SECTION 1. TITLE
PENALTIES
This ordinance shall be known as “PROPER CLOTHING
ORDINANCE OF THE CITY OF DASMARIÑAS.”
SECTION 2. SCOPE
This ordinance covers all public places and/or
establishments in the City of Dasmariñas. This includes
every individual residing or non-residing to the premises
and/or boundaries of the City.
SECTION 3. DEFINITION OF TERMS
As used in this Ordinance, the following terms are hereby
defined as:
1. Nudity or Nude – an act of not wearing clothes
and/or showing other parts of the body such as breasts,
back, thighs or 3 inches above the knee, female or male
genital organ.
2. Disturbance – an act of annoyance
3. Public places – places that are under the jurisdiction
of the city of Dasmariñas including the villages,
educational institutions, health institutions, establishments
such as malls, small businesses, and the like that every
person is allowed to be.
4. Revealing Clothes – these are clothes that show other
parts of the body such as cleavage, thighs, butt, back,
belly button and the like.
5. Anyone – a person who is complained to commit
nudity and/or disturbance with no age or gender
exemptions.
6. Sexual Harassment – an act of harassing a person
through:
• Thinking with malicious desires
• Touching without permission
• Verbally stating malicious words
7. Proper Clothes/Clothing – these are presentable
clothes or garments that a person must wear when in
public, such as:
• V-neck or Round-neck T-shirts
• Pants/Skirts that is above the knees
• Blouses that are not spaghetti straps
• Blouses that are not plunging necklines
SECTION 4. ACTS OF NUDITY
1. Acts of nudity is committed by anyone who go outside
their houses or their property without clothes, topless,
wearing only a top without lower garments and revealing
clothes
2. Acts of nudity is committed by anyone who go outside
their houses verbally stating malicious words or lewd words
to someone wearing presentable clothes.
3. Acts of nudity is committed when a form of sexual
harassment have been done such as:
• Touching parts of the body without the consent of that
person
• Anyone who done “cat-calling” whistle
• Anyone who look to the body of other person that is
malicious
4. Acts of nudity is committed when anyone showing private
parts of the body and/or doing malicious acts in public.
SECTION 5. ACTS OF DISTURBANCE
1. Acts of disturbance is committed when a person felt
disturbed of anyone showing his/her body parts.
2. Acts of disturbance is committed when a person felt
disturbed of anyone wearing revealing clothes or being
sexually harass.
3. Acts of disturbance is committed when anyone is wearing
improper clothing to a public place of the city.
SECTION 6. LIABILITIES OF OWNERS
As per stated in the R.A 7877 of Anti-Sexual Harassment
Act of 1995 where The employer or head of office,
educational or training institution shall be solidly liable for
damages arising from the acts of sexual harassment
committed in the employment, education or training
environment if the employer or head of office, educational
or training institution is informed of such acts by the
offended party and no immediate action is taken.
SECTION 8. PROHIBITED ACTS
Consistent with Section 5 hereof, the proper clothing
ordinance shall prohibit:
1. Acts of nudity and disturbance through wearing of
revealing clothes such as:
• Plunging necklines
• Spaghetti strap blouses
• Skirts 3 inches above the knee
• Shorts 3 inches above the knee
• Undergarments (boxer shorts, underwear, “sando”, etc.)
2. Acts of nudity and disturbance through not wearing
anything, wearing only upper garments or lower garments.
3. Acts of nudity and disturbance through sexually
harassing a person by:
• Verbally stating malicious or lewd words
• Touching a person to his/her body parts that he/she feel
disturbed or obscene without his/her permission
• Showing an act of indecent actions
• Anyone who done “cat-calling” whistle
SECTION 9. IMPLEMENTATION OF PROPER CLOTHING POLICIES
All public places within the jurisdiction of the City of
Dasmariñas, through their administrators, management,
heads, directors, etc. shall:
1. Have at least one (1) group patrol to monitor the
actions of the people near or in the place they own;
2. Have an exhibition of the proper clothing a person must
wear;
3. Have a nearest officer to catch those who will disobey
this ordinance;
4. Educate its people of what are they rights as per
stated in this ordinance.
SECTION 10.
Anyone who is found in violation of the provisions of this
ordinance shall be fined as follows:
(a) FIRST OFFENSE. A fine of One Thousand Pesos
(PhP1,000.00), or imprisonment of not more than One (1)
Month, or both, at the discretion of the court.
(b) SECOND OFFENSE. A fine of Three Thousand Pesos
(PhP3,000.00), or imprisonment of not more than Two (2)
Months but not less than One (1) Month, or both, at the
discretion of the court.
(c) THIRD OFFENSE. A fine of Five Thousand Pesos
(PhP5,000.00), or imprisonment of not more than Three (3)
Months but not less than Two (2) Months, or both, at the
discretion of the court.
SECTION 11. REPEALING CLAUSE
Any ordinance in conflict with any provision contained
herein shall be deemed repealed or modified
accordingly.
SECTION 12. SEPARABILITY CLAUSE
Should any provision of this ordinance be declared
unconstitutional or invalid, the provisions not so declared
shall continue to be in full force and effect.
SECTION 13. EFFECTIVITY CLAUSE
This ordinance shall take effect after fifteen (15) days
following its publication in the public places upon the
jurisdiction of the City of Dasmariñas.
