■^ ■ As per the order-dated 29.03.2012 passed .by the Hon’ble Division Bench comprising
(\J^^ o f His Lordship Chief Justice Shri Mohit Sbah and His Lordship Justice Shri Ranjit More,
J.J. passed in W rit Petition No. 5Q4 of 2012, it has been observed by the H on’ble Division
. Bench, after taking info, consideration the Notification dated 14.09.2006 issued by the
Ministry o f Environment and'Forcst, .Government o f India, under the provisions of the
. Envi r onment Protection Act. 1986, read along with Rules 1986 ; the relevant portion of Para
.. 7 o f the order is as u n d e r .

"...... and also having rugard to the fact that large number o f enyironmental

■ Thus, feom the aforesaid order passed by the Hon’ble High Court, it can be said that
H on-b le High Court to s expressed th eir'view s, after taking-into coxtsid«ation th e .
: N qtifichU onand the Acts /.Rules framed therein. As such, the said decisioD o f the H on’ble
H igh Court-which has been expressed and founded, on i ^ o n s and has proceeded on the
consideration o f the issue (viz. MOEF Notification) shall be deemed to have binding effect
o n the concerned authority i.e. S.R.A. till the same is reversed by the Hon’ble Supreme Court

Furth-i. the aforesaid Jodgment passed by the Hop'ble High Court has been passed
after taking into consideration the MOEF Nobf.ca.ion No. SO 1533 dared ld.09,2005 issued

idm easuring 20,000 sq. ratrs. As such, the,said Judgment is a Judgment “per-curim" and
“Ratio-decidendi" as t o same is based on t o facre aetually decided and is an authonty for
th ose facts, -rhe ratio o f the Judgments will be binding on t o SRA unless it is set aside by

from having their applications rece iv ed and processed by the S lu m

R ehabilitation A uthority in respect o f the schem e. Since th e effect o f th e

acceptance of the fu'st application is to exclude from scrutiny all other

applications until the scrutiny o f the first application is Complete, it is th e

boLinden duty o f the applicant to ensure that the application is com plete in

all respects and does not suffer from any deficiency. A ny other

construction would lead to the undesirable result that an ap p lication w hich

is otherw ise deficient and incom plete can progressively be im proved upon

over a prolonged period of time leading to a delay in im plem entation of the

Siuni Rehabiiuation t.-cheme. M oreover, the mere subm ission of an

-ippiication, hovvever deficient, will op erate to block all other applicants.
