JUDICIAL COUNTER-AFFIDAVIT OF MARILYN RICABLANCA

This Judicial Affidavit of MARILYN RICABLANCA is executed to serve as

her direct testimony in the instant case. This is offered to disprove: 1) all
the allegations in the complainant's Judicial Affidavit; 2) including all the
Annexes appended thereto and 3) all matters related thereto, with
reservation to present exhibits in the course of the proceedings hereof.

Questions were propounded by ATTY. JOSELITO TROY G. SUELLO at

his Office at 10 Lim Building D. Jakosalem St., Cebu City, Philippines, in
English and Bisayan which Accused can understand, while ANSWERS
were given by the Accused in English and Bisayan.

1. Do you swear to tell the truth and nothing but the truth?
Answer: Yes.

2. Are you aware that you will be criminally liable for perjury of false
testimony if you will not tell the truth?
Answer: Yes.

3. Please state your name, age, residence address and occupation.

Answer: My name is MARILYN RICABLANCA, of legal age, a resident of
Sitio You, Bgy. Sambag, Cebu City;

4. Do you know EVELYN RODRIGUEZ BUZZARD? If so, why?

Answer: Yes, I know EVELYN RODRIGUEZ BUZZARD very well
because she is the mother of my live-in partner, AMOR DAITIC and I
even also address her “Mother” and treat her like my own mother;

5. EVELYN RODRIGUEZ BUZZARD filed a criminal case against you for

Alleged Serious Physical Injuries, what can you say to this?
Answer: The charge is utterly false and has no basis in truth and in fact.

6. Why do you say the said charge against you is utterly false and has no
basis in truth and in fact?
Answer: Because the truth is that I confronted her about the humiliating
gossip she spread about me of being a prostitute but suddenly and
without any warning she slapped my face. So I instinctively pushed her
to defend myself from further attack. In the process, she fell but she was
immediately helped up by AMOR DAITIC.

7. What happened next?

Answer: I was helped to hide inside the house and she threatened to kill
me and slice me into little pieces.

8. Complainant alleged that she suffered Serious Physical Injuries, what

can you say to this?
Answer: Again she is utterly lying. Granting if at all she was injured, it
was a direct result of her sudden aggression against me forcing me to
defend myself, which is my lawful right. Her medical certificate did not
indicate the number of days if any required for her treatment. The sling
she wore on her arm as shown in her attached photo is purely for optics
purposes only because early in the morning the very next day AMOR
DAITIK and I saw her gathering several buckets water without any sling
at all and not once have we seen her wearing that sling.

9. Aside from your own denial of the instant charge, do you have any
witness to attest to the truth of your statements?
Answer: Yes, no less than the complainant’s own daughter AMOR
DAITIC can attest to the truth of my herein statements as evidenced by
her Judicial Affidavit attached herein as Annex A because she was there
beside me during this entire incident.

10. I have no more questions. Do you have something more to say?

Answer: It was the complainant who slapped me and threatened to kill
me. I should be the one filing cases against her but I did not do so
because I still respect her like my own mother being the mother of my
live-in partner. Hence I just request for a preliminary/clarificatory
investigation to be conducted to clear this matter.
