WHEREAS, per Section 11 of the 1987 Constitution of the Republic of the Philippines,
it is hereby declared that the state shall value the dignity of children and guarantee full respect for
their rights;

WHEREAS, public shows, pageants, and contests are common platforms for advocacies
on the environment, human rights, health, peace, equality, and social justice.

WHEREAS, public shows, pageants, and contests can only achieve its full effectivity as
advocacy platforms if its participants’ well-being is ensured.

WHEREAS, there is a need to regulate the participation of children participating in


pageants as such have become a popular means of entertainment in Filipino culture.

WHEREAS, the effects that are commonly associated with public shows, pageants, and
contests which include sleep deprivation, social pressure, and physical and emotional stress can
greatly impact a child’s development.

RESOLVED, AS IT IS HEREBY RESOLVED, to enact the following ordinance:

AN ORDINANCE REGULATING THE PARTICIPATION OF CHILDREN IN


PUBLIC SHOWS, PAGEANTS, CONTESTS, PERFORMANCES, AND
ENTERTAINMENT IN THE CITY OF DUMAGUETE

Be it ordained by the Sangguniang Panlungsod of the City of Dumaguete, that:

SECTION 1. Title – This ordinance shall be known as the “CHILDREN IN


PUBLIC SHOWS ORDINANCE”

SECTION 2. Definition of Terms – For purposes of this Ordinance, the following


terms are defined as follows:

a) Activity/Event – refers to public shows, pageants, contests, performances,


entertainment and the like
b) Child- any person below 18 years of age or those over 18 years old but are unable to
fully take care or protect themselves from abuse, neglect, cruelty, exploitation or
discrimination because of their physical or mental disability or condition
c) Event Organizer - a person who organizes, schedules and plans the event. They are
responsible for an event from start to finish.
d) Handler – a contest candidate or performer’s assistant whose tasks include but are
not limited to managing, dressing, training, and doing makeup.

SECTION 3. Prohibited Acts.

a) It shall be unlawful for any individual to engage in the conduct of sponsoring and/or
hosting indecent activities involving children.
b) It shall be unlawful for any business establishment operating in the City of Dumaguete to
allow, tolerate and consent in the conduct the hosting of indecent activities within the
premises and outside of their establishment.
c) It shall be unlawful for indecent activities in the guise of pageants which tend to
commodify, abuse, humiliate and treat children as sex objects be held in school,
communities and barangays in the city.
d) It shall be unlawful for event organizers to schedule activities involving children between
9:30 p.m. to 6:00 a.m.
e) It shall be unlawful for event organizers, handlers and parents/guardians:
a. To allow a child to wear clothes that expose the bikini area, buttocks, and front
and back torso;
b. To allow a child to sing, dance or perform acts with explicit or sensual content;
c. To coerce a child to perform dangerous stunts;
d. To allow a child to become a center of ridicule for adult’s humor;
e. To force special diets onto a child for drastic weight loss or gain without the advice
of a medical professional;
f. To force a child to undergo physically slimming or compressing procedures which
include but are not limited to waist training: a process involving the use of a corset,
girdle, tape or any restricting material to shape or slim the waist to an extreme
extent for aesthetic reasons;
g. To force a child to undergo aesthetic or cosmetic procedures;
h. To allow a child to rehearse within a day for more than 2 consecutive hours and/or
4 non-consecutive hours; and
i. To coerce a child into rehearsing anytime between 9:30pm to 6:00am.

SECTION 4. – Penalties. Any person who violates any of the prohibited acts stated
above shall be punished through the imposition of the following penalties:

First Violation : P1,000.00


Second Violation : P3,000.00
Third Violation : P5,000.00 fine and/or imprisonment of not more
than six (6) months upon the discretion of the
court

SECTION 5. Implementing Rules and Regulations. Within sixty (60) days from the
approval of this Ordinance, the necessary rules and regulations shall be issued by the Mayor for the
proper and effective implementation of this Ordinance.

SECTION 6. – Separability Clause. If any part of this Ordinance is declared as


unconstitutional or unlawful, such declaration shall not affect the other parts or sections hereof
that are not declared unlawful or unconstitutional.

SECTION 7. – Repealing Clause. All previous ordinances inconsistent with this


Ordinance shall be deemed repealed or modified accordingly.

SECTION 8. – Effectivity. After this Ordinance is approved, it shall take effect fifteen
(15) days from the promulgation of its implementing rules and regulations.
