NOWSHERA INDUSTRIAL ESTATE-KPEZDMC

SUBJECT: - TRANSFER OF LEASE HOLD RIGHTS OF PLOT NO.95 MEASURING 01-ACRE AT


NOWSHERA INDUSTRIAL ESTATE FROM M/S ASMA MARBLE INDUSTRIES TO
M/S ZAHID MARBLE INDUSTRIES.
PUC is an application received from M/S ASMA MARBLE INDUSTRY, wherein they
requested for TRANSFER OF LEASE HOLD RIGHTS of Plot No. 95, measuring 01-acre at Nowshera industrial
Estate in favour of M/S ZAHID MARBLE INDUSTRY.
HISTORY OF THE CASE:
In the year 2003, an application was submitted by MR. HAKEEM KHAN (PARTNER OF
ASMA MARBLE INDUSTRY) for allotment of 01-acre plot for setting up marble industry (F/A). Feasibility
report of M/S ASMA MARBLE INDUSTRY is also placed in file at F/B. The then Estate Management, vide
Provisional Allotment letter No. 3609-13 dated 22.09.2003 (F/C), allotted Plot No. 95 measuring 01-acre
to M/S Asma Marble Industry upon payment of the then prevailing lease price, receipt placed at F/D.
Accordingly, LEASE DEED of the plot executed in the office of sub registrar Nowshera vide deed No. 1228
dated 25.09.2003 (F/E).

M/S Asma Marble Industry provided an application to this office (F/F) wherein they stated
that they have convened a meeting dated 10.11.2008 in the premises of factory / Plot No. 95 and
directors / partners of M/S Asma Marble industry RESOLVED to transfer the lease hold rights of Plot No.
95 measuring 01-acre in favour of M/S ZAHID MARBLE INDUSTRY through the followings.

In this regard, Affidavit on STAMP paper worth to Rs. 60 in favour of the then SDA by
Directors / Partners of M/S Zahid Marble Industry which is self-explanatory is provided and may be
perused at F/G. Upon instruction of the then Project Management vide letter No. 1417-19 dated 24.3.09,
(F/I) the Directors / Partners of M/S Asma Marble Industry omit /undertake /resolved on stamp paper
worth totalling into Rs. 110 to transfer lease hold rights of the said plot in favour of M/S ZAHID MARBLE
INDUSTRY through its chair holders as specified / mentioned above. Subsequently, the then Estate
Management, vide letter No. 1853-56, dated 23.10.09 intimated the party concerned to arrange payment
of Transfer and change of name fee, in order to proceed further in the instant matter (F/J), but for one
reason or the others, the party failed to do so, till date.

To keep well in picture the high-ups in the best interest of KPEZDMC, some
self-explanatory letters / detailed communications held between the then Estate Management, M/S Zahid
Marble Industry and other concerned must be perused at page No.151-215/C.

Para 53-56 may be perused for Technical and Finance Report submitted by Technical Team
(F/K) and Finance respectively. As per para 55, the party has cleared all outstanding dues upto 30.06.19
dated 2.12.19. However, the New Allottee would be required to deposit, Rs. 125,000/- as transfer fee as
per present prevailing lease price (@5% of the 2.5 Millions)

Keeping in view of the above, the case is submitted for your kind consideration and
further orders (if any), please.
