 WHERE TO APPLY
The application shall be filed with the trial court that tried and sentenced the offender at any time after
conviction and sentence but within fifteen (15) days after promulgation of judgment.
If application is based on a modified decision imposing a probationable penalty, it shall be filed in the trial
court where the judgment of conviction imposing a non-probationable penalty was rendered, or where
such case has since been re-raffled.

 HOW TO APPLY
1. Apply within fifteen (15) days from promulgation of judgment.
2. The court will suspend the execution of sentence and refer the application to the proper probation office for the
conduct of post-sentence investigation (PSI).
3. The probation officer must submit the Post-Sentence Investigation Report (PSIR) within sixty (60) days upon
receipt but the period may be extended in meritorious cases for a period that will be approved by the court.
4. Pending submission of the PSIR and the resolution of the application, the defendant may be temporarily released
under bail or be released on recognizance of a responsible member of the community, if defendant is incapable of
posting bail

 SAAN MAGSUSUMITE NG APLIKASYON
Ang aplikasyon para sa probation ay isusumite sa trial court / hukuman na naglitis ng iyong kaso at
naghatol ng parusa. Ito ay maaring I sumite kahit anong araw matapos ang paghatol subalit sa loob lamang
ng 15/labing limang araw matapos ang pag pahayag ng desisyon ng korte o hukuman.

Kapag ang aplikasyon ay batay sa nabagong desisyon na nagpataw ng parusang pasok sa probation , ito
ay kailangan I sumite sa hukumang naghatol ng parusa na hindi kwalipikado sa probation, o sa hukuman
na kung saan ang kasong iyon ay napunta.
 PAANO MAG APPLY PARA SA PROBATION
1. Mag sumite ng aplikasyon sa loob ng 15 araw matapos ang pagpahayag ng desisyon ng hukuman o korte.
2. Ang hukuman o korte ay isususpende ang pagpatupad ng hatol at ibibigay/ isasangguni ang apliksyon sa
probation officer para gawin ang PSI/ Post-sentence investigation.
3. Isusumite ng probation officer Ang PSI sa loob ng 60 araw matapos matanggap ang aplikasyon subalit
maaring madagdagan ang bilang ng araw ng pagsumite kapag inaprubhahan ng korte.
4. Matapos maisumite ang PSIR at habang wala pang resolusyon sa aplikasyon, maaring pansamantalang
mapalaya ang aplikante kapag sya ay nakapag bail o kaya ay sa recognizance if di nya kayang mag bail.
