثبي اٌّذَش اٌؼبَ أو اٌؼضى إٌّزذة أو ِذَش‬
officer or an equivalent. .‫اٌّغزشفً أو اٌشئُظ اٌزٕفُزٌ أو ِٓ َؼبدٌه‬

13. What information must I include in .13


my application form?
You will be asked to provide detailed ‫عُُطٍت ِٕه رمذَُ ِؼٍىِبد ِفظٍخ حىي طجُؼخ‬
information about your business or practice, ‫اٌؼًّ أو اٌّّبسعخ اٌزٍ رمىَ ثهب وِظبدس‬

using or intend to acquire. Prior to being ‫َدت ػٍُه أْ رجشهٓ ٌٍهُئخ ػًٍ وخىد ثشٔبِح‬
granted a licence you will have to demonstrate ‫ِٕبعت ٌٍىلبَخ ِٓ اإلشؼبع لجً ِٕحه‬
to FANR that there is an appropriate radiation .‫اٌزشخُض‬
protection program in place.

14. What is a radiation protection .14

In addition to meeting general legal obligations, ‫ثبإلضبفخ إًٌ رٍجُخ اٌّشخض ٌه ٌالٌزضاِبد‬
licensees must also draw up a radiation ‫ فُدت ػٍُه أَضبً وضغ ثشٔبِح‬،‫اٌمبٔىُٔخ اٌؼبِخ‬
protection program, specific to the practices. ًّ‫ رش‬.‫ولبَخ ِٓ اإلشؼبع خبص ٌٍّّبسعبد‬

ensure that licensees are in compliance with .‫اٌّشخض ٌهُ إلخشاءاد األِبْ وششوط اٌزشخُض‬
safety procedures both regulatory and licensing
conditions.
16. What if I fail to comply with .16

FANR has a number of options for dealing with ‫َّىٓ ٌٍهُئخ أْ رزؼبًِ ِغ ػذَ اعزُفبء ششوط‬
