AFFIDAVIT OF DESISTANCE

CITY OF BATANGAS ) S.S.

I, CENON P. FRANCISCO, of legal age, married, and a resident of Brgy,

Marawouy Lipa City, Batangas, after having duly sworn to in accordance
with law hereby depose and state:

1. I am the complaining witness for Frustrated Homicide against Crisipin R. Ranon

in the NPSD NO. IV-02-INV-19G-00741 filed before the Provincial Prosecutor’s Office
of Batangas City;

2. After several conferences with the accused, I hereby declare that the same arose
out of pure misunderstanding and apprehension of facts;

3. Based on the said misunderstanding, misapprehension of facts and also for the
welfare of our child, I manifest that I am now permanently withdrawing my complaint
against the accused and that I am no longer interested, and I hereby desist, in prosecuting
the above-mentioned case;

4. This Affidavit of Desistance should, however not be understood as a waiver or

relinquishment of any of my legal rights to pursue any legal action that I may file in
connection with any act or omission that the accused may commit in the future;

5. I hereby release the accused from any and all criminal liabilities and waive any
right of action in connection with the above case;

6. I hereby inform the Provincial Prosecutor of Batangas City that I am

withdrawing my complaint for Frustrated Homicide in NPSD NO. IV-02-INV-19G-
00741 filed before the Provincial Prosecutor’s Office of Batangas City.

5. I likewise request the Provincial Prosecutor’s Office, City of Batangas to

withdraw or dismiss with prejudice the said criminal case.
