Cir.No.CCO/CPPD- COMMITTEES illustrative list of standard texts to be used for
ADV/43/2009-10 OBSERVATIONS recording and communicating the decisions
Dated August 28, 2009 of the credit committees to ensure uniformity.
[Ref.CPP/CIRLTR/BSG/07 dt. It has been felt that the basis for considering
06.05.2000] a remark as an observation or as a condition
needs to be logically explained and it is
desired that the operating functionaries at the
Circle level will internalise the same and
would reflect the committee’s views correctly
while drawing up resolutions. There has to be
a clear statement and unambiguous
distinction between a condition and an
observation. A condition needs to be carried
out and fulfilled within a specific timeframe.
Otherwise there has to be specific waiver
permitted by the appropriate authority. On
the other hand an observation is a direction to
the operating functionaries to pursue a
particular course of action which may result
in accretion of business or mitigation of risk
for the Bank. Therefore, with the support of a
few illustrative examples mentioned in the
Annexure-I to the circular, reiterate the
logical underpinning of treating a particular
comment as an observation or as a condition.
This will be advised to the Circles to ensure
that committee views are correctly
documented which would not only result in
proper compliance but would also result in
enforcement of the effective credit discipline.
Sl.No.357/2009-10 ISSUE OF GUARANTEE BY Issuing of guarantees by banks on behalf
Cir.No.CCO/CPPD-BANK BANKS of corporate entities in respect of Non-

Dated August 28, 2009 debt instruments is not permissible.
Although RBI has not permitted issue of
guarantees by banks on behalf of
corporate entities in respect of NCDs/
Debt instruments as mentioned above it
has clarified that guarantees may be
issued by banks favouring FIs/other
banks/other lending agencies for loans
extended by them. However, SBI in terms
of para 4.26 of Bank’s Loan Policy has
taken a decision not to issue such
guarantees for domestic operations.
Further, the Bank will also not undertake
