It is humbly submitted that I was appointed as WMO (BS-17), BHU, Malian Kalan
on adhoc basis and my services were terminated due to arrival of regular incumbent of the
postselected through PPSC.
Now I have come to know through a reliable source that a post of MO (BS-17), BHU
Damowana Tehsil & District Sheikhupura is lying vacant due to absence from duty of Dr. Mahma
Javed since 27.10.2017.
It is, therefore, humbly prayed that I may kindly be appointed as WMO (BS-17),
BHU, Damowana on adhoc basis. I have also applied online.

I am directed to refer to the subject noted above and to state that Agriculture
Department forwarded proposal for amendments in the Service Rules 2007 and Provincial
Miscellaneous posts Service Rules, 2006 to Regulations Wing, S&GAD. Regulations Wing initiated
summary for the said amendment through Secretary Law. Secretary Law has observed as under:-
a) The Service Rules Committee, vide draft Service Rules, 2007 had proposed the
qualifications of Ph.D and M.Sc for the post of DGA(Ext.): the lower as well as
the higher qualifications had thus been grouped sans any distinct consequences.
The lower qualification does not bar a person having higher qualification to
compete. That is why the qualification of Ph.D has been omitted and the
qualification of M.Sc has been retained: an applicant with Ph.D qualification or
any other higher qualification will also be eligible to apply.
b) The Service Rules Committee vide draft notification (Provincial Miscellaneous
Service Rules, 2006) had proposed substitution of two columns for the post of
Agriculture Inspector (BS-9). However, the said post with all the entries, had
been omitted vide S&GAD’s Notification No.SOR-III(S&GAD)1-11/2003(P)
dated 6th May, 2001 (copy enclosed). The recommendations of SRC to substitute
entries only in two columns cannot, therefore, be incorporated in the vetted draft.
If the Service Rules Committee intends to re-inject the said post, it may kindly
propose appropriate entries in all the ten columns.
3. I am further directed to request to furnish reply of above observations and also visit
o/o Deputy Secretary (A-II), Agriculture Department for discussion on 07.03.2018 positively.

(Ext.), Daska (copy enclosed). Study leave (2nd year) was granted to him w.e.f. 28.09.2011 to
27.09.2012 on full pay vide order dated 21.01.2012 issued by ex-District Officer Agriculture
(Ext.), Sialkot (copy enclosed). After that he applied for 3rd year Study Leave w.e.f.
28.09.2012 to 27.09.2013 which was rejected by ex-District Officer Agriculture (Ext.),
Sialkot. Being aggrieved he filed Writ Petition before Lahore High Court, Lahore. The
Hon’ble Court directed Agriculture Department to hear him. In compliance of Hon’ble Court,
Personal Hearing was granted to him and Secretary Agriculture passed order dated
16.03.2013 as under (copy enclosed):-
a. M/S Bilal Rauf and M. Ashfaq Field Assistants may be
allowed to continue studies. Leave is hereby granted to
the as per title from 28.09.2012 to 27.09.2013 on
compassionate grounds in view of the fact that they
have spend 3 year (5th semester) and only one year’s
study is left.
b. M/s Mohsin and Aftab Ahmad are directed to report to the
department and process their case as per law/rules in view
of he fact that they have been recently admitted and it is
their 1st semester. Their absence period shall be treated as
leave per title.
c. Department proceedings under PEEDA Act, 2006 may
be initiated against Mr. Muhammad Yousaf, former
DOA(Ext.), Sialkot and Dr. Muhammad Asif Zia,
DDOA(Ext.), Daska for issuing NOC and granting
study leave to the petitioners without any lawful
authority. DGA(Ext.) shall prepare charge sheet against
all accused including allegations on record and forward

03 vide order dated 18.08.2015 and after fixation of pay during 2015 in the light of Finance

Rawalpindi. The District Accounts Officer, Rawalpindi has raised an objection that the claim is time
barred.

Sir,
Dr. Muhammad Anjum Ali, Director General Agriculture (Ext. & AR), Punjab
Lahore has been selected as Member (Crop Sciences), Pakistan Agricultural Research
Council (PARC), under Ministry of National Food Security & Research, Islamabad for a
period of three years after getting NOC from Services & General Administration Department.
2. Dr. Muhammad Anjum Ali, Director General Agriculture (Ext. & AR), Punjab
Lahore has requested for relieving from the position of Director General Agriculture (Ext. &
AR), Punjab Lahore to join as Member (Crop Sciences), Pakistan Agricultural Research
Council (PARC), under Ministry of National Food Security & Research, Islamabad for a
period of three years. No officer of Extension Wing of Agriculture Department in BS-20 was
available. Mr. Muhammad Zafaryab Haider (BS-19) at seniority No.1 Director Agriculture
(Horticulture) Ext. (BS-19), Lahore was senior most officer in the seniority list of BS-19
officers of Extension & Adaptive Research Wing of Agriculture Department.
3. Accordingly Summary for Chief Minister was submitted with following
proposals:-
I. Dr. Muhammad Anjum Ali, Director General Agriculture (Ext. & AR),
Punjab Lahore may be relieved w.e.f. 30.03.2017 from the post of
Director General Agriculture (Ext. & AR), Punjab Lahore to join his
new assignment as Member (Crop Sciences), Pakistan Agricultural
Research Council (PARC), under Ministry of National Food Security
& Research, Islamabad for period of three years.
II. Mr. Muhammad Zafaryab Haider, Director Agriculture (Horticulture)
Ext. (BS-19), Lahore may be transferred and posted as Director
General Agriculture (Ext. & AR) (BS-20), Punjab Lahore in his own
pay and scale.
Chief Minister was pleased to approve above proposals of Administrative
Department vide para 53 of the summary (copy enclosed).
4. Services & General Administrative Department vide Notification No.SOEI-1-
46/2015, dated June 04, 2018 approved relieving of Dr. Muhammad Anjum Ali from the post
of Director General Agriculture (Ext. & AR), Punjab Lahore w.e.f. 30.03.2017. However,
S&GAD had posted Mr. Muhammad Zafaryab Haider, Director Agriculture (Horticulture)
Ext. (BS-19), Lahore as Director General Agriculture (Ext. & AR), Punjab Lahore on OPS
Basis with immediate effect.
5. From above, it is transpired that Agriculture Department initiated Summary
for Chief Minister on 03.04.2017 with proposals of relieving of Dr. Muhammad Anjum Ali
from the post of Director General Agriculture (Ext. & AR), Punjab Lahore w.e.f. 30.03.2017
and posting of Mr. Muhammad Zafaryab Haider, Director Agriculture (Horticulture) Ext.
(BS-19), Lahore as Director General Agriculture (Ext. & AR), Punjab Lahore with
assumption of posting of Mr. Muhammad Zafaryab Haider as Director General Agriculture
(Ext. & AR), Punjab Lahore on own pay and scale w.e.f. 04.04.2017. Further Agriculture
Department assigned look after charge of the post of Director General Agriculture (Ext. &
AR), Punjab Lahore to Mr. Muhammad Zafaryab Haider, Director Agriculture (Horticulture)
Ext. (BS-19), Lahore w.e.f. 04.04.2017 to run affairs of Extension Wing of Agriculture
Department smoothly.
6. Now Mr. Zafaryab Haider, Director General Agriculture (Ext. & AR), Punjab
Lahore has requested that the Services and General Administration Department may be
approached to revise Notification of his posting dated June 04, 2018 as Director General
Agriculture (Ext. & AR), Punjab Lahore on own pay and scale basis w.e.f. 04.04.2017 to
regularize the official work ab initio.
7. I am, therefore, directed to request that S&GAD Notification No.SOEI-1-
46/2015, dated June 04, 2018 regarding posting of Mr. Muhammad Zafaryab Haider, Director
of Agriculture (Horticulture), Lahore as Director General Agriculture (Ext. & AR), Punjab
Lahore may be modified w.e.f. 04.04.2017 instead of with immediate effect so that all the
powers used by him in capacity of Director General Agriculture (Ext. & AR), Punjab Lahore

Surveillance visit of all labs will be conducted by PNAC (Pakistan National Accreditation
Council) to assess the performance and maintenance of our ISO-17025 accredited labs each
year according to the given international standards to evaluate again for the recommendation
and continuity of accredited activities which are carrying out in our labs.
For continuous improvement and the maintenance of accreditation of ISO labs, these quality
parameters should be fulfilled persistently:
To conduct Internal and external audits.
To arrange MRM (Management Review Meeting).
To participate in PT/ILC for the accuracy of our results according to
international standards.
To resolve NCs raised during internal and external assessment by specific
bodies
As results of ISO labs are accepted internationally, so it is helpful for the removal of
International Technical Barriers to Trade for the acceptance of our Agricultural products in
all over the world that will play an important role in the economy of the country.
v. REVENUE GENERATION:
Every ISO accredited laboratory is under consideration for their scope extension as well as
other laboratories in Agriculture sector needs to be accredited according to the ISO standards
to increase the import and export of every agricultural products to be accepted all over the
world.
As we have received training from the PNAC experts of PCSIR (Pakistan Council of
Scientific and Industrial Research) to get Accreditation for Implementation and maintenance
of ISO-17025 Standard version in which every aspect of quality assurance activities are also
studied in detail. After that we have qualified the written tests and now we are able to
perform our duties as Quality Assurance Officers in the relevant Agricultural Research labs.

Mr. Muhammad Afzal, Assistant Director Agriculture (Ext.), Chiniot was deferred in the
Department Promotion Committee held on 11.06.2015 due to facing criminal case in the
Civil Court (copy enclosed) whch was registered against him under Section 365-PPC vide
FIR No.01/15 dated 01.01.2015 at Police Station Kotwali District Faisalabad. Now the
decision of the court has been announced as “no reason for non-production of evidence has
been mentioned so, in these circumstances when prosecution is not interested in the
proceedings of his case, it is best to stop the proceedings of the case under Section 249,
Cr.P.C. Resultantly, it is so done. Accused person is released for the time being under section
249, Cr.P.C. The case is adjourned sine die and file be sent to the record room for the time
being (copy enclosed).
2. In view of the above, Regulations Wing, S&GAD is requested to kindly guide
this department that whether the officer can be promoted at this stage or otherwise.

I am directed to refer to the subject noted above with reference to your letter
No.Reg:3-57/2016-745 dated 26.01.2018 on the subject noted above (Annex-A).
2. The brief facts of the case are that Mr. Abdul Sattar Anjum S/o Abdul Jalil was
appointed as Agriculture Officer BS-17 vide order dated 05.06.1988 (Annex-B). He served as
Agriculture Officer at various stations in Punjab. During his posting as Instructor, Barani Agricultural
Training Institute, Dahgal Rawalpindi, his services were placed at the disposal of Pakistan
Agricultural Research Council, Islamabad on deputation basis for a period of three years on the
request of PARC vide its letter dated 20.11.2008 on usual terms and conditions (Annex-C).
Accordingly, the officer relinquished the charge of the post of Instructor, BATI, Dahgal Rawalpindi
on 11.12.2008 (Annex-D).
3. After obtaining NOC from Agriculture Department dated 01.06.2010
(Annex-E) he was absorbed in the PARC, Islamabad as Scientific Officer (SPS-08) and posted at
National Institute of Organic Agriculture vide order dated 24.08.2010 with immediate effect
(Annex-F). Deputy Director (Estt:) PARC vide order dated 07.07.2017 repatriated the officer and
advised him to report back to Director General Agriculture (Ext. & AR) Punjab, Lahore under
intimation to his office (Annex-G). In compliance thereof, the officer submitted his joining on
24.07.2017 as Agriculture Officer (Ext.) BS-17 for further posting (Annex-H).
4. The case was forwarded to Regulations Wing, S&GAD and Law Department for
advice (Annexs-I & J). Regulations Wing, S&GAD advised to decide the matter at own level in the
light of judgments of Supreme Court of Pakistan and course of action earlier adopted by other
departments in such like cases (Annex-K).
5. Deputy Director (Reg), Law & Parliamentary Affairs Department intimated that as
the Federal Agency found the absorption of Mr. Abdul Sattar Anjum as illegal, therefore, he was
reverted to the parent department pursuant to the judgments of the Hon’ble Supreme Court of Pakistan
reported as 2013 SCMR 1752 and 2015 SCMR 456. In the circumstances, the Administrative
Department is left with no other option but to allow the officer to join his duties in the Administrative
Department against the post held by him at the time of his absorption in PARC. The Administrative
Department may take further necessary action in the matter in accordance with law (Annex-L).
6. But the Competent Authority observed as under:-
“How can we take him back after seven years of his absorption? He is no more
our employee. Now it’s a matter b/w PARC and him. We got nothing to do with
him. I would also like to know that why PARC shunted him out after seven
years?
7. Accordingly the request of joining of Mr. Abdul Sattar Anjum was rejected and
Director General Agriculture (Ext. & AR), Punjab Lahore was informed accordingly (Annex-M).
8. Mr. Abdul Sattar Anjum again submitted his joining on 14.04.2018 and requested that
the orders passed by this office dated 26.03.2018 may be withdrawn and joining as an Agricultural
Officer may be accepted accordingly from 18.07.2017.
9. Agriculture Department requested the Establishment Division to intimate as to
whether Establishment Division letter/OM No.1-59/2013/Lit-IV dated 31.01.2014 (Annex-N) still
hold field or otherwise vide letter dated 09.05.2018 (Annex-O).
10. Section Officer (Lit-IV), Establishment Division has informed that the office
Memorandum in question was withdrawn ab-initio vide O.M.No.1/59/2013-Lit-IV dated 18.09.2015
(Annex-P) with the observation that under Article 189 and 190 of the Constitution of the Islamic
Republic of Pakistan, every judgment of the Supreme Court of Pakistan is binding upon the
Executive. Therefore, practice of circulating judgments in bits and pieces be discontinued in future
(Annex-Q).
11. Mr. Abdul Sattar Anjum further submitted in his application (Annex-R) that Hon’ble
Supreme Court in the CRP No.18/2015 Original Petition No.89/2011, HRC 25394/2014 dated
19.05.2016 (Amir Hani Muslim J.) had already settled the lien issue “The issue of lien of such
officers has already been settled in the aforesaid judgments as induction of the employees has been
declared nullity, termination of their lien becomes insignificant.” Moreover, “their inter-se
seniority with their batchmates shall also be maintained and if their batchmates have been
promoted in the intervening period, they will also be entitled to such promotion (Annex-S).
12. In view of the above, it is requested that an expert opinion may kindly be provided
regarding “Lien” of Mr. Abdul Sattar Anjum whether he can be repatriated on his original post in
Agriculture Department after a period of seven years in case of implementation of order dated
07.07.2017 issued by PARC as well, as per opinion of Law Department already provided on
26.01.2018 and in light of verdict of August of Supreme Court of Pakistan in the matter of “Lien”.

Sir,
I am directed to refer to the subject noted above and to state that Rana Bilal
Rauf, Field Assistant o/o Assistant Director Agriculture (Ext.), Sambrial was appointed as
Field Assistant vide order dated 31.08.2007 (copy enclosed). He applied for NOC to take
admission in BSc (Hons) and ex-Deputy District Officer Agriculture (Ext.), Daska
recommended for issuance of permission of NOC on the face of application (copy enclosed).
Later on he was granted Study Leave on full pay w.e.f. 27.09.2010 to 26.09.2011 vide order
dated 27.09.2010 issued by ex-Deputy District Officer Agriculture (Ext.), Daska (copy
enclosed). Study leave (2nd year) was granted to him w.e.f. 28.09.2011 to 27.09.2012 on full
pay vide order dated 21.01.2012 issued by ex-District Officer Agriculture (Ext.), Sialkot
(copy enclosed). After that he applied for 3rd year Study Leave w.e.f. 28.09.2012 to
27.09.2013 which was rejected by ex-District Officer Agriculture (Ext.), Sialkot. Being
aggrieved he filed Writ Petition before Lahore High Court, Lahore. The Hon’ble Court
directed Agriculture Department to hear him. In compliance of Hon’ble Court, Personal
Hearing was granted to him and Secretary Agriculture passed order dated 16.03.2013 as
under (copy enclosed):-
a. M/S Bilal Rauf and M. Ashfaq Field Assistants may be
allowed to continue studies. Leave is hereby granted to
the as per title from 28.09.2012 to 27.09.2013 on
compassionate grounds in view of the fact that they
have spend 3 year (5th semester) and only one year’s
study is left.
b. M/s Mohsin and Aftab Ahmad are directed to report to the
department and process their case as per law/rules in view
of he fact that they have been recently admitted and it is
their 1st semester. Their absence period shall be treated as
leave per title.
c. Department proceedings under PEEDA Act, 2006 may
be initiated against Mr. Muhammad Yousaf, former
DOA(Ext.), Sialkot and Dr. Muhammad Asif Zia,
DDOA(Ext.), Daska for issuing NOC and granting
study leave to the petitioners without any lawful
authority. DGA(Ext.) shall prepare charge sheet against
all accused including allegations on record and forward
the same within 15 days.
d. The vires/legality of admission of above employees is left
to the University Authorities to decide their respective
cases without prejudice to above actions.
8. Case has been examined in the department and to state that the study will be
useful for the department.
9. I am further directed to request to kindly guide this department whether the
official is entitled for restoration of increments for the period w.e.f. 28.09.2011 to 27.09.2013
(EOL) the period he remained on study or otherwise in the light of Notification dated 26th
March, 1990.
