Leave &licesene Agrement
(SHOP PREMISES)
This Leave & License Agreement is made and entered into at Navi Mumbai on
this 16th day of September, 2014, BETWEEN Mrs. SMITA BAPU
KATAKDOUND, aged about 45 years, Indian Inhabitant, residing at Flat
No. 801, 18th Road, Ranwal Grandeur Chembur, Mumbai–400071,
hereinafter called and referred to as the “THE OWNER/LICENSOR” [which
expression shall mean and include her executors, administrators and
assigns) of the ONE PART.
AND
Mr. AKHTAR AKBAR SAYEED, aged about 37 years, Indian Inhabitant,
residing at

___, hereinafter called and referred to as the “THE LICENSE” [which
expression shall mean and include his executors, administrators and
assigns) of the SECOND PART.
WHEREAS :
The LICENSOR is absolutely seized and possessed of or otherwise well and
sufficiently entitled to the Shop No. F–32, “Haware’s Centurion”, Plot No. 88
to 91, Sector–19A, Nerul, Navi Mumbai–400706, Tal. & Dist. Thane,
[hereinafter referred to as “the said Shop/Premises”].
And all documents pertaining to the said premises stands in the name of
Licensor and whereas the Licensee has approached the Licensor with a request
to allow their to use and occupy the said premises for the purpose of doing
business for period of 36 months, commencing from 01/09/2014 and ending
on 31/08/2017 on Leave and Licence basis.
AND WHEREAS :
Both the parties now wish to put on record the terms and conditions of this
Agreement in writing which appear thereinafter:-
1. The Licensee shall pay to the Licensors monthly compensation for every
month in advance on or before 10th of each English Calendar month and
in consideration of the License and permission to use the said premises
hereby granted to the LICENSEES as per the table given below : -

2. For the due performance, the Licensee the agreed to refundable security
deposit with the owner a sum of Rs. 1,50,000/- (Rupees One Lakh
Fifty Thousand Only) as and by way of refundable security deposit, the
receipt of which the owner have admits and acknowledge, and
undertakes to refund the same and to the Licensee at the time of the
termination of this Agreement without any delay.
4. The Licensee shall not part with the possession of the said premises to
any third person and/or not to store any hazardous goods in the said
premises during the period of this Agreement.
5. The Licensee shall pay the Electricity Bill. Water Charges, Telephone
Charges of the said premises as per Bill without any delay to the
concerned authorities regularly and punctually.
6. The LICENSEE shall not be entitled to give the benefit thereof to any
other person by Transfer, Assignment Mortgage, sub–lease or by any
other right or interest.
8. The Licensee shall decorate the shop and furnish the Shop as his part of
business, on his own expenses and risks.
10. It is hereby agreed between the parties that desire to terminate this
Agreement before the expiry period of 36 months either party shall be at
liberty to do so by giving one month written notice to that effect.

11. On the expiry of this Agreement the Licensee shall vacate the said
premises and that he shall handover the vacant and peaceful possession
of the said premises and removing his own belonging against the refund
the Security deposit as mentioned above first.
RECEIVED a sum of Rs. 1,50,000/- (Rupees One Lakh Fifty Thousand Only)
from the said “LICENSEE” as a refundable Security Deposit, in respect of
using the said Shop/Premises.
