Subject: NOTICE TO EXPLAIN

Dear Mr. Reyes,

Please submit your written explanation to the Human


Resource Department Office being charged against you described or
narrated below within FIVE (5) DAYS from the date that this Notice
was served upon you.

Also, please attend the conference to be held on December 28,


2019 at 10:00 am at the company’s conference room as this will give
you additional opportunity to verbally explain your side.

In the event that you are found guilty of the said charge(s),
the company may terminate you from employment and/or impose
other appropriate penalties.

Kindly give this matter your priority attention.

DISCIPLINARY MATTER(S):

What was/were the offense(s) committed:

 According to Article 282 of the Labor Code, an employer can


terminate an employee for just causes, which could be any of the
following:

(a) Serious misconduct or wilful disobedience by the employee of the of


the lawful orders of his employer or representative in connection with
his work;

(b) Gross and habitual neglect by the employee of his duties;

(c) Fraud or wilful breach by the employee of the trust reposed in him by
his employer or duly authorized representative;

(d) Commission of a crime or offense by the employee against the person of


his employer or any immediate member of his family or his duly
authorized representative; and

(e) Other analogous to the foregoing

Employee, Donato Reyes committed the offense of (a) Serious


misconduct or wilful disobedience by the employee of the of the lawful
orders of his employer or representative in connection with his work
when he violated the terms of the contract entered into with (intl company
name) which states that said project must be done with their own hardware
and software and Innovative, Inc. and must not utilize other programs in
this project.

 Also, Donato Reyes, for the same reason stated above, violated one
of the rules and regulations imposed by the company that says If
employees do not meet the company’s expectations of performance
or conduct, necessary corrective action may be taken (No. 14 of the
Company Personnel Policies)

How was/were the offense(s) committed:

Nearing the deadline, Donato Reyes was not able to produce the
technical details of the project and decided to use his old software and
hardware he is accustomed to and produced an equivalent product. Hence,
violating the conditions of the said contract.
