LEASE DEED

This Lease made on this 28th day of April 2017 between Mrs. Munni Pandey W/o Mr. Sanjay
Pandey R/o D-31, New Palam Vihar, Phase-1, Gurgaon, Haryana (Hereinafter referred to as THE
LESSOR which term shall include his heirs, executors, administrators, assigns of the one part.)
AND
Mrs. Seema Thakur W/o Mr. Lalit Mohan Thakur R/o Thakur Villa, Dhingra Estate,
Bouleanganj, Shimla, Himachal Pradesh Mo -9911492645 & ( Present add.- Flat no-
211, Cosmos Executive Apartment, Palam Vihar , Cartarpuri Alias Daulatpur
Nasirabad(63), Gurgaon, Haryana-122017 , Aadhaar No- 239687831635 ) (hereinafter called THE
LESSEE which expression shall unless repugnant to the context or meaning thereof include his successors and
assigns) of the other part.

1. WHEREAS the Lessor is the owner of residential H-667 Ansal Palam vihar Gurgaon ,
Haryana,122017(hereinafter) referred as HOUSE PROPERTY.
2. WHEREAS as the Lessor/Owner of the house property has agreed to let out and the lessee have agreed to
take on lease of the Second Floor of the said house property (hereinafter referred to as THE PREMISES)
and more fully described as under.
 One Bedroom, one Bathrooms and one Kitchen.

 NOW THIS DEED WITNESSES AS FOLLOWS :

i) The premises have been let out to the use of the LESSEE as residence to Mrs. Seema Thakur with his
Family for a period of eleven months from 01-05 -2017 to 30-03-2018.
ii) That the Lessee shall pay to the Lessor’s for the demised premises a monthly rent of Rs.9500/-(Rupees
Nine Thousand Five Hundred only) per month from 01-05-2017. Which shall be payable on or before the
15th day of the month in advance of every month of the lease. The Lessee shall make payment of advance
rent as aforesaid by means of a cash to the Lessor Mrs. Munni Pandey And such payments shall be
deemed to be full and valid discharged of the lessee’s rent, together with the fixtures and fittings listed in this
Deed subject to the following conditions.
iii) That the following Lease Agreement is RENEWABLE after 11 months with mutual consent and there will be
increase in Basic Rent of 10% after 11 months.
iv) The lessee shall be liable to pay electricity charges, as per sub meter installed for the premises @
Actual Cost incurred in Rs. per unit during the billing cycle of Electricity Board. The sub meter reading
is……………………. on date …………….……. In the event of default in the regard on the part Lessee, The
Lessor shall be entitled to leave the water and electricity supplies to the premises disconnected.
v) That the Lessee shall not assign, sub let, license or otherwise part with possession of whole or any part of the
demised premises and hand over vacant possession of the leased premises to the lessor without any demur or
objection whatsoever on the expiration of the lease. Any loss or damage to the fixtures and fittings and damage
to the standing structures of the demised premises found on the expiration of the lease shall be made good by
the Lessee directly or by deduction of the cost of replacement/repairs from the Security Deposit.
vi) The Lessee shall not make any additions or alterations in the premises.
vii) That all rules regularly laws and by-laws of municipal corporation or any local authority or authorities having
jurisdiction over the demised premised shall be complied with by the lessee. And the lessee shall not
involve in any commercial activity in the premises.
viii) The Lessee has inspected the premises and is satisfied that:
a) Sanitary, electrical and wooden fittings and fixtures are in good working condition and shall ensure
that they are in the same condition at the time of handing over the premises to the Lessor, normal
wear and tear acceptable.
b) The premises are in good tenantable condition.
ix) The day to day maintenance of the sanitary, electrical and wooden fittings and fixtures shall be the
responsibility of the Lessee.
x) All major repairs of the premises like bursting of pipes, cracking in walls etc. shall be the responsibility of the
Lessor.
xi) The lessee shall be entitled to install air conditioners in the premises provided these are operated in
conformity with local Bye Laws.

xii) If for any reason the Lessee wants to terminate the lease earlier than the agreed Lock in period of Six
months or The lease is terminated by the lessor because of the non compliance of the Lease agreement, by
the lessee, apart from bearing liable to restore vacant and peaceful possession of the premises together with
fittings, fixtures etc., clearing up all outstanding dues such as rent, water and electricity charges shall also,
Lessee be liable to pay the cost of damages including paint and polish caused to the premises
during the tenancy of the lease, normal tear and wear excepted.

xiii) If the lessee commits default of any terms and conditions agreed to hereinabove. The lease shall
determine, entitling the Lessor to re-enter the premises without any objection or resistance from the lessee

1. That the Lessor/Owner thereby covenants that the Lessee paying the monthly rent and other dues
hereby reserved and performing all the covenants here in above contained, may hold and enjoy the premises
during the said terms of the lease without any unlawful interference or interruption from the Lessor.

2. That the Lessor hereby agrees and covenants that the house tax and other taxes shall be paid the
Lessor.That all notices under or in respect of this lease shall be in writing by registered post.

3. In the event the lessee or lessor desired to vacate the premises before the expiry of the aforesaid fixed
period of 11 months both shall have the right to do so, without assigning any reason whatsoever, by giving
one months notice in writing.

4. The lessee would pay the full rentals of the lock-in period of 6 months in case property is vacated on the
request of the Lessee before this period.

5. Montly Leese Rental of 9500/- is inclusive of Water meter and Maintenance Charges and hence Leesee
need not pay the same separately.

6. The Lessee will pay Rs.9500/- (Rupees Nine Thousand Five Hundred Only) the interest free security
deposit amount of Rs.9500 by cheque no.800313 Drawn on OBC BANK will be deposit after 3 month.as per
mutual understanding between Lessor or Lessee. which shall be refunded (subject to clearance of the
mentioned cheque and encashment to Lessee bank account) on the termination of the lease, after deducting
there from any amount payable by Lessee as outstanding dues to the Lessor or any other authorities.
7. If the lessee fails to pay the rent within the stipulated time and commits default in payment of the rent
or commits a breach of an of its obligation or covenants here under or in law or any of them, then the
lease will automatically be deemed to have been cancelled and it shall be incumbent upon the Lessee to
vacant the premises and hand over vacant possession of the same to the Lessor forthwith.

IT IS HEREBY MUTUALLY AGREED AS FOLLOWS:
( i ) That the lessee shall permit the LESSOR, and his agent(s) to enter upon the leased premises for inspection as
well as for carrying out repairs etc. at reasonable time as and when necessary.
( ii ) That the lease term can be renewed if mutually agreed between the LESSEE and LESSOR on the fresh terms
and conditions then mutually agreed to between them for which the LESSEE shall give to the LESSOR a notice not
less than one month before the expiration of the term hereby granted.
( iii) That the Lessee is being allowed to use the said demised premises and no other part of the HOUSE
PROPERTY) for the period specified above only. It is distinctly understood and agreed upon between the two parties
that no tenancy is conferred by this Deed to the Lessee and the relationships of the landlord and the tenant has not
come into existence under this Deed.
(iv) That the Lessee shall not do anything that is detrimental to the interest of the Lessor, The Lessee hereby agrees
that the Lessor shall not be held liable for any theft, loss, damage or destruction of the property of the Lessee nor any
bodily injury to any person occupying the said premises or workmen employed by him from any cause whatsoever
during the period that this Deed is in force.
Penality Charges
In case the Lessee fails without just cause to hand over possession of the said premises to the Lessor upon expiry of
this lease or upon its earlier determination by either of the parties to the lease, the lessee shall be liable to pay penalty
charges @ Rs.1,000/- (Rupees One thousand only) per day on account of use and occupation unless and until the
premises is vacant and handed over to the lessor or lease is mutually renewed.
In witnesses whereof the parties have signed this deed in the presence of the witnesses on the day and year
aforementioned.
