CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This contract of service is made and entered into by and between:

The PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICE, of the Department of

Environment and Natural Resources, a government agency with office address at Brgy. Guindapunan
Catbalogan City PENRO Province of Samar herein represented by GRACE B. GRAVOSO and
CYREL A. CENTRO

hereinafter referred to as the “First Party”.

Second Party

- AND -

CYREL A. CENTRO, of legal age, Single, Filipino and with residence address at Brgy. Loyo, Basey,
Samar Philippines hereinafter referred to as the “Second Party”.

- WITNESSETH -

1. That the First Party is in need of the services of the Second Party who shall perform work
not performed by the regular personnel of the First Party;

2. That the Second Party has signified his/her intention, to which the First Party has accepted
provide the services needed by the latter;

3. That the Second Party hereby possesses the education, experience and skills required to
perform the job as described herein;

4. That the Second Party hereby attests that he/she is not related within the third degree of
consanguinity or affinity to the a.) hiring authority and/or b.) representative of First Party, that
he/she has not been previously dismissed from government services by reason of an

administrative offense, that he/she has not already reached the compulsory retirement age of
sixty-five(65);

5. That in view hereof, the Second Party is hereby contracted as Forest Protection Officer for
the month of November 4, 2019- December 31, 2019 in consideration of a monthly rate of
Eight Thousand Five Hundred Pesos Only (₱8,500.00).

5.1 For the purpose of payment for the services herein rendered by the Second Party
shall submit Daily Time Record and accomplishment report covering each part of the Term of
Reference enumerated hereunder for the approval of the OIC, PENR Officer.

5.2 That this Contract shall be subject to the availability of funds and to existing
accounting and auditing rules and regulations.

6. That as Forest Protection Officer, the Second Party is expected to perform the functions
enumerated in the following term of reference:

a. Assist in the preparation of documentary requirements in the filling of cases of apprehended

conveyances and forest products;
b. Assist the conduct of Apprehension activities in violation of PD 705;
c. Provide assistance in the monitoring/surveillance of illegal activities within the jurisdiction
of DENR-PENRO Samar;
d. To assist LAWIN related activities within the jurisdiction of DENR-PENRO Samar;
e. Performs other related activities which may be assigned by the supervisor from time to time;
 7. That the Second Party shall secure a low cost term insurance from the Government
Service Insurance System (GSIS) or any insurance from the company to provide protection
and security in times of emergency and accident;

8. That the Second Party shall be liable for any and all damages that the First Party may

suffer, in monetary or otherwise, that may arise/result out his/her actions or in the performance
of his/her duties. Provided, that if the injured party is a third person other that government, such
aggrieved party may initiate any action against the Second Party in his own capacity and shall
not in any manner implicate the First Party or any of its agency or instrumentality for any liable
thereof;

9. That the Second Party shall perform at a time of the schedule to be agreed upon by
both parties;

10. That the Second Party shall be accountable with all his/her action as a public
employee. Provided that this contract does not create an employee-employer relationship
between the First Party and the Second Party. Provided further, that the services rendered
hereunder are not considered and will be credited as government service. Provided finally, that
latter is not entitled to benefits employed by the regular personnel of the First Party.

11. That this Contract is not covered by Civil Service Law, Rules and Regulations but by
COA rules as provided under section 2, Rule XI of CSC Memorandum Circular No.40, Series
of 1998; and

12. That it is the intention of both parties to form a long and mutually profitable relationship,
However, this relationship may be terminated at the option of the First Party and at
any time in the event that the Second Party fails to carry out the duties and
responsibilities and fails to observe office policies, rules and procedures including
but not limited to the following:

● That during the time of employment, The Second Party may not engage in any work
for any other employee, which will detract from his/her ability to perform duties; and
● Access to confidential information, is a property of the employer (First Party), as
such you are not permitted to disclose this information outside.

It is further acknowledged that upon TERMINATION of EMPLOYMENT, The SECOND

PARTY agrees to return to the FIRST PARTY any property of PENRO Samar.

13. That the First Party and Second Party have agreed that this contract shall be
approved and be in force prior to the drug test result. However, should the drug test result to
be positive, the Second Party shall undergo a confirmatory test at his/her expense. Moreover,

should the confirmatory test be positive, the contract of Second Party shall automatically be

terminated or rescind.

14. That the Second Party is required to register with the Home Development Mutual Fund
(Pag-ibig) in accordance with the provision of Section 7 of R.A.9679 KNOWN AS THE Home
Development Mutual Fund Law of 2009. Enforcing the compulsory coverage of JOB
ORDER/CONTRACTUALS in government entities. Since the working status is a no employee-
employer relationship, both the employee share and employer counterpart shall be shouldered
by the First Party.

15. This CONTRACT shall be governed, interpreted and construed in accordance with laws
governing employment contracts.
 IN WITNESS WHEREOF, both parties have hereunto set their hands this 4TH of November 2019 at DENR-
PENRO Catbalogan City.
