Now I have come to know through a reliable source that a post of MO (BS-17), BHU
Damowana Tehsil & District Sheikhupura is lying vacant due to absence from duty of Dr. Mahma
Javed since 27.10.2017.
It is, therefore, humbly prayed that I may kindly be appointed as WMO (BS-17),

“With reference to Rule 9 of the Revised Leave Rules 1981, the Chief
Minister has now been pleased to authorize the Finance Department to grant
extension in Extra Ordinary Leave (without pay) on specific recommendations
of the Administrative Department for the purpose of higher studies, on health
grounds and for the reasons beyond the control of a civil servant upto
maximum limit of five years and three more years combined together in case
of those who have put in more than ten years service and five years for those
who have put in at least two years continuous service.”

In view of the above, case is submitted before Finance Department for


approval for extension in Extraordinary Leave (without pay) w.e.f. 22.09.2016 to 21.09.2019.

(EXTENSION & AR) SERVICE RULES, 2007 AND THE PUNJAB
AGRICULTURE DEPARTMENT (EXTENSION WING) PROVINCIAL
MISCELLANEOUS POSTS SERVICE RULES, 2006

I am directed to refer to the subject noted above and to state that Agriculture
Department forwarded proposal for amendments in the Service Rules 2007 and Provincial
Miscellaneous posts Service Rules, 2006 to Regulations Wing, S&GAD. Regulations Wing initiated
summary for the said amendment through Secretary Law. Secretary Law has observed as under:-

a) The Service Rules Committee, vide draft Service Rules, 2007 had proposed the
qualifications of Ph.D and M.Sc for the post of DGA(Ext.): the lower as well as
the higher qualifications had thus been grouped sans any distinct consequences.
The lower qualification does not bar a person having higher qualification to
compete. That is why the qualification of Ph.D has been omitted and the
qualification of M.Sc has been retained: an applicant with Ph.D qualification or
any other higher qualification will also be eligible to apply.
b) The Service Rules Committee vide draft notification (Provincial Miscellaneous
Service Rules, 2006) had proposed substitution of two columns for the post of
Agriculture Inspector (BS-9). However, the said post with all the entries, had
been omitted vide S&GAD’s Notification No.SOR-III(S&GAD)1-11/2003(P)
dated 6th May, 2001 (copy enclosed). The recommendations of SRC to substitute
entries only in two columns cannot, therefore, be incorporated in the vetted draft.
If the Service Rules Committee intends to re-inject the said post, it may kindly
propose appropriate entries in all the ten columns.

2. Further the Secretary (Regulations), S&GAD has observed as under:-


“The Agriculture Department is requested to kindly look into the observations of Law
& PA Department. If the Administrative Department agrees to the vetted drafts, the
case may be submitted to the Chief Minister for approval please.”

3. I am further directed to request to furnish reply of above observations and also visit
o/o Deputy Secretary (A-II), Agriculture Department for discussion on 07.03.2018 positively.

you could not defend yourself. After preliminary enquiry report, a joint Enquiry Committee
was constituted. The committee submitted that no concrete proof is available against you but
at the same time the allegations of the complainant may also not be a whole lie.

The company was requested to verify the experience certificate. In response
02 verification certificates were received. In the letter dated December 3, 2015, Manager HR
of the said organization stated that their company has started its operation in 2002 (copy
enclosed). While the experience certificate was w.e.f. July 2000 to 21.06.2004.
Later on, the department again requested the said Industry to verify the
genuiness of certificate. Now they replied that all verification certificates are genuine (copy
enclosed).
2. In view of the above, it is requested that this department may be informed that
when company was registered by SECP/given certificate of incorporation by SECP.

returned the case with the remarks “The annual increment of 01.12.2011 is not admissible
due to non completion of six months as regularization was made on 23.07.2011”.

NO.FD.PC.2-1/2011 dated 11.07.2011.

due next scale No.19 on 01.12.1997 and not granted move over to him as he has not applied
for the same due to the reason that 3 years stay is required at maximum for move over to next
scale. Now it has come to his notice that in the light of Finance Department‘s letter
No.FDPC-1-1/83 dated 26.08.1993, Agriculture Experts are exempted from stay of 3 years,
so he is eligible for move over from BPS-18 to BPS-19 without stay at maximum of BPS-18.
2. In view of the above, advice may be solicited as to whether the case of move

3. In view of the above, advice may be solicited as to whether the case of move
over w.e.f. 01.12.1997 in favour of Mr. Shoukat Ali Cheema (Rtd) can be considered at this
belated stage and he has also been awarded punishment under PEEDA Act, 2006 or
otherwise.

Sir,
I am directed to refer to the subject noted above and to state that Mr. Ashfaq
Ahmad S/o Muhammad Ashraf, Field Assistant o/o Assistant Director Agriculture (Ext.),
Sambrial was appointed as Field Assistant vide order dated 01.01.2004 (copy enclosed). He
applied for NOC to take admission in BSc (Hons) and ex-Deputy District Officer Agriculture
(Ext.), Daska recommended for issuance of permission of NOC on the face of application
(copy enclosed). Later on he was granted Study Leave on full pay w.e.f. 27.09.2010 to
26.09.2011 vide order dated 27.09.2010 issued by ex-Deputy District Officer Agriculture
(Ext.), Daska (copy enclosed). Study leave (2nd year) was granted to him w.e.f. 28.09.2011 to
27.09.2012 on full pay vide order dated 21.01.2012 issued by ex-District Officer Agriculture
(Ext.), Sialkot (copy enclosed). After that he applied for 3rd year Study Leave w.e.f.
28.09.2012 to 27.09.2013 which was rejected by ex-District Officer Agriculture (Ext.),
Sialkot. Being aggrieved he filed Writ Petition before Lahore High Court, Lahore. The
Hon’ble Court directed Agriculture Department to hear him. In compliance of Hon’ble Court,
Personal Hearing was granted to him and Secretary Agriculture passed order dated
16.03.2013 as under (copy enclosed):-
a. M/S Bilal Rauf and M. Ashfaq Field Assistants may be
allowed to continue studies. Leave is hereby granted to
the as per title from 28.09.2012 to 27.09.2013 on
compassionate grounds in view of the fact that they
have spend 3 year (5th semester) and only one year’s
study is left.
b. M/s Mohsin and Aftab Ahmad are directed to report to the
department and process their case as per law/rules in view
of he fact that they have been recently admitted and it is
their 1st semester. Their absence period shall be treated as
leave per title.
c. Department proceedings under PEEDA Act, 2006 may
be initiated against Mr. Muhammad Yousaf, former
DOA(Ext.), Sialkot and Dr. Muhammad Asif Zia,
DDOA(Ext.), Daska for issuing NOC and granting
study leave to the petitioners without any lawful
authority. DGA(Ext.) shall prepare charge sheet against
all accused including allegations on record and forward
the same within 15 days.
d. The vires/legality of admission of above employees is left
to the University Authorities to decide their respective
cases without prejudice to above actions.

2. Secretary Agriculture again passed following orders dated 29.07.2013 while


deciding the Show Cause Cum Personal Hearing Notice issued to M/S Muhammad Yousaf,
former DOA(Ext.), Sialkot and Muhammad Asif Zia, DDOA(Ext.), Daska for issuing NOC
and granting study leave to the petitioners without any lawful authority (copy enclosed):
“Keeping in view the above position and taking a lenient
view, I Dr. Ijaz Munir, Secretary Agriculture / Competent
Authority impose minor penalty of “Censure” upon the
accused under article 4(i)(a)(i) of PEEDA Act, 2006 and
recovery of amount from the Field Assistant erratically
drawn by them under the head of salaries (during full pay
leave granted to them by the Accused)”
3. Being aggrieved of above order dated 29.07.2013, Mr. Ashfaq Ahmad filed
Writ Petition 55486/Writ and in compliance of court order Secretary Agriculture after listing
the petitioner passed following order vide No. SO(A-II)12-1-2013 dated 01.12.21014 (copy
enclosed) as serial No. 11:
“Now therefore in view of the discussion made above and
merits of the case, I, Ali Tahir Secretary Agriculture /
Competent Authority do not find any reason to amend the
orders dated 29.07.2013 passed by my
predecessor/Secretary Agriculture”.
4. Mr. Ashfaq Ahmad again filed Writ Petition No.33137/14 and in compliance
of court order Secretary Agriculture after listing the petitioner passed following order vide
No. SO(A-II)12-1/2013 dated 18.02.2015 (copy enclosed) in Para No. 8
“Now therefore, I, Rashid Mahmood, Secretary Agriculture
in view of the foregoing reject the request of the petitioners
being devoid of merits of the case.”
5. Now the official has completed his BSc(Hons) Agriculture and requested that
since he was on study w.e.f. 28.09.2011 to 27.09.2013, therefore, his increments may be
restored in the light of Notification No.SR.II-1-109/89 dated 26th March, 1990 issued by
Deputy Secretary (SR-II), Finance Department and the period of 4th year leave w.e.f.
28.09.2013 to 27.09.2014 was remained undecided due to above may also be decided by
granting study leave.
6 Administrative Department while deciding 4th year undecided period, granted
him 293 days study leave on fully pay w.e.f. 28.09.2013 to 18.07.2014 vide order dated
02.05.2018 (copy enclosed).
7. However, regarding his request for restoration of increments, the Notification
No.SR.II-1-109/89 dated 26th March, 1990 issued by Deputy Secretary (SR-II), Finance
Department provides that (copy enclosed):-
“Provided that the competent authority, i.e. Finance Department in
consultation with the Administrative Department, may in case in
which it is satisfied that extraordinary leave was taken (i) on
account of illness, or (ii) for higher studies if it is certified by the
Administrative Department that the course of study will be
useful for the department, or (iii) for any other cause beyond the
Government servant’s control, direct that EOL shall be counted
for increment under sub-clause(ii) and (iii) of this clause.”

8. Case has been examined in the department and to state that the study will be
useful for the department.
9. I am further directed to request to kindly guide this department whether the
official is entitled for restoration of increments for the period w.e.f. 28.09.2011 to 27.09.2013
(EOL) the period he remained on study or otherwise in the light of Notification dated 26th
March, 1990.

2. Brief background of the case is that Mr. Saeed Akbar S/O Akbar Ali, Junior
Clerk office of the then Deputy Director of Agriculture now designated District Officer
Agriculture (Ext) Narowal was notionally posted in the office of Deputy District Officer
Agriculture (Ext) Yazman, District Bahawalpur against vacant post vide order dated
28.2.2008 for the purpose of drawal of pay for the period from 01.10.1997 to 16.7.2000. At
the same time the Executive District Officer (Agriculture), Bahawalpur was also requested to
approach the District Government for provision of additional funds for the Financial Year
2007-08 with copy thereof to the Deputy District Officer Agriculture (Ext), Yazman, District
Bahawalpur vide letter dated 19.3.2008. The District Officer Agriculture (Ext), Narowal was
also asked to supply the service Book & original L.P.C. of the said official for the purpose,
who informed vide letter dated 14.6.2008 to contact the Deputy District Officer Agriculture
(Ext), Kotli Sattian to provide L.P.C.
3. In this connection, Deputy District Officer Agriculture (Ext), Yazman, District
Bahawalpur were reminded to arrange the payment to the above named official vide letter
dated 22.10.2008, 08.11.2008 and 26.11.2008. Meanwhile, Deputy District Officer
Agriculture (Ext), Yazman, District Bahawalpur informed vide letter dated 26.11.2008 that as
per record of District Accounts Officer, Bahawalpur no post of Junior Clerk remained vacant
during the period from 01.10.1997 to 30.06.1998 due to which arrear bill was not passed.
Hence, the Deputy District Officer Agriculture (Ext), Bahawalpur was asked to ensure early
clearance of the dues for the period from 01.10.1997 to 16.7.2000 vide letter dated
06.12.2008.
4. On receipt of Service Book and L.P.C of Mr. Saeed Akbar, Junior Clerk, o/o
Deputy District Officer Agriculture (Ext), Bahawalpur demanded for provision of funds of
Rs.82,272/- during the current financial year, 2015-16. After receiving the funds when the
arrear bill was submitted to District Accounts Officer, Bahawalpur, he returned the bill un-
passed raising objection that the case being 08 years old has become time barred.
5. It is pertinent to state that as per Sr.No.18 of the Delegation of Financial
Powers Rules, 2016 (copy enclosed), Finance Department is competent to accord approval.
6. In view of the above, the case for payment of arrears of salary to Mr. Saeed
Akbar, Junior Clerk, o/o Deputy District Officer Agriculture (Ext), Bahawalpur w.e.f.
01.10.1997 to 16.07.2000 is submitted for obtaining concurrence/approval of Finance
Department. It is, therefore, requested that the case may be approved as the official being low
paid employee is facing hardship.

period of three years after getting NOC from Services & General Administration Department.
2. Dr. Muhammad Anjum Ali, Director General Agriculture (Ext. & AR), Punjab
Lahore has requested for relieving from the position of Director General Agriculture (Ext. &
AR), Punjab Lahore to join as Member (Crop Sciences), Pakistan Agricultural Research
Council (PARC), under Ministry of National Food Security & Research, Islamabad for a
period of three years. No officer of Extension Wing of Agriculture Department in BS-20 was
available. Mr. Muhammad Zafaryab Haider (BS-19) at seniority No.1 Director Agriculture
(Horticulture) Ext. (BS-19), Lahore was senior most officer in the seniority list of BS-19
officers of Extension & Adaptive Research Wing of Agriculture Department.
3. Accordingly Summary for Chief Minister was submitted with following
proposals:-
I. Dr. Muhammad Anjum Ali, Director General Agriculture (Ext. & AR),
Punjab Lahore may be relieved w.e.f. 30.03.2017 from the post of
Director General Agriculture (Ext. & AR), Punjab Lahore to join his
new assignment as Member (Crop Sciences), Pakistan Agricultural
Research Council (PARC), under Ministry of National Food Security
& Research, Islamabad for period of three years.
II. Mr. Muhammad Zafaryab Haider, Director Agriculture (Horticulture)
Ext. (BS-19), Lahore may be transferred and posted as Director
General Agriculture (Ext. & AR) (BS-20), Punjab Lahore in his own
pay and scale.
Chief Minister was pleased to approve above proposals of Administrative
Department vide para 53 of the summary (copy enclosed).
4. Services & General Administrative Department vide Notification No.SOEI-1-
46/2015, dated June 04, 2018 approved relieving of Dr. Muhammad Anjum Ali from the post
of Director General Agriculture (Ext. & AR), Punjab Lahore w.e.f. 30.03.2017. However,
S&GAD had posted Mr. Muhammad Zafaryab Haider, Director Agriculture (Horticulture)
Ext. (BS-19), Lahore as Director General Agriculture (Ext. & AR), Punjab Lahore on OPS
Basis with immediate effect.
5. From above, it is transpired that Agriculture Department initiated Summary
for Chief Minister on 03.04.2017 with proposals of relieving of Dr. Muhammad Anjum Ali
from the post of Director General Agriculture (Ext. & AR), Punjab Lahore w.e.f. 30.03.2017
and posting of Mr. Muhammad Zafaryab Haider, Director Agriculture (Horticulture) Ext.
(BS-19), Lahore as Director General Agriculture (Ext. & AR), Punjab Lahore with
assumption of posting of Mr. Muhammad Zafaryab Haider as Director General Agriculture
(Ext. & AR), Punjab Lahore on own pay and scale w.e.f. 04.04.2017. Further Agriculture
Department assigned look after charge of the post of Director General Agriculture (Ext. &
AR), Punjab Lahore to Mr. Muhammad Zafaryab Haider, Director Agriculture (Horticulture)
Ext. (BS-19), Lahore w.e.f. 04.04.2017 to run affairs of Extension Wing of Agriculture
Department smoothly.
6. Now Mr. Zafaryab Haider, Director General Agriculture (Ext. & AR), Punjab
Lahore has requested that the Services and General Administration Department may be
approached to revise Notification of his posting dated June 04, 2018 as Director General
Agriculture (Ext. & AR), Punjab Lahore on own pay and scale basis w.e.f. 04.04.2017 to
regularize the official work ab initio.

It is submitted that we have been selected as Assistant Research


Officer/Agricultural Officer, Quality Assurance upto 30.06.2018 on contract basis subject to
extension on yearly basis on satisfactory performance under the development project
“Accreditation of AARI/Laboratories for ISO-17025”, under the Directorate of Rapid Soil
Fertility Survey and Soil Testing Institute, Punjab Lahore vide order No.SO(R&E)6-4/2017-
AAL, dated 2nd March, 2018 (copy enclosed).
2. Before 40 days of expiry of the project as mentioned in our orders we applied
to worthy Secretary Agriculture through proper channel for extension of the project through
bridge financing w.e.f. 01.07.2018 to 31.12.2018 vide letter No.24136/Acctts., dated
21.05.2018 (copy enclosed). Activities of the officers in their concerned Labs daily,
weekly, monthly, by annually and annually is hereby enclosed that will continue for
assuring the maintenance of Accreditation of AARI Laboratories for ISO-17025
standards on regular basis.
3. Accordingly after approval of worthy Secretary Agriculture, Section Officer
(Planning), Government of the Punjab, Agriculture Department requested Finance
Department to provide funds amounting to Rs.6.764 million on account of pay and
allowances for the 20 Nos. of staff positions recruited under the project w.e.f. 01.07.2018 to
31.12.2018 through bridge financing so that the outcomes/investment made under the project
may not suffer vide UO.No.SOA(P)3-30/2016, 13.06.2018 (copy enclosed).
4. Now Finance Department has observed that Revised Budget Estimates for the
year 2017-18 have been finalized so the request of the department cannot be entertained at
this belated stage (copy enclosed).
5. In this regard, it is submitted that if the project will not extend following
objectives of the project will be suffered and department/government may face financial loss
and as well as the import and export of the Agricultural products that are to be accepted in all
over the world:-
i. OLDER VERSION:
As we have now implemented older version (ISO-17025: 2005) in our few agricultural
Research labs which has been launched Internationally in 2005 and latest version (ISO-
17025: 2017) has been launched since 2017 and we have to implement the latest version
within three years in all accredited laboratories according to the international standards,
otherwise in 2020 accreditation of all ISO labs and their accredited activities will be
suspended, So we have only one and half year left to implement ISO-17025: 2017
version as directed by the International Standard Organizations (APLAC, ILAC).
ii. SURVEILLANCE VISIT:

Surveillance visit of all labs will be conducted by PNAC (Pakistan National Accreditation
Council) to assess the performance and maintenance of our ISO-17025 accredited labs each
year according to the given international standards to evaluate again for the recommendation
and continuity of accredited activities which are carrying out in our labs.

iii. CONTINUOUS IMPROVEMENT:

For continuous improvement and the maintenance of accreditation of ISO labs, these quality
parameters should be fulfilled persistently:
 To conduct Internal and external audits.
 To arrange MRM (Management Review Meeting).
 To participate in PT/ILC for the accuracy of our results according to
international standards.
 To resolve NCs raised during internal and external assessment by specific
bodies

iv. REMOVAL OF TECHNICAL BARRIERS TO TRADE (TBT):

As results of ISO labs are accepted internationally, so it is helpful for the removal of
International Technical Barriers to Trade for the acceptance of our Agricultural products in
all over the world that will play an important role in the economy of the country.

v. REVENUE GENERATION:

Massive generation of Revenue/Income for Agriculture sector through testing of samples


from ISO accredited labs as these results are more accurate, authentic and accepted
everywhere in the world.
vi. SCOPE EXTENTION:

Every ISO accredited laboratory is under consideration for their scope extension as well as
other laboratories in Agriculture sector needs to be accredited according to the ISO standards
to increase the import and export of every agricultural products to be accepted all over the
world.

vii. ISO RELATED TRAINING:

As we have received training from the PNAC experts of PCSIR (Pakistan Council of
Scientific and Industrial Research) to get Accreditation for Implementation and maintenance
of ISO-17025 Standard version in which every aspect of quality assurance activities are also
studied in detail. After that we have qualified the written tests and now we are able to
perform our duties as Quality Assurance Officers in the relevant Agricultural Research labs.

6. Keeping in view of above reasons, it is humbly requested that Finance


Department may kindly be again approached by mentioning above facts with the request to
provide funds amounting to Rs.6.764 million on account of pay and allowances for the 20
Nos. of staff positions recruited under the project w.e.f. 01.07.2018 to 31.12.2018 through
bridge financing so that the outcomes/investment made under the project may not suffer

Cr.P.C. Resultantly, it is so done. Accused person is released for the time being under section
249, Cr.P.C. The case is adjourned sine die and file be sent to the record room for the time

having 4 year B.Sc (Hons) Agriculture with M.Sc (Hons) Agriculture from Higher Education

ABDUL SATTAR ANJUM S/O ABDUL JALIL FOR JOINING IN
AGRICULTURE DEPARTMENT ON REPATRIATION AFTER
ABSORPTION IN PARC.

I am directed to refer to the subject noted above with reference to your letter
No.Reg:3-57/2016-745 dated 26.01.2018 on the subject noted above (Annex-A).
2. The brief facts of the case are that Mr. Abdul Sattar Anjum S/o Abdul Jalil was
appointed as Agriculture Officer BS-17 vide order dated 05.06.1988 (Annex-B). He served as
Agriculture Officer at various stations in Punjab. During his posting as Instructor, Barani Agricultural
Training Institute, Dahgal Rawalpindi, his services were placed at the disposal of Pakistan
Agricultural Research Council, Islamabad on deputation basis for a period of three years on the
request of PARC vide its letter dated 20.11.2008 on usual terms and conditions (Annex-C).
Accordingly, the officer relinquished the charge of the post of Instructor, BATI, Dahgal Rawalpindi
on 11.12.2008 (Annex-D).
3. After obtaining NOC from Agriculture Department dated 01.06.2010
(Annex-E) he was absorbed in the PARC, Islamabad as Scientific Officer (SPS-08) and posted at
National Institute of Organic Agriculture vide order dated 24.08.2010 with immediate effect
(Annex-F). Deputy Director (Estt:) PARC vide order dated 07.07.2017 repatriated the officer and
advised him to report back to Director General Agriculture (Ext. & AR) Punjab, Lahore under
intimation to his office (Annex-G). In compliance thereof, the officer submitted his joining on
24.07.2017 as Agriculture Officer (Ext.) BS-17 for further posting (Annex-H).
4. The case was forwarded to Regulations Wing, S&GAD and Law Department for
advice (Annexs-I & J). Regulations Wing, S&GAD advised to decide the matter at own level in the
light of judgments of Supreme Court of Pakistan and course of action earlier adopted by other
departments in such like cases (Annex-K).
5. Deputy Director (Reg), Law & Parliamentary Affairs Department intimated that as
the Federal Agency found the absorption of Mr. Abdul Sattar Anjum as illegal, therefore, he was
reverted to the parent department pursuant to the judgments of the Hon’ble Supreme Court of Pakistan
reported as 2013 SCMR 1752 and 2015 SCMR 456. In the circumstances, the Administrative
Department is left with no other option but to allow the officer to join his duties in the Administrative
Department against the post held by him at the time of his absorption in PARC. The Administrative
Department may take further necessary action in the matter in accordance with law (Annex-L).
6. But the Competent Authority observed as under:-
“How can we take him back after seven years of his absorption? He is no more
our employee. Now it’s a matter b/w PARC and him. We got nothing to do with
him. I would also like to know that why PARC shunted him out after seven
years?

7. Accordingly the request of joining of Mr. Abdul Sattar Anjum was rejected and
Director General Agriculture (Ext. & AR), Punjab Lahore was informed accordingly (Annex-M).
8. Mr. Abdul Sattar Anjum again submitted his joining on 14.04.2018 and requested that
the orders passed by this office dated 26.03.2018 may be withdrawn and joining as an Agricultural
Officer may be accepted accordingly from 18.07.2017.
9. Agriculture Department requested the Establishment Division to intimate as to
whether Establishment Division letter/OM No.1-59/2013/Lit-IV dated 31.01.2014 (Annex-N) still
hold field or otherwise vide letter dated 09.05.2018 (Annex-O).
10. Section Officer (Lit-IV), Establishment Division has informed that the office
Memorandum in question was withdrawn ab-initio vide O.M.No.1/59/2013-Lit-IV dated 18.09.2015
(Annex-P) with the observation that under Article 189 and 190 of the Constitution of the Islamic
Republic of Pakistan, every judgment of the Supreme Court of Pakistan is binding upon the
Executive. Therefore, practice of circulating judgments in bits and pieces be discontinued in future
(Annex-Q).
11. Mr. Abdul Sattar Anjum further submitted in his application (Annex-R) that Hon’ble
Supreme Court in the CRP No.18/2015 Original Petition No.89/2011, HRC 25394/2014 dated
19.05.2016 (Amir Hani Muslim J.) had already settled the lien issue “The issue of lien of such
officers has already been settled in the aforesaid judgments as induction of the employees has been
declared nullity, termination of their lien becomes insignificant.” Moreover, “their inter-se
seniority with their batchmates shall also be maintained and if their batchmates have been
promoted in the intervening period, they will also be entitled to such promotion (Annex-S).
12. In view of the above, it is requested that an expert opinion may kindly be provided
regarding “Lien” of Mr. Abdul Sattar Anjum whether he can be repatriated on his original post in
Agriculture Department after a period of seven years in case of implementation of order dated
07.07.2017 issued by PARC as well, as per opinion of Law Department already provided on
26.01.2018 and in light of verdict of August of Supreme Court of Pakistan in the matter of “Lien”.

Sir,
I am directed to refer to the subject noted above and to state that Rana Bilal
Rauf, Field Assistant o/o Assistant Director Agriculture (Ext.), Sambrial was appointed as
Field Assistant vide order dated 31.08.2007 (copy enclosed). He applied for NOC to take
admission in BSc (Hons) and ex-Deputy District Officer Agriculture (Ext.), Daska
recommended for issuance of permission of NOC on the face of application (copy enclosed).
Later on he was granted Study Leave on full pay w.e.f. 27.09.2010 to 26.09.2011 vide order
dated 27.09.2010 issued by ex-Deputy District Officer Agriculture (Ext.), Daska (copy
enclosed). Study leave (2nd year) was granted to him w.e.f. 28.09.2011 to 27.09.2012 on full
pay vide order dated 21.01.2012 issued by ex-District Officer Agriculture (Ext.), Sialkot
(copy enclosed). After that he applied for 3rd year Study Leave w.e.f. 28.09.2012 to
27.09.2013 which was rejected by ex-District Officer Agriculture (Ext.), Sialkot. Being
aggrieved he filed Writ Petition before Lahore High Court, Lahore. The Hon’ble Court
directed Agriculture Department to hear him. In compliance of Hon’ble Court, Personal
Hearing was granted to him and Secretary Agriculture passed order dated 16.03.2013 as
under (copy enclosed):-
a. M/S Bilal Rauf and M. Ashfaq Field Assistants may be
allowed to continue studies. Leave is hereby granted to
the as per title from 28.09.2012 to 27.09.2013 on
compassionate grounds in view of the fact that they
have spend 3 year (5th semester) and only one year’s
study is left.
b. M/s Mohsin and Aftab Ahmad are directed to report to the
department and process their case as per law/rules in view
of he fact that they have been recently admitted and it is
their 1st semester. Their absence period shall be treated as
leave per title.
c. Department proceedings under PEEDA Act, 2006 may
be initiated against Mr. Muhammad Yousaf, former
DOA(Ext.), Sialkot and Dr. Muhammad Asif Zia,
DDOA(Ext.), Daska for issuing NOC and granting
study leave to the petitioners without any lawful
authority. DGA(Ext.) shall prepare charge sheet against
all accused including allegations on record and forward
the same within 15 days.
d. The vires/legality of admission of above employees is left
to the University Authorities to decide their respective
cases without prejudice to above actions.

2. Secretary Agriculture again passed following orders dated 29.07.2013 while


deciding the Show Cause Cum Personal Hearing Notice issued to M/S Muhammad Yousaf,
former DOA(Ext.), Sialkot and Muhammad Asif Zia, DDOA(Ext.), Daska for issuing NOC
and granting study leave to the petitioners without any lawful authority (copy enclosed):
“Keeping in view the above position and taking a lenient
view, I Dr. Ijaz Munir, Secretary Agriculture / Competent
Authority impose minor penalty of “Censure” upon the
accused under article 4(i)(a)(i) of PEEDA Act, 2006 and
recovery of amount from the Field Assistant erratically
drawn by them under the head of salaries (during full pay
leave granted to them by the Accused)”
3. Being aggrieved of above order dated 29.07.2013, Rana Bilal Rauf, Field
Assistant filed Writ Petition 55486/Writ and in compliance of court order Secretary
Agriculture after listing the petitioner passed following order vide No. SO(A-II)12-1-2013
dated 01.12.21014 (copy enclosed) as serial No. 11:
“Now therefore in view of the discussion made above and
merits of the case, I, Ali Tahir Secretary Agriculture /
Competent Authority do not find any reason to amend the
orders dated 29.07.2013 passed by my
predecessor/Secretary Agriculture”.
4. Rana Bilal Rauf, Field Assistant again filed Writ Petition No.33137/14 and in
compliance of court order Secretary Agriculture after listing the petitioner passed following
order vide No. SO(A-II)12-1/2013 dated 18.02.2015 (copy enclosed) in Para No. 8
“Now therefore, I, Rashid Mahmood, Secretary Agriculture
in view of the foregoing reject the request of the petitioners
being devoid of merits of the case.”
5. Now the official has completed his BSc(Hons) Agriculture and requested that
since he was on study w.e.f. 28.09.2011 to 27.09.2013, therefore, his increments may be
restored in the light of Notification No.SR.II-1-109/89 dated 26th March, 1990 issued by
Deputy Secretary (SR-II), Finance Department and the period of 4th year leave w.e.f.
28.09.2013 to 27.09.2014 was remained undecided due to above may also be decided by
granting study leave.
6 Administrative Department while deciding 4th year undecided period, granted
him 293 days study leave on fully pay w.e.f. 28.09.2013 to 18.07.2014 vide order dated
02.08.2018 (copy enclosed).
7. However, regarding his request for restoration of increments, the Notification
No.SR.II-1-109/89 dated 26th March, 1990 issued by Deputy Secretary (SR-II), Finance
Department provides that (copy enclosed):-
“Provided that the competent authority, i.e. Finance Department in
consultation with the Administrative Department, may in case in
which it is satisfied that extraordinary leave was taken (i) on
account of illness, or (ii) for higher studies if it is certified by the
Administrative Department that the course of study will be
useful for the department, or (iii) for any other cause beyond the
Government servant’s control, direct that EOL shall be counted
for increment under sub-clause(ii) and (iii) of this clause.”

8. Case has been examined in the department and to state that the study will be
useful for the department.

official is entitled for restoration of increments for the period w.e.f. 28.09.2011 to 27.09.2013

2. Agriculture Department initiated Summary for Chief Minister for posting of

Own Pay and Scale basis on retirement of Mr. Muhammad Yousaf Chahal on attaining the

summary observed that the posting of the officers in their own pay and scale is a stop-gap
arrangement which should not be perpetuated as a routine matter and returned the summary
for taking necessary steps to fill up the vacant posts by promotion of the senior-most officers

3. At present, following posts have become vacant due to

4. At present no officer of Extension Wing of Agriculture Department in BS-19


is available for posting against the vacant posts. Therefore, work of the posts have badly been
suffered. Due to which seniority list dated 24.01.2011 cannot be revised at this point of time.
5. Regarding the fresh No Inquiry Certificate from Anti-Corruption
Establishment, reminders dated 02.10.2018 and 10.10.2018 has been issued (Annex-B&C).

Subject: APPEALS NO.976/2016 TITLED AS FIDA HUSSAIN VS. SECRETARY


AGRICULTURE ETC

I am directed to refer to the subject noted above and to state that a Show Cause
Cum Personal Hearing Notice was served upon Mr. Fida Hussain, Deputy Director
(Training), IATI, R.Y.Khan on the following charges (Annex-A):-

“You remained absent from duty w.e.f. 06.02.2014 to 28.02.2014


without lawful permission by the Competent Authority, therefore,
you are liable to be proceeded against departmentally under PEEDA
Act, 2006.”

After fulfilling all codal formalities, Secretary Agriculture/Competent


Authority imposed penalty of “stoppage of annual increment for 02 years” upon Mr. Fida
Hussain, Deputy Director (Training), IATI, R.Y.Khan vide order dated 02.06.2014 (Annex-
B). Being aggrieved of above, Mr. Fida Hussain, Deputy Director (Training), IATI,
R.Y.Khan/accused officer filed appeal before Chief Secretary/Appellate Authority (Annex-
C) which was rejected by the Chief Secretary vide order dated 25.01.2016 (Annex-D).
Later on, he filed appeal in the PST and Hon’ble PST has passed order dated
24.04.2018 (Annex-E). Operating part of the order is as under:-

“In view of given circumstances Court is of the view that the


impugned orders passed against the law and justice, the same
are hereby set aside.”

On receipt of judgment dated 24.04.2018 passed by Hon’ble PST, the case


was forwarded to the Solicitor, Government of the Punjab, Lahore with the request to
examine the case and tender his expert opinion regarding filing of CPLA before the Supreme
Court of Pakistan (Annex-F). The Solicitor has informed that there is no scope of success by
filing of CPLA (Annex-G).
In compliance of order of hon’ble Punjab Service Tribunal, Lahore dated
24.04.2018, advice may be solicited to this department to the effect that both orders dated
02.06.2014 issued by Secretary Agriculture and order dated 25.01.2016 of Chief Secretary
may be set aside or only order dated 02.06.2014 issued by Secretary Agriculture.
