Vide PUCL Vs UOI 2003 (4) SCC 399 in Para 16, 24-27,
38-45.
In para 44 (page 440) this Hon'ble Court has given a list
of decisions in which the meaning and dimensions of
the phrase, “freedom of speech and expression”, have
been given.
(I) Vide Sakal Papers (P) Ltd Vs UOI 1962 (3) SCR 842 at
page 857, 862, 863 and 868
At page 863
“For, the scheme of Art. 19 is to enumerate different
freedoms separately and then to specify the extent of
restrictions to which they may be subjected and the
objects for securing which this could be done. A
citizen is entitled to enjoy each and every one of the
freedoms together and cl. (1) does not prefer one
freedom to another. That is the plain meaning of this
clause. It follows from this that the State cannot
make a law which directly restricts one freedom even
for securing the better enjoyment of another
freedom. All the greater reason, therefore for holding
that the State cannot directly restrict one freedom by
placing an otherwise permissible restriction on
another freedom”.

“To repeat, the only restrictions which may be
imposed on the rights of an individual under Art.
19(1)(a) are those which cl. (2) of Art. 19 permits and
no other”

“The decision in our view lays down the correct test. The
limitation imposed in the interests of public order to be a
reasonable restriction, should be one which has a
proximate connection or nexus with public order, but not
one far-fetched, hypothetical or problematic or too
remote in the chain of its relation to public order.”

“We shall now test the impugned section, having regard
to the aforesaid principles. Have the acts prohibited
under s. 3 any proximate connection with public safety
or tranquility ? We have already analysed the provisions
of s. 3 of the Act. In an attempt to indicate its wide
sweep, we pointed out that any instigation by word or
visible representation not to pay or defer payment of
any exaction or even contractual dues to Government,
authority or a landowner is made an offence. Even
