A Growing Sensitivity to HIPAA

When I use the phrase, “Health Insurance
Portability and Accountability Act” or
“HIPAA” a lot of things come to mind. For
some of you the response ranges from groans
and curse words, to legitimate questions you
wish were clearly answered. I have taken several
calls lately asking me to, “bring me up to date
on all the new things with HIPAA…” The
question is loaded with all kinds of follow
up questions but my favorite is, “What has
happened to cause you to call me?” Invariably
the answers include a visit with a information
technology company or staff or taking a
continuing education class both of which made
the office nervous that they were woefully out
of date with current HIPAA standards and
regulations.
The truth is we have not seen significant
changes to the HIPAA regulations in the last
year but there have been tremendous social
cultural changes in our sensitivity to and
breeches to privacy. Let’s look at the debate
going on right now in society about privacy, or
look at how healthcare has a presence on many
social media applications or the recent rash of
ransomware attacks to local municipalities and
hospitals. Cyber attacks are a daily story and
recently over 400 offices utilizing the same
records software were targeted. It’s not that
HIPAA has changed but the environment
in which you as a dentist has changed. As I
have heard from my millennial friends, “There
are a lot of “feels” going on today” especially
related to HIPAA.
This is a great time to do some reminders
and maybe some clarifications related to
HIPAA and your dental office.
Main Parts
There are several parts to what we know
as HIPAA. Since the law was rolled out in
1996, there have been several sections over
the years. CDT code sets, National Provider
Identifiers, Privacy, Security, and Hitech.
Each of them is aimed at the central idea of
increasing the effectiveness, efficiency and
protection of personal health information
and protection of patient rights. Patients have
several rights including: a copy of their health
record, asking for changes in the record, a
list of where or who sees their information,
restricting who sees their information,

confidential communication and the right
to make a complaint. Protected Health
Information or PHI is a list of 18 different
categories of identifiers from social security
number to photographs. Dental offices
understand the reason for awareness and care
of patient health information. The trick with
HIPAA centers on this: We all know patients
have rights and privacy of protected health
information. When a patient enters the office,
patients need to give the office permission
to share that protected information for the
purposes or Treatment, Payment and Normal
Healthcare Operations. To do what the
patient asks of you and to do the best for the
patient and in the most convenient way, you
sometimes interact with other dentists, you file
insurance, you send appointment reminders,
and you store their health record. All of
this can fall under Treatment, Payment and
Normal Healthcare Operations.
Security Review
A majority of the recent inquiries about
HIPAA have been related to the Security
portion of the Act. It makes sense because
ransomware, cyber attacks, and breaches of
personal information are daily headlines.
Security is a moving target as well. Security
standards from 2001 are not the same as 2019.
Target, Sony, Yahoo, Equifax, and yes even
dental offices have had breaches of personal
information in recent years. Security has
three main sections: Technical, Physical and
Administrative. Technical deals with all the
technology including firewalls, updates, mobile
devices, virus protection, passwords, backups
and all of the other information technology
parts of your practice. Physical relates to
the physical building and records security.
Administrative is the policies and procedures,
looking at doing your own audits of where
patient information goes and what threats
and risks are there for breaches. Each of these
three areas are to insure patient information
is only seen, changed and available by the
right people to treat and collect payment in
the daily routine of the practice. As stated
earlier, breaches are the HIPAA term for when
protected health information gets out to the
wrong people. Breaches are not the goal but
the thing you are working hard to avoid. They
come in many forms: from sending the email
to the wrong person, to commenting on patient
information on social media, to leaving a chart
out for another patient to see. Sometimes they
are more malicious on the part of another as in
the case of cyber attacks or malware (malicious
software) and ransomware. Doing a good job
with HIPAA compliance can limit your risks
and vulnerability to these kinds of attacks.
A few tips to help you would include
a good conversation with your information
technology people. Asking about updates,
security of servers, laptops, mobile devices and
WIFI connections is critical. Making sure
you regularly update the newest versions of
software updates and make sure your software
is still supported with these updates. Training
and testing your staff on suspicious emails
and spam that may include trouble is a good
practice. Doing a basic security audit of what
protected health information do you have; how
you gather, route and store that information;
who gets the information; identify threats and
risks and the impact of losing or having some
of that stolen will help when and if a breach
occurs.
If you have had a breach you will need
to respond, report and reassess. If you think
protected health information has been
breached, you should determine what has been
exposed and mitigate any further loss. Have a
plan on how you would handle a breach and
follow it. Reporting should occur to the patient
(s) and if a crime to law enforcement. You will
probably be in touch with others like security
or information technology staff to determine
and mitigate the situation. Determining the
number of patients affected is important
since it also affects who else you report to. If
more than 500 patients are affected, HIPAA
requires you to report no longer than 60 days
to patients, Office of Civil Rights (OCR)
HIPAA division and to the media. If less than
500 patients are affected, you will notify
patients within 60 days and log the breach
on a report to OCR by end of February of
the following year. Any breach should be
addressed immediately to change technology
and procedures to ensure security of the
patient’s information.
I hope your sensitivity to HIPAA is
on but not overactive. There is so much
to this law and this overview will help
you, but if you need more specific help,
I have great resources to recommend

Association Practical Guide to HIPAA
