1.0 DONG JI (M) SDN BHD (PENTENS) warrants to the Customer that the PENTENS- own
manufactured Product(s) listed above and supplied by it, meets at the time of delivery the
technical properties according to the relevant Product Data Sheet(s) attached.

2.0 Should any defect in the said own manufactured Product for which PENTENS is responsible for
manifest itself during the Warranty Period, PENTENS shall deliver free of charge defect-free
PENTENS- own manufactured Product(s) to replace the said existing Product, provided written
notice of such defect has first been given by the Customer and received by PENTENS. This
remedy under the Warranty shall be the sole remedy that the Customer is entitled for such
defects, and shall be to the exclusion of all other remedies at law or otherwise.

3.0 This Warranty is conditional upon the following:

3.1 PENTENS has been paid in full for the PENTENS-Product(s) delivered for the Project;

3.2 The defective PENTENS-Product(s) has been used for the Application as defined above;

3.3 The defects or damages are not the result of any of the following:

a) Poor or negligent housekeeping and maintenance; or

b) Non-compliance
c) with guidelines regarding storage and application of the PENTENS- own manufactured
Product(s) including but not limited to usage within the shelf line; or
d) Any alterations of additions or repairs to the PENTENS- own manufactured Product(s) by
others; or
e) Quality of substrate to which PENTENS- own manufactured Product(s) is applied not meeting
the requirements as set forth by PENTENS, including but not limited to disintegration of the
substrates; or
f) Faulty design or quality of the construction in which PENTENS- own manufactured Product(s)
are used; or
g) External effects, such as by third (including but not limited to damage and / or destruction) or
acts of nature such as earthquakes, lightning, hurricanes, floods, fire, etc. or any
uncontrollable and / or unforeseen settlement or movement of material or constant contact of
the PENTENS- own manufactured Product(s) with incompatible substances; or
h) Wear and tear, including any purely esthetical changes in the PENTENS- own manufactured
Product(s)
i) Incorrect application by a third party applicator, whether or not in the presence of PENTENS
personnel.

3.4 PENTENS has been informed immediately in writing about imminent damages or defects which
may have been caused by defective PENTENS- own manufactured Product(s) and has had the
opportunity to inspect them. The report to PENTENS includes:

a) Type of failure of the PENTENS- own manufactured Product(s);

b) Batch number or number of the PENTENS- own manufactured Product(s));
c) Location(s) of defective PENTENS- own manufactured Product(s).

3.5 No repair measures have been taken without PENTENS’s prior approval; and

3.6 All reasonable measures to limit existing damage or prevent imminent damage have been taken.

4.0 This Warranty shall apply only to PENTENS- own manufactured Product(s) applied for and/or
related to the Project.

5.0 Subject to Section 2.0, the Warranty provided herein shall be in the form of Bank Guarantee and
the claimable amount or remedy of the Warrant is restricted and limited to a five per centum (5%)
of the said Bank Guarantee.

6.0 Except as expressly provided herein, PENTENS shall not be liable to the Customer in connection
with the PENTENS- own manufactured Product(s) for the project, for any loss income, loss of
actual or anticipated profits, loss of business, loss of contracts, loss of goodwill or reputation, loss
of business, loss of anticipated savings or indirect or consequential loss or damage of any kind, in
each case howsoever arising, whether such loss is foreseeable or in the contemplation of the
parties and whether arising in or caused by breach of contract, tort (including negligence), breach
of statutory duty or otherwise.

7.0 There are no conditions, warranties, representations or terms, express or implied as to the
PENTENS- own manufactured Product(s), that are binding on the parties except as specifically
stated in this Warranty; any condition, Warranty representation or other terms which might
otherwise be implied into or incorporated in this Warranty or any contract, whether by statute,
common law or otherwise, is hereby expressly excluded.

8.0 This guarantee cannot be enforced or become operative unless and all payment have been paid
and settled in full.

9.0 This Warranty is governed by the material laws of Malaysia and the parties submit to this
exclusive jurisdiction of the Malaysian courts to resolve any disputes arising out of or in
connection with this Warranty.
