Notice

Notice is hereby given that Borough Council of the Borough of Chambersburg, Franklin County,
Pennsylvania, intends to consider for adoption and to vote upon an enactment of an Ordinance,
summarized below, at the Chambersburg Borough Council Meeting on December 9, 2019 at 7
p.m. at the Borough Offices, 100 South 2nd Street, Chambersburg, Pennsylvania 17201.
The title of the proposed Ordinance is “AN ORDINANCE OF THE BOROUGH OF
CHAMBERSBURG, FRANKLIN COUNTY, AMENDING CHAPTER 254 OF THE CODE
OF THE BOROUGH OF CHAMBERSBURG, ENTITLED ‘STREETS AND
SIDEWALKS’”.
If enacted, the Ordinance will require that all curbs and sidewalks in the Borough be installed,
maintained, and repaired in accordance with the Borough’s Sidewalk and Curb Installation Policy
and the Borough’s Sidewalk Installation Plans/Maps.
The contents of the Ordinance are summarized as follows:
SECTION I: Curbs and sidewalks shall be constructed, reconstructed, and repaired in
accordance with the Sidewalk Installation Plans/Maps and the Sidewalk and
Curb Installation Policy. Appeals may be made to the Curb and Sidewalk
Compliance Committee, comprised of three members of Town Council.
Where applicable, determinations of the Board will act as amendments to
the Sidewalk Installation Plans/Maps.
SECTION II: All vegetation shall be trimmed so that it does not encroach upon or
overhang the sidewalk at a height of less than eight (8) feet.
SECTION III: Borough has the right to make emergency repairs to curbs and sidewalks if
deemed necessary by the Borough Engineer and if repair is not estimated to
exceed $1000.00. Borough shall provide at least 48-hour notice prior to
making emergency repairs.
SECTION IV: Borough Engineer is authorized to issue stop orders. The filing of an appeal
will not stay a stop order.
SECTION V: Savings Clause. The Code of the Borough of Chambersburg remains
otherwise intact.
SECTION VI: Severability. If any portion of the Ordinance is deemed void, it shall be
severable.
SECTION VII: Repealer. All previous contrary provisions are repealed.
SECTION VIII: Effective Date. If enacted, the Ordinance will take effect immediately.
The full text of the proposed Ordinance may be examined without charge at the Office of the
Chambersburg Borough Manager, 100 South 2nd Street, Chambersburg, Pennsylvania 17201,
during regular business hours, which are Monday through Friday, 8 a.m. to 5 p.m. A copy will be
provided upon request without charge. A copy of the proposed Ordinance has also been filed at
the Franklin County Law Library, 100 Lincoln Way East, Suite E, Chambersburg, Pennsylvania
17201 and is available for inspection during normal business hours.
