As per Right to information Act, 2005 Chapter-II clause 4(1)(b) every public authority shall publish
information on 17 items. The information of Maharashtra Council of Homoeopathy as per above act is
as under:

The powers, duties, functions of the Council as per the Bombay Homoeopathic
Practitioners Act 1959 sec. 14 is as under -

1. to provide for registration of practitioners and to maintain the register;

(b) to hear and decide appeals from any decision of the Registrar;

(c) to reprimand a registered practitioner, or to suspend or remove him from the register or to
take such other disciplinary action against him as may, in the opinion of the Council, be
necessary or expedient ;

(d) to hold examinations, to make all the necessary arrangements of such examinations and to
charge fees therefore ;

(e) to 2( * * * ) conduct the courses of training leading to the examinations held by the Council ;

(f) to grant degrees, diplomas and marks of honor ;

(g) to award stipends, scholarships, medals, prizes and other rewards :

(h) to recommend recognition of institutions for the purpose of giving instructions for the
courses leading to the examinations held by the Council, or to recommend the cancellation of
such recognition ;

(j) to prepare, publish and prescribe text books, and to publish statements (of courses of study
prescribed by the Central Council);

(k) to provide for the maintenance of an adequate standard of proficiency for the practice of
Homoeopathic (system of Medicine)

(l) to found and maintain libraries;


(m) to recommend and promote schemes for post-graduate training and research in
Homoeopathy and Biochemistry;

(n) to provide for the inspection of recognized institutions or any other institutions giving
instructions for any or (the recognized medical qualifications ) and to require such institutions to
furnish such information as may be necessary;

(o) to appoint boards of studies and committees consisting of persons, who may or may not be
members of the Council, but at least half of the number of such persons on the board or
committee shall be the practitioners whose names are entered in register, and to make
regulations for the constitution, duties and functions of such boards and committees;

(p) subject to the approval of the State Government to receive donations and to determine the
conditions of acceptance of donations;

(q) to exercise such other powers and perform such other duties and functions as are laid down
in this Act or may be prescribed by rules or by regulations or Bylaws.)

1. The powers & duties of its Officers & employees


The State Govt. officer after consulting the Council appoint a registrar, who is Secretary and
Executive Officer of the Council. The Salary, allowances & other conditions of service of the
Registrar is as prescribed by rules. The Council shall from time to time prescribes by regulations
the number & designation & the salaries, allowances & other condition of service of their
officers
& servants as may be necessary for the purposes of carrying out its duties & functions under
Bombay Homoeopathic Practitioners Act 1959.

The power to make appointment of any officer or servant shall vest in the President.

The Registrar & any other officers or Servant appointed under Bombay Homoeopathic
Practitioners Act 1959 Section 15(7) shall be deemed to be a public servant within the meaning
of section 21 of the Indian Penal Code.
The main duties of the Registrar is as per Bombay Homoeopathic Practitioners Act 1959 section
20, 21 & 26 such as prepare & maintain a register of Homoeopathic Practitioners, To register the
name of the person who possesses any of the recognized medical qualification which is included
in Second & Third Schedule of Homoeopathy Central Council Act 1973 & preparation of list of
registered Practitioners & cause two notices after every five years for renewal of
registration. Take meetings of Council, keep record of Council, & as per sec 14 of said act as
noted above & other duties as per said act. The duties of the employees are as per order of
Registrar & Council which are necessary for the purposes of carrying out duties and functions as
under Bombay homoeopathic Practitioners Act 1959.

1. The procedure followed in the decision making process including channels


of supervision & accountability:-
The procedure followed in the decision is as per Council meeting resolution and as per order of
Registrar.
2. The Norms set by it for the discharges of its functions :-

As per Bombay Homoeopathic Practitioner act 1959 & Homoeopathy Central Council Act 1973
Council decision & in some cases to take approval of Govt.

3. The rules, regulations, instructions, manuals & records held by it or under


its control or used by its employees for discharging it functions :-
As per Bombay Homoeopathic Practitioners Act 1959 & Council resolution
4. A statement of the categories of documents that are held by it or under its control

i) Registration Registers
ii) Provisional Registration register.
iii) Examination record i.e. result sheets & concern letters
iv) Est. record, & Rules etc.
v) All other record which is necessary to kept in office i.e. pay bill, Registers & other in concern
of Accounts of this Council.
vi) Record of Certificate regarding.
vii) Govt. correspondence
viii) Complaints of doctors & their record & appeal record etc.

5. The particulars of any arrangement that exists for consultation with or


representation by, the member of the public in relation to the formulation of its
policy or implementation thereof :-
Registrar of this Council is available for public guidance in office time & to circulate notice or
send letters to colleges or practitioners as per meeting resolution & Bombay Homoeopathic
Practitioners Act 1959.
6. A statement of the Boards, Councils, committees & other bodies consisting of two
or more persons constituted as its part or for the purpose of its advice and as to
whether meetings of those boards, councils, committees & other bodies are open
to the public or the minutes of such meeting are accessible for public :-

The proceeding of every meeting of the Council is treated as confidential & no person
without previous permission of the Council disclose any portion thereof as per
Bombay Homoeopathic Practitioners Act 1959 Section 11.

The income of the Council consist as under :-
1) Fees received from the practitioners as registration fee, renewal fee, All duplicate
certificate fee & Duplicate mark lists fee etc.
This Council does not get any grants from the State Govt.
This Council expenditure is salaries of employees , allowances of members of Council i.e.
Traveling Allowance, D.A. & Court case expenditure & allowances and other expenses which
are necessary for performing the duties & functions under Bombay Homoeopathic Practitioner
Act 1959.

10. The manner of execution of subsidy programme including the amount allocated &
the details of beneficiaries of each programs.

No subsidy, hence information is not related with this Council.

11. Particulars of recipients of concessions , permits or authorizations granted by it :-

Special concessions & permits or authorization is not granted to any one by this Council.

12. Details in respect of the information, available or held by it reduced in an


electronic form.

The Registered practitioners list i.e. Registration No, Name, Address & other information
regarding qualification that are registered in this Council up to 31st Jan 2006 is available in
this Council. This information now will available on website www.mchmumbai.org (C. D.
enclosed)

13. The particulars of facilities available to citizens for obtaining information, including
the working hours of a library or reading room, if maintained for public use -

The office hours :- 9.45 am to 5.30 pm


The Fee hours :- 10.00 am to 3.00 pm

No Library or reading room is available in the Council. This Council provides information,
guidance to practitioners & students or any citizen within office hours i.e. 9.45 am to 5.30
pm.
