EXTRAJUDICIAL SETTLEMENT OF ESTATE

WITH WAIVER OF SHARES

KNOW ALL MEN BY THESE PRESENTS :

This AGREEMENT, made and entered into by and between the


HEIRS OF CARMELITA LOPEZ REYES namely ---

1. MARCELITA P. REYES, of legal age, widow and a


resident at 860 Pearl Street, St. Augustine Village, San Agustin, City
of San Fernando, Pampanga;

2. RHODERICK P. REYES, of legal age, married to Ranela


R. Reyes and a resident at 860 Pearl Street, St. Augustine Village,
San Agustin, City of San Fernando, Pampanga; and

3. FREDERICK AGUSTIN P. REYES, of legal age, married to


Annel S. Reyes and a resident at St. John Street, St. Jude Village,
San Agustin, City of San Fernando, Pampanga;

LEONIDES B. REYES died intestate on September 1, 2000 in


the City of San Fernando, Pampanga.

During the lifetime of LEONIDES B. REYES, he owned ½


undivided portions of two (2) parcels of land (as his conjugal share)
which are covered by TCT Nos. 340105-R and 340106-R of the
Registry of Deeds for San Fernando, Pampanga and more particularly
described as follows ---

TRANSFER CERTIFICATE OF TITLE NO. 340106-R

“A parcel of land (lot 2-B of the subd. plan Psd-035416-


052415, being a portion of lot 2, Blk. 8 (LRC) Psd-126348 L.R.C.
Rec. No. ), situated in the Bo. of San Agustin, Mun. of San
Fdo., Prov. of Pamp. Bounded on the SE., along line 1-2 by lot 4;
on the SW., along line 2-3 by Rd. lot 5 both of Blk. 8; on the
NW., along line 3-4-5 by Rd. lot 5, all of Psd-126348; on the
NE., along line 5-1 by lot 2-A of the subd. plan. x x x Containing
an area of TWO HUNDRED THIRTY FOUR (234) square meters,
more or less.x x x”

TRANSFER CERTIFICATE OF TITLE NO. 140105-R

“A parcel of land (lot 2-A of the subd. plan Psd-035416-


052415, being a portion of lot 2, Blk. 8 (LRC) Psd-126348 L.R.C.
Rec. No. ), situated in the Bo. of San Agustin, Mun. of San
Fdo., Prov. of Pamp. Bounded on the SE., along line 1-2 by lot 4,
Blk. 8 (LRC) Psd-126348; on the SW., along line 2-3 by by lot
2-B of the subd. plan; on the NW., along line 3-4 by Rd. lot 5;
on the NE., along line 4-1 by lot 1, Blk. 8 both of (LRC) Psd-
126348. x x x Containing an area of
( ) square meters, more or less.x x x”

Due to the death of the said LEONIDES B. REYES, he was


survived by his surviving spouse, MARCELITA P. REYES, and their
two (2) legitimate children, namely --- RHODERICK P. REYES and
FREDERICK AGUSTIN P. REYES --- and the said heirs inherited the
rights and interest of the said deceased over the said real properties.

There are no known debts or obligations due against the estate


of the deceased; and

It is to the best interests of the parties hereto to divide and


partition and adjudicate among themselves the said entire estate of
the decedents extrajudicially, in the form and manner hereinafter set
forth;

NOW THEREFORE, for and in consideration of the premises, and


invoking the provisions of Rule 74, Section 1 of the Rules of Court,
the parties hereto do by these presents agree to adjudicate the
entire estate of LEONIDES B. REYES, adjudicating, as they do
hereby adjudicate and partition, the same to and among themselves
in equal shares of 1/3 each.

Subject, however, to the liabilities imposed by Rule 74, Section


1 of the Rules of Court, in favor of any other possible heirs,
creditors, and other persons who might be deprived of their lawful
participation in the estate of the decedent, for a period of two years;
and

That in the remote event that any other property of the


decedent should later be found which is/are not included hereinabove,
the parties hereto further agree to distribute, divide, and adjudicate,
as they do hereby distribute, divide and adjudicate, the same in like
manner and proportion as herein established and disposed.

That we, RHODERICK P. REYES and FREDERICK AGUSTIN


P. REYES, FOR AND IN CONSIDERATION OF OUR LOVE AND
AFFECTION to our mother, MARCELITA P. REYES, we hereby
voluntarily and absolutely WAIVE our respective shares, rights
and interest over the real property TCT No. 340105-R unto
the said MARCELITA P. REYES.

That MARCELITA P. REYES hereby accepts the said shares


being waived by her sons in her favor, and hereby manifests
her gratefulness for the latter’s generosity and liberality.

That we, MARCELITA P. REYES and FREDERICK AGUSTIN P.


REYES, FOR AND IN CONSIDERATION OF OUR LOVE AND
AFFECTION to RHODERICK P. REYES, we hereby voluntarily and
absolutely WAIVE our respective shares, rights and interest over
the real property TCT No. 340106-R unto the said RHODERICK
P. REYES.

That RHODERICK P. REYES hereby accepts the said shares


being waived by his mother and brother in his favor, and
hereby manifests his gratefulness for the latter’s generosity and
liberality.

IN WITNESS WHEREOF, the parties hereto have hereunto set


their hands at the City of San Fernando, Pampanga, on this 2 nd day
of June 2018.

the LEONIDES B. REYES with Waiver of Shares; they presented to
me competent proofs of their respective identities as reflected above;
they represented to me that their signatures on this instrument were
voluntarily affixed by them for the purposes stated therein; and they
declared that they executed this instrument as their free and
voluntary act and deed.
