Ms. Geraldine D. Gomez of 3 E.R.G. Builder with business address at Block 5, Lot 4, Brgy. San
Gabriel, Gen. Mariano Alvarez, Cavite, came to my office and referred to me for possible legal
action your breach of the Construction Agreement you entered into with 3 E.R.G. Builder on
July 22, 2019, acknowledged before Notary Public Atty. Caesar Anthony Solis on September 17,
2019 bearing Doc. No. 440, Page No. 88, Book No. 7, Series of 2019 and recorded in his
Notarial Register.

Based on the testimony of Ms. Gomez, she has paid you the amount of Eight Hundred
Thousand Pesos (P800,000.00) Philippine Currency in August 2019, the amount of One Million
Five Hundred Thousand Pesos (P1,500,000.00) Philippine Currency on September 25, 2019 with
additional amount of One Hundred Fifty Thousand Pesos (P150,000.00) Philippine Currency,
and in October, 2019 she paid you the amount of Seven Hundred Thousand Pesos
(P700,000.00) Philippine Currency in the total amount of Three Million One Hundred Fifty
Thousand Pesos (P3,150,000.00) Philippine Currency, with your commitment to perform
dutifully the provisions of your Construction Agreement.

However, you failed to comply with your agreement, the reason why Ms. Gomez sent you a
letter on October 22, 2019, giving you notice that 3E.R.G. Builder has rescinded your contract
based on provision No. 32 of the said Construction Contract.

In view thereof, you are hereby instructed not to interfere with the on-going project which has
been sub-contracted to you, otherwise, we will be constrained to file any appropriate legal
action, civil and criminal, to protect and enforce the rights of the Contractor.

Any further violation that you will commit relative to your contract on the on-going project at
Jetti Alijis, Mandalagan Libertad, Bacolod City will subject you to damages in addition to the
civil and criminal action that may be filed against you.

May you heed this letter to prevent any untoward consequence.
