The draft of the following order which the District Magistrate, RAMANAGARA District,
RAMANAGARA proposes to make in exercise of the powers conferred by clauses (w), (x), (y) and (z) of
sub–section (1) of section 31 of the Karnataka Police Act, 1963 (Karnataka Act 4 of 1964) is hereby
published as required by sub-section (6) of the said section for the information of the persons likely to be
affected thereby and notice is hereby given that the said draft Order will be taken into consideration on or
after fifteen days from the date of its publication in Official Gazette.
Any objection or suggestion may be received from any person in respect of the said draft order by
the District Magistrate, Ramanagara District before expiry of the period specified above will be considered
by the District Magistrate, Ramanagara District, Objections or suggestions may be addressed to the
District Magistrate, Ramanagara District, Ramanagara.
DRAFT ORDER
1. Title and Commencement,-
(1) This order may be called the Licensing and controlling of places of Public Amusement
Order, RAMANAGARA DISTRICT 2008.
(2) It shall come into force on the date of publication in the official gazette.
2. Definitions: -
In this order unless the context otherwise requires,-
(a) “Act” means the Karnataka Police Act, 1963 (Karnataka Act, 4 of 1964)
(b) ‘Form’ Means form appended to this order.
(c) “Licensing Authority” means in the case of the District, the District Magistrate, Ramanagara
District.
(d) “License” means license issued under clause-4.
(e) ‘Order’ means the licensing and controlling of place of Public Amusement (Ramanagara
District) Order 2008.
(f) “premises” means any tent, erection, building or enclosure to which the public are admitted
to witness any programme for public amusement for a consideration.
(g) ‘section’ means a section of the Act.
3. Application for the grant of license,-
(1) Every application for grant of license to conduct or organize any public amusement shall be
made to the licensing Authority in six sets in Form-1.
Provided that no such license shall be necessary to conduct Yakshagana or Bayalata (Field
Dramma) Folk Arts and magic show for a period not exceeding two days.
(2) Every application under sub-clause (1), shall be accompanied by a treasury challan for
having paid the following fees namely,-
a) In the case of a permanent place of public amusement having capacity of:-
I. Upto 200 seats Rs. 1, 50,000
II. From 201 to 500 Rs. 2, 00,000
III. Above 500 seats Rs. 3, 00,000
b) In the case of a semi permanent place of public amusement having capacity of:-
I. Upto 200 seats Rs.50,000
II. From 201 to 500 Rs.75,000
III. Above 500 seats Rs.1,00,000
c) In the case of a temporary place of Public Amusement having capacity of:-
I. Upto 200 seats Rs. 10,000
II. From 201 to 500 Rs.15,000
III. Above 500 seats Rs.20,000

d) in any other place, where the public amusements are conducted, if the admission to such
place on payment of money, the following fee shall be payable, namely,-
I..Where no certificate is required from any authority specified
in sub- clause(1) of clause-4 ……Rs. 7,500
II. Where certificate is required from any authority specified
in sub-clause (1) of clause-4 … Rs.15,000
4. Grant of refusal of License,-
(1) On receipt of the application under clause 3, the licensing Authority, may if it is satisfied that
application is in order, forward the copies of such application to the authorities specified below having
jurisdiction over the area where public amusement is proposed to be conducted for their reports or
certificates, as the case may be namely,-
(a) The Superintendent of Police (in case of Districts)
(b) The Executive Engineer, Public Works Department
(c) The Health Officer,
(d) The Officer of the Chief Electrical Inspectorate;
(e) The Fire Officer,
(f) Any other authority as may be specified by the state Government from time to time.
(2) The authorities specified above shall, after satisfying themselves send their reports or certificate to the
licensing authority with in three week from the date of receipt of application under sub-clause(1) namely,-
(a) That the conduct of public amusements will not endanger public safety;
(b) That the premises and electrical installations are adequate and sound for the conduct
of public amusements.
(c) That adequate provisions are made for sanitation, ventilation and light;
(d) That necessary precautions have been observed and provision is made to install fire
fighting equipments.
(e) That the provisions of this order have been complied with; and
(f) That there is no objection for grant of license.
(3) If the officer specified under sub-clause(1) do not furnish their reports or certificates within the time
specified under sub-clause (2) the licensing authority may dispose of the application for grant of license
on its merits.
(4) The licensing authority may for the purpose of granting license, if necessary, hold inspection of the site
or premises or may depute any officer of and above rank of Thashildar serving under it to inspect such
premises, the licensing authority or the officer so deputed may, if need be, invite any of the authorities
specified under sub-clause(1) or their authorized representative to be present for such inspection.
(5) The Licensing authority may before deciding whether to grant or refuse license record the statement of
the applicant or authorize any of its subordinate officers not below the rank of Thashildar, to record the
statement of the applicant to afford him an opportunity to explain his case.
(a) the interest of the public in general; and
(b) The status and antecedents of the applicant.
(6) The licensing authority shall in deciding whether to grant or refuse license for conducting public
amusement shall have regard to the following matter namely,-
a) The Parking place available for parking vehicles of visitors to amusement center.
b) Law and order problems in the locality.
c) Vicinity of educational institutions near the amusement premises.
d) Vicinity of religious institutions.
e) That it is not located in the residential locality.
f) Precautionary measures taken against wild animals, employed for conducting
amusements.
g) That the amusement does not in any way effect the religious feelings of any section
of the society.
h) That the materials used for the structure do not pose any threat of fire hazard.

i) That the proposed amusement does not promote public gambling or the premises
shall not be used for gambling house.
(7) The licensing authority shall not grant a license under this order unless it is satisfied,-
a) That the provisions of this order have been substantially complied with;
b) That the premises proposed does not cause obstruction, inconvenience, annoyance,
risk danger or damage to be residents or passers of such premises, and
c) That all adequate precautions have been taken in the premises, in respect of which
the license is to be granted to provide for the safety, convenience and comfort of the
persons attending the programme therein.
(8) Subject to the provision of this order, the licensing authority may grant a license to the applicant in
Form-2 on such terms and condition for such period specified there in and subject to such restrictions as it
may determine. Where the licensing Authority refuse to grant a license, it shall do so and such order shall
be communicated to the applicant giving reasons in writing for such refusal within one month from the
date of receipt of the reports under sub-clause(2).
(9) If the licensing Authority does not dispose of the application within the time specified under sub-
clause(8) the license shall be deemed to have been granted to the applicant.
(10) Every license granted under this order shall be personal to the Applicant to whom it is granted and no
transfer or assignment thereof, whether absolute or by way of security or otherwise, shall be valid.
(11) A license granted under this order shall be valid for the period specified in the license which shall not
exceed twelve months(one year)
5. Fee for issue of Duplicate License ,-
The Fee for grant of duplicate license shall be Rs.1000/-only.
6. Seating arrangement:
(1) The License shall not accommodate more than 20 persons per nine, square meters in the
place of public amusement.
(2) The entrance, passage, corridor, gangway and stage shall be deducted for the purpose of
calculating the seating accommodation under sub- clause(1)
(3) The distance between the stage and the first row of seats shall be 10 feet.
(4) There shall be a passage of 0.90 meter in width for every ten rows of seats.
(5) The gangway shall not be less than 0.90 meter in width and shall be so arranged that no
seats shall be more that 10 feet away from gangway.
(6) There shall be an intervening space of at least 0.35 meter between the back of one seat and
the front of the seat immediately behind measured between perpendicular.
(7) There shall be two doorways fitted with doors to open out wards.
(8) There shall be opening sufficiently wide enough to ensure good ventilation.
(9) There shall be an open space of not less than ten feet in width on any two sides of the
premises and sufficient open space for parking of vehicles.
(10) One portable fire extinguisher of CO2 or CTO or DPO type of one kilogram capacity and one
bucket on nine liters filled with sand shall be provided.
(11) Drinking water shall be provided in such a manner and in such quantities as may be
specified by the licensing authority,-
(12) One W.C. and one urinal for every fifty persons and less for exclusive use of each sex shall
be provided.
7. Electrical Installation:
(1) The cables or wire used shall be of ISI grade and the wiring shall pass through conduit pipes only.
(2) There shall be a separate circuit controlled by suitable linked switch for the supply of electricity.
8. Inspection:
(1) The licensing authority or any officer not below the rank of Thasildar having jurisdiction over the area
deputed by the licensing authority may hold periodical inspection once in a month or as often as deemed
necessary of the licensed place or public amusement to ensure that the license has complied with the
provisions or the Terms and Conditions of License and this order.

(2) If on such inspection, the licensing authority as reason to believe that the licensee has not complied
with terms and conditions of the license., it shall issue a notice to the license to comply with the terms and
conditions of the license, and on failure to comply with such direction within the time stipulated, the
licensing authority shall cancel the license granted under this order.
(3) Also on such inspection if the licensing authority if is of the opinion that additional regulations condition
or direction to provide extra facilities, this could be indicated to the applicant in writing, he has to comply
with such directions within 15 days of receipt of such notice or seek reasonable time within 15 days.

CONDITIONS OF LICENCE:
This License is granted subject to the provisions of the Licensing and controlling of places of
public Amusement (Ramanagaram District) Order, 2008 and terms and conditions specified below.
1. The Licensee shall not permit any obscene or objectionable posters or pictorial publicity
material to be displayed in the licensed place of public amusement.
2. The Licensee shall not organize or perform shows of public amusement which are absence
in character.
3. The Licensee shall set tickets for admission to any show of public amusement within the
licensed place of public amusement by providing suitable booths for the purpose.
4. The licensee shall not admit into the Licensed place of public Amusement in excess of the
number specified in the License.
5. The License shall not conduct any show of public amusement before 10 A.M to after 11 P.M
6. The license shall not permit smoking or consumption of liquor in the Licensed place of public
amusement.
7. The Licensee shall comply with the all directions by the Licensing authorities from time to
time.
8. The licensee shall not accommodate more than 20 persons per nine square meters in the
places of public amusement.
