VERSUS
1. This is an application filed u/s 108 of the Evidence Act, 1972, by the Petitioner, for declaring
Petitioner’s Husband, Shri Ashok, son of Shri Divanchand as dead and for direction to
the defendant no.2/ North DMC to enter the death of Shri Ashok.
2. In brief, the case of the Petitioner is that the Petitioner was married to Shri Ashok , son of
Shri Divanchand and the her husband namely Sh. Ashok Kumar left for his brother’s
marriage from Agra on 29.06.2002 to H. No. 29/4 West Moti Bagh under Sarai Rohilla
Police Station in Delhi.
3. It is further submitted that Ashok’s mental state was not stable from past few years and
also h did not have any enmity with anyone. He went missing on 20.07.2002 in the
morning when he left the above said premise without informing anyone. Petitioner’s
Husband had a height of 5”2’ and when last seen was wearing a sky blue shirt with green
trouser and black slippers.
4. It is further submitted that when his whereabouts were not known despite efforts, a
complaint vide DD No.57B dated 31.02.2002 was lodged with the Police Station Sarai
Rohilla, New Delhi.
5. It is submitted that the Petitioner Smt. Shanti Chadna and her relatives have made all
efforts and have tried their level best to locate\ trace Sh. Ashok Kumar but all in vain.
Despite best efforts done by the Petitioner and her relatives, the Petitioner has not
heard of her husband since the date of his missing i.e. 20.07.2002. The local police of
Delhi and Agra as well could not trace the person.
6. Therefore the Petitioner is presenting this application to the Honorable’ Court to declare
the person who is missing since 20.07.2002 as presumd to be untraced\ dead and thereby
pass an order accordingly as it may deem fit.
