Overview:
This agreement is made between the Clients, whose names are
listed above, and the Photographer, Lindsey Coleman of Lindsey
Coleman Photography. Coverage is scheduled for _______. All
photographs will be shot in digital format and will be delivered
as high-resolution JPEG files in an online gallery within 4-6
weeks of the wedding. Images will remain available for download
within one month of the gallery release date.

Fees:
Package price: _______
This fee includes coverage, a second shooter, an online gallery,
printing rights, digital processing of the camera RAW files, and
all density and color corrected high-resolution images in JPEG
format.

Additional hours of photography are available for $---/hour,

which shall be paid to the Photographer prior to exit at the end
of the event by either personal check or cash.

Retainer and Payment:

Upon your signature, Lindsey Coleman Photography will reserve
the time and date agreed upon and will not make other
reservations for that time and date. The Client shall make a
non-refundable retainer of $-- to the Photographer upon
signature to perform the services specified herein. The
remaining amount must be paid within one week prior to the date
of the event. Please make checks payable to Lindsey Coleman.
Other online methods of payment may be discussed at the
convenience of the Client.

Artistic Rights:
The Photographer retains the right of discretion in selecting the
photographic materials released to the Client. All editing is the
responsibility of the Photographer. You may request black and white
copies of images. Please do not edit, apply filters, screenshot, or
tamper with images in any way. If you are unsatisfied with the
editing work of the Photographer in any way, please speak with her.

Photographic Materials:
All photographic materials (negatives, transparencies, proofs, and
previews) shall be the exclusive property of the Photographer.
Edited images will be delivered to the Client within 4-6 weeks
after the wedding via online gallery for download. The gallery
shall remain open for 30 days after delivery date.
Copyright and Reproductions:
The Photographer shall own the copyright in all images created and
shall have the exclusive right to make reproductions for, including
but not limited to, marketing materials, social media, portfolio
entries, sample products, editorial submissions and use, or for
display within or on the Photographer’s website and/or studio. If
the Photographer desired to make other uses, the Photographer shall
not do so without first obtaining written permission of the Client.
It is understood that any duplication or alteration of original
images is strictly prohibited {Copyright Law Title 17, Appendix V.
Additional provisions of the Digital Millennium Copyright Act 2005,
Section 102} without the written permission of the Photographer.

Client’s Usage:
The Client shall use prints and digital files in accordance with
the permissions within this agreement. Printing rights are granted.
The Client’s prints are for personal use only and shall not be
submitted into contests or reproduced for commercial use without
permission from the Photographer. The Client shall not authorize
any reproductions by parties other than the Photographer without
permission.

Social Media:
The Client may share blog post links, Instagram posts, and Facebook
albums through use of the share functions or in any other fashion
the Photographer provides. The Client must credit/tag Lindsey
Coleman Photography (@lindsphotoco) in any posts or shares of their
own.

Capturing Desired Photographs:

At least two weeks prior to the wedding, the Clients will fill
out a questionnaire to finalize important details and a shot
list for the day. The shot list is not a guarantee, but rather a
guide for the Photographer. The Parties agree to positive
cooperation and communication for the best possible result
within the definition of this assignment. The wishes of the
Client will be met to the best of the ability of the
Photographer. The Photographer will NOT be held accountable for
not capturing desired photographs if there is no one to assist
in identifying or gathering people/items/locations for the
photographs. Lindsey Coleman Photography is not responsible for
key individuals’ failure to be present or to cooperate during
the event, neither for missed images due to details not revealed
to the Photographer.
Sole Photographer:
It is understood that Lindsey Coleman and one second shooter
will act as the sole wedding photographers for the day. Since
guests blocking ceremony shots and flashes from guests’ cameras
may ruin shots taken by the Photographer, the Clients
acknowledge that they are responsible for notifying their guests
that guest photography shall be limited and not at the expense
of the professional photographer’s work.

Failure to Perform:
The Photographer will arrive at the wedding to the absolute best
of their ability. If the Photographer is unable to perform this
agreement due to illness, emergency, fire, casualty, strike,
unsafe environment, threat, act of God, or causes beyond the
control of the Photographer, the Photographer will not be held
liable for missing scheduled session coverage. If the
Photographer is unable to attend the wedding for any reason,
they will provide a replacement photographer at no extra charge.
The substitute photographer is chosen at the discretion of the
Photographer and does not constitute a breach of this agreement.
The Photographer warrants the substitute photographer to be of
comparable quality and professionalism.

If photographic coverage services cannot be fulfilled by Lindsey

Coleman or a replacement chosen at the discretion of the
Photographer, the Photographer shall return the retainer to the
Client and shall have no further liability. Further, if the
Photographer is unable to deliver photographic materials due to
technological malfunctions, including but not limited to camera
and processing or otherwise lost or damaged images without fault
of the Photographer, liability shall be limited. The limit of
liability shall not exceed the contract price stated herein.
Lindsey Coleman Photography will not be held responsible for any
ruined photographs due to guests’ flashes or any other ruined
photographs due to any other cause in or outside of the
Photographer’s control.

Photographer’s Standard Price List:

The charges in this agreement are based on the Photographer’s
current price list. This pricing is adjusted periodically, and
future orders shall be charged at the prices in effect at the
time when the order is placed.

Indemnification:
The Photographer shall be held harmless against any and all loss
of any type for any reason. The Clients shall indemnify and
reimburse the photographer for any and all loss by any party
whatsoever, including any third-party rights for use of venue.

Miscellany:
This Agreement incorporates the entire understanding of the
parties. Any modifications of this Agreement must be in writing
and signed by both parties. Any waiver of a breach or default
hereunder shall not be deemed a waiver of a subsequent breach or
default of either the same provision or any other provision of
this Agreement.
To confirm your booking and acknowledge acceptance of this
contract, please sign, date, and return with the $-- retainer to
Lindsey Coleman Photography. It is recommended you print a copy
for your records.
