Actus reus v.

mens rea

-AR: “guilty act” / physical action offender performs leading to the commission of crim (or its
omission) ex: poisoning of victim with aspirin

-MR: “guilty mind” / “intent” / what the offender is thinking or feeling that led to the commission of
the crime; ex: to kill the victim

Stockholm syndrome - feelings of trust or affection felt in many cases of kidnapping or


hostage-taking by a victim toward a captor.; quite common with assistants w/ demanding
bosses (how to get away w/ murder)

HTGAWM:
Step 1: discredit the witnesses
Step 2: Introduce a new suspect
Step 3: Bury the evidence
---throw so much info at the jury that they walk into the deliberation room w/ one
overwhelming feeling … doubt

Directed verdict – faster verdict when prosecution’s evidence is insufficient; but dangerous to appeal
since if denied, the public will think that sufficient evidence is present (incriminating the defense)

Fire/burning the body –way of destroying the DNA thus altering the evidence
