HAULING CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This HAULING CONTRACT is executed and entered this __ day of November 2019 by
and between:
PJCL ENTERPRISES, a company duly registered and existing under laws of the Philippines with
office address at 4th Estate, Sucat Parañaque City, represented by RICHELLE B. DE LEON,
Project Coordinator, hereinafter referred to as the First Party.

______________________________, a company duly registered and existing under the laws of

the Philippines with office address at _________________________________; represented by
__________________________________, hereinafter referred to as Second Party.

WITHNESSESTH:

WHEREAS, the First Party has secured a contract with particular Company, who has awarded to
operate for reclamation which project is primarily situated in
The same manifest its needs for fleet to _______ units of conditioned Dump Truck
Units to be used for its Hauling Operation has contracted the services of the Second Party.

WHEREAS, the Second Party has expressed its intention to join the First Party in its capacity as
Dump Truck Units Lessor Contractor.

NOW THEREFORE, for in and consideration of the foregoing premises and of the covenants,
terms and conditions set forth below parties have agreed as follows:

DURATIONS AND COMMENCEMENT OF THE CONTRACT

1. Validity of this contract shall start from signing between the First Party and the Second
Party to commence from date of the actual arrival of Dump Truck Units at the Project Site.
It will be effective as Straight Hauling Contract Agreement until the completion of the said
project. The contract shall be for a period of at least 1 year renewable thereafter unless
otherwise terminated hereof that causes of material breach of violation of any terms and
condition stipulated herein.
2. _____ Dump Truck units and its Driver and Helper per unit shall mobilized/transported
to the staging point mutually agreed by both parties where the Hauling Units will be
operating to Work Site.
3. BILLING PERIOD AND PAYMENT TERMS: Billing period shall be every six days a
week cut off every Saturday afternoon.

4. That all payments by First Party to the Second Party shall be drawn in any manner as agreed
upon by both parties in favor/name of the Second Party.

SCOPE OF WORKS, CONDUCT & PRICING AGREED BY BOTH PARTIES

1. Hauling Pick-Up Site to the Dumping Site shall be responsibility of the First Party.

a) Pick-Up location is in SMDC Bloom Residences Sucat Paranaque.

b) Dumping Site Location is in Molino Rd.
c) Truck Rental Shall be 140 per cubic meter month.
d) Within maximum Distance One Way of __ to __ Km.
e) With a minimum distance of 30 to 35 tons per load.
f) Minimum of ___to __ trips per day.
g) Diesel, Fuel and minor truck maintenance shall be supplied by the Second Party.
h) Drivers and Helpers shall be provided by the Second Party.
i) Salaries of the Drivers and Helpers shall be Shouldered by the Second Party.
j) Barracks with Supply of electricity and water shall be shouldered by the First Party.
k) Maintenance of the Dump Truck shall be shouldered by Second Party including
replacement the of Tires.
l) Toll Fee (if any) shall be shouldered by the Second Party.
m) Stickers (if any) shall be provided by the First Party.
Hauling from Pick-Up Site to Dump Site shall abide with all the instructions and operational
procedures being implemented by the Site Management and Site Operators.
1. The Dump Truck Units of the SECOND PARTY shall be put in operation right after
appropriate safety and performance inspection has been completed. In the event of stoppage
due to high risk and other contributing factors beyond control, Force Majeure is affected to
protect the interest of each party.
OTHER RESPONSIBILITY
1. That Both Parties hereby agrees to cooperate in good faith to effect and execute this agreement
and shall continue to be effective unless revoked or terminated for cause or by a subsequent
agreement.
TERMINATION OF CONTRACT
2. In case of government imposition of MORATORIUM of stoppage of Reclamation operation
both parties will terminate the contract subject for amendments depending on the time of
hauling Permit were lifted.
